A federal jury convicted both in November 2025, and on July 7, 2026, He was sentenced to six years in prison and Brody to two years. Each also received a $1 million fine, according to the U.S. Department of Justice (DOJ).
What the federal case was about
The case concerned Done Global, a telehealth company that offered ADHD care through a subscription model. In its June 2024 charging announcement, the U.S. Attorney’s Office for the Northern District of California alleged that He and Brody used the platform to facilitate unlawful online distribution of Adderall and other stimulants, healthcare fraud, and obstruction. Prosecutors alleged Done arranged prescriptions for more than 40 million pills and generated over $100 million in revenue. Those figures were allegations at the arrest stage, not the later sentencing totals. Read the DOJ’s June 2024 announcement.
The indictment was an accusation, not a determination of guilt. The DOJ release stated that defendants are presumed innocent unless and until proven guilty.

The pill and money figures refer to different measures and stages of the case. The 2024 announcement described prosecutors’ allegations about pills and company revenue; the 2026 sentencing account described pills distributed and alleged insurer losses. Revenue and insurer fraud are not interchangeable measures.

What prosecutors presented at trial
The DOJ’s conviction-stage account described trial evidence concerning Done’s advertising, refill practices, clinical decision-making, and representations to insurers and pharmacies. The jury’s verdicts concern the defendants and counts in this prosecution; they do not establish that telehealth prescribing generally, or online ADHD treatment as a category, is unlawful. At the sentencing stage, the DOJ reported more than 37 million Adderall pills distributed and over $12 million in insurer fraud. These are the figures in the sentencing announcement, rather than the earlier arrest-stage estimates.

Why Adderall’s controlled-substance status matters
Adderall contains amphetamine, which the Drug Enforcement Administration (DEA) lists as a Schedule II/IIN stimulant. The DEA describes Schedule II substances as having a high potential for abuse that may lead to severe psychological or physical dependence. Schedule II does not mean a medicine has no accepted medical use: the DEA distinguishes it from Schedule I, which it describes as having no currently accepted medical use. The prosecution centered on alleged and adjudicated conduct involving prescribing, distribution, and fraud—not on a conclusion that appropriate Adderall treatment or telemedicine care is inherently illegal. The DOJ’s case accounts focused on medical necessity, clinical oversight, and alleged false representations.

What patients should do if they need ongoing care
In its December 2025 announcement, the DOJ said patients receiving treatment at Mindful Mental Wellness could contact their insurer for help finding a new provider. The release also points people seeking primary care or other services to the Health Resources and Services Administration (HRSA) health-center locator.
