DOJ Wanted Google to Sell Chrome. The Judge Rejected the Breakup

The DOJ asked for a Chrome sale, but the judge rejected it. Here’s what the court ordered instead and what the ongoing appeals mean.

The Department of Justice reaffirmed its request for Google to sell Chrome on March 7, 2025, but that request was not a court order. On September 2, 2025, Judge Amit Mehta rejected a Chrome sale and a contingent Android breakup. Google kept Chrome, though the court imposed other restrictions on search-distribution deals and required certain data access for qualified competitors. Appeals remained active as of August 18, 2026.

Why did the DOJ target Chrome?

The case was about Google’s conduct in online search and search advertising—not a finding that Chrome itself was an illegal monopoly. In August 2024, the court found that Google had unlawfully maintained monopolies in key search markets. The remedies phase asked what should change as a result.

Chrome matters to that question because it is both a browser through which people can reach competing search engines and a Google-controlled channel where Google Search can be promoted or set as the default. The DOJ argued that an independent Chrome owner could offer rival search providers a more meaningful route to users. Its case for divestiture was about the relationship between browser ownership and search distribution, not a claim that selling Chrome would itself sell Google Search.

The government’s March 2025 proposal treated Chrome as an important gateway and sought a structural remedy. The judge later concluded that the plaintiffs had not established the necessary connection between Chrome ownership and the proven violation to justify that drastic step. The DOJ’s revised remedies summary sets out the government’s proposal; the court’s opinion explains why the court rejected Chrome divestiture.

What did the DOJ ask the court to do?

In its final proposed remedies, filed March 7, 2025, the DOJ and participating states reaffirmed a package that included:

  • Require Google to divest Chrome. The proposal also addressed the Chromium project and related assets needed to operate the browser.
  • Keep Android structural relief available. The government proposed contingent relief involving Android if Google failed to comply with other obligations or those obligations proved ineffective.
  • Restrict certain search-distribution arrangements. The proposal sought limits on agreements and payments that helped make Google Search the default or exclusive option.
  • Provide specified data access to qualified competitors. The proposed obligations covered certain search-index, user, and advertising data.
  • Review certain future investments. Rather than an outright ban on Google’s AI investments, the revised proposal contemplated government review or notification of certain investments in search and generative-AI competitors.

These were requests for the judge to impose, not obligations that took effect simply because the DOJ filed them. The proposal also did not mean that Google had to stop every payment to a distribution partner.

What did Google argue against a Chrome sale?

Google said the proposed remedies went beyond the conduct established in the liability ruling and could harm consumers, innovation, the economy, and national security. It argued that Chrome was developed as an integrated Google product, not acquired to gain search power, and that separating it from Google would be technically and operationally difficult because features rely on shared systems.

Google also argued that a forced separation could affect security, updates, synchronization, and user experience, and that AI search competition had changed the market. Those were Google’s arguments, not findings that the court accepted as proof that Google no longer held market power. The court’s task was to decide whether the remedies fit the violations it had found.

What did the judge order instead?

On September 2, 2025, Judge Mehta rejected immediate Chrome divestiture and the proposed contingent Android divestiture. The final remedy was primarily behavioral: it restricted certain exclusive distribution arrangements and imposed obligations concerning data or access for qualified competitors. The judgment’s term is six years, according to the Congressional Research Service summary.

The DOJ later described the remedies as prohibiting exclusive contracts involving the distribution of Google Search, Chrome, Google Assistant, and Gemini, alongside data-related obligations. This is narrower than a blanket ban on paying partners or making Google Search available through other products. The DOJ’s announcement of the remedies describes what took effect.

The practical distinction is important: restrictions on distribution arrangements can affect how products are promoted or made default, but they do not transfer ownership of Chrome. Nor does a Chrome sale, by itself, automatically determine Google’s separate search-distribution arrangements with companies such as Apple.

Why was Chrome divestiture rejected?

A structural remedy such as a forced sale can permanently alter a company’s assets and control. The government therefore had to show that this remedy was sufficiently connected to the conduct established in court and appropriate to address it. Judge Mehta found that the plaintiffs had not met the heavy burden for what he characterized as a radical structural remedy, and that Chrome divestiture was not a suitable fit.

The dispute also involved a practical trade-off. The DOJ argued that an independent browser could open a distribution route for rivals and reduce Google’s ability to favor its own search service. Google argued that Chrome’s connections to shared systems made separation disruptive. The ruling did not resolve every hypothetical about how a new owner might run Chrome; it concluded that the proposed breakup was not justified on the record before the court.

What would a Chrome sale have meant for Chromium?

Chrome and Chromium are related but distinct. Chrome is Google’s consumer browser. Chromium is an open-source browser project and technology base used by multiple browsers. The DOJ’s proposed terms contemplated divesting Chrome and Chromium or related assets needed to operate the browser; the court opinion also describes restrictions on Google releasing another browser during the judgment period without court approval.

A Chrome sale would not automatically have transferred every Chromium-based browser to the same buyer. It would, however, have raised operational questions about branding, project governance, security, updates, account sync, Safe Browsing, passwords, search defaults, and extensions. Those questions remain hypothetical because no divestiture occurred.

What does the ruling mean for Chrome users?

  • No need to switch because of the proposal: The DOJ filing did not require users to change browsers, and the final judgment did not order a sale.
  • Chrome did not disappear or change owners: The remedies ruling rejected divestiture.
  • Some distribution practices may be constrained: The court’s restrictions concern certain exclusive agreements, not a general prohibition on offering Google Search or every payment to partners.
  • Future changes remain possible: Appeals could affect the legal outcome, but the current case history does not establish that Chrome will be sold.

For readers choosing a browser for personal reasons, the case does not create a requirement to buy or install anything. A Chrome divestiture might have changed defaults or ownership, but those possibilities should not be confused with events that took place.

The DOJ case page lists the subsequent filings. As of August 18, 2026, appellate proceedings remained active, so the remedies ruling should not be described as ending the entire case.
