DOLE Labor Advisory No. 17-22: Weather-Related Work Suspension in the Philippine Private Sector

DOLE Labor Advisory No. 17-22 is historical guidance, not the latest rule for weather-related work suspension. For current decisions, consult DOLE’s August 20, 2026 summary of Labor Advisory No. 14, s. 2026, which says workers may refuse work when weather or similar events pose imminent danger and explains how wages are treated. The 2022 advisory remains useful for understanding the earlier framework, but a weather disturbance does not automatically mean work is suspended.

What Labor Advisory No. 17-22 covered

DOLE issued Labor Advisory No. 17, Series of 2022, to guide private-sector employers on suspending work and paying wages during inclement weather and calamities. In its August 25, 2022 announcement, DOLE said that, except where a law or appropriate proclamation provides otherwise, private employers may suspend work to protect employees’ safety and health. The announcement said employers should coordinate that decision with the safety and health committee, safety officer, or another responsible company officer.

The advisory was not a blanket rule that every storm or other weather event closes every workplace. The 2022 announcement described an employer’s authority to suspend work in response to conditions; it did not say that a weather event automatically suspends work nationwide.

What DOLE’s 2022 summary said about pay

DOLE’s 2022 announcement described the wage treatment this way:

  • Employees who reported for work and worked at least six hours were entitled to full regular pay.
  • Employees who did not work during a suspension were not entitled to regular pay, unless a favorable company policy, established practice, or collective bargaining agreement (CBA) provided for payment.

These are the rules as summarized in DOLE’s 2022 announcement. For a present-day decision, use the later guidance below rather than treating the 2022 summary as the newest position.

What later guidance says about unsafe work and wages

DOLE’s August 20, 2026 release on Labor Advisory No. 14, s. 2026 says workers may refuse work without administrative sanction when weather disturbances or similar occurrences pose imminent danger to their safety and health. This is distinct from an employer’s decision to suspend work: a worker’s refusal under the later guidance is tied to imminent danger, not simply the presence of bad weather.

The same 2026 release summarizes the wage rules as follows:

  • When work is suspended and an employee does not report, the employee is not entitled to regular pay for the unworked time unless a company policy, established practice, or CBA provides otherwise.
  • An employer may allow accrued leave to be used.
  • Employees who work at least six hours receive full regular pay; those who work fewer than six hours receive proportionate pay.
  • Employers may provide additional incentives to employees who report during the conditions.

The release says Advisory No. 14, s. 2026 updates Advisory No. 15, s. 2025. DOLE’s Bureau of Working Conditions Labor Advisories index lists both the 2022 and 2026 advisories, so No. 17-22 should not be described as the latest guidance.

How to assess a weather-related work or pay question

  1. Identify the applicable guidance. No. 17-22 is the 2022 advisory. For current situations, consult DOLE’s 2026 release and the full text of Advisory No. 14, s. 2026.
  2. Determine what happened at work. Establish whether the employer suspended work, the employee worked some or all of the shift, or the employee refused because conditions posed imminent danger.
  3. Check hours worked. Under the 2026 summary, six or more hours means full regular pay; fewer than six hours means proportionate pay.
  4. Check terms that may improve the default. Review any applicable company policy, established practice, CBA, and whether the employer allows accrued leave or offers incentives.
  5. Check other controlling rules. The 2022 announcement expressly made employer suspension authority subject to applicable law or proclamation. A specific dispute may also depend on the full current advisory and the facts at the workplace.

What to verify in a specific dispute

DOLE’s releases summarize the guidance but do not resolve every workplace-specific question. Confirm the full text of Labor Advisory No. 14, s. 2026, any applicable law or proclamation, the employer’s policy and established practice, and any CBA. If the dispute turns on whether danger was imminent or how pay should be calculated, those facts and the governing text matter; the general summaries alone may not settle the outcome.
