DOGE and Social Security: What the State Lawsuits and SSA Records Case Actually Say

The states’ Treasury lawsuit and the separate SSA records case are often conflated. Court filings describe payment-system concerns, PII searches and unresolved data questions, but do not establish that DOGE stopped Social Security checks.

No cited court record establishes that DOGE caused Social Security checks to be stopped. The headline combines separate legal fights: states challenged DOGE-associated access to the Treasury payment system, while labor organizations sued over DOGE team members’ access to Social Security Administration (SSA) records. SSA later disclosed that a DOGE team member searched personal information in an SSA database in March 2025, but that is a different issue from the states’ allegations about payment access.

What the states said DOGE’s Treasury access could mean for Social Security

On February 6, 2025, Arizona Attorney General Kris Mayes and 11 other attorneys general announced that they planned to sue over DOGE-associated access to Treasury payment systems. Their statement warned that access could be used to block critical payments and said, “The President does not have the power to give away our private information to anyone he chooses, and he cannot cut federal payments approved by Congress.” That was the coalition’s legal and political position, not a court ruling.

The suit was reported as filed the next day, February 7. Illinois Attorney General Kwame Raoul’s office said Illinois had joined a coalition of 18 attorneys general challenging expanded access to the Treasury Department’s Bureau of the Fiscal Service central payment system. The coalition argued that the system handles federal payments and state funding and contains sensitive personal and financial information. Social Security payments were among the payments officials said could be at risk if access were misused.

The difference between the two coalition counts is a matter of timing: the February 6 announcement had 12 signatories; the February 7 filing announcement described an 18-state coalition. The states’ warning concerned what access could enable. It does not establish that DOGE blocked benefits or that Social Security payments were actually interrupted.

The SSA records lawsuit is a separate case

Labor organizations separately challenged DOGE team members’ access to SSA records. That case concerned access to agency data, not the Treasury payment system. The distinction matters: the state case raised a risk to payments infrastructure, while the SSA case produced disclosures about searches, permissions and a possible data transfer.

What SSA first told the court

The court issued a temporary restraining order on March 20, 2025. In a March 24 declaration, Acting SSA Commissioner Leland Dudek said the agency had revoked DOGE team access to systems containing personally identifiable information by that date and described deletion and access controls.

What SSA later corrected

On January 16, 2026, SSA and the Justice Department filed a notice correcting the court record after SSA reviewed records obtained during or after October 2025. SSA said that on the morning of March 24, 2025, one member of the then-SSA DOGE team ran personally identifiable information (PII) searches on SSA’s copy of the Numident within its Enterprise Data Warehouse. The agency said the final search was around 9:30 a.m. Eastern Time and access ended around noon. This correction adds detail to the earlier account; it does not say that benefit payments were stopped.

The January notice also described other access episodes. According to SSA, one DOGE team member had access to ten Enterprise Data Warehouse schemas containing PII from March 26 through April 2, 2025, but did not use that access to search or view PII. Another member had a call-center profile capable of accessing PII from April 9 through June 11; SSA said it did not know whether PII was accessed through that profile.

The encrypted attachment SSA could not inspect

SSA said a DOGE team member sent an encrypted, password-protected attachment on March 3, 2025, that the agency believed contained SSA-derived PII, including names and addresses for approximately 1,000 people. SSA said it could not open the attachment to confirm its contents and did not know whether recipients had the password. The agency’s filing therefore described a suspected transmission, not a verified account of exactly what data the file contained or who could open it.

Other matters described in SSA’s filing

The same January 2026 notice discussed a political advocacy group’s request to analyze state voter rolls, a “Voter Data Agreement” signed by a DOGE team member acting in an SSA capacity without normal agency review, and two Hatch Act referrals to the U.S. Office of Special Counsel. These are matters SSA described in its court filing; the notice alone does not establish the ultimate outcome of any referral or related allegation.

What the court rulings did—and did not—decide

On April 10, 2026, the Fourth Circuit vacated the SSA case’s preliminary injunction because the plaintiffs had not shown irreparable harm sufficient to justify preliminary relief. That ruling addressed the basis for an injunction at that stage; it did not decide the underlying claims or declare the challenged access lawful.

The district court case continued after the appellate ruling. In an opinion dated June 26, 2026, the district court allowed limited discovery and denied defendants’ request to rescind that discovery order. The opinion said a motion to dismiss was pending at that time. Those are the latest procedural developments established here; they are not a final judgment on the merits.

The June 26 opinion also recounted a plaintiffs’ factual notice describing a sworn declaration by a senior SSA executive. The notice alleged that directions were given to enter inaccurate death dates, including a request involving 2.7 million people, and the opinion recounted defendants’ response. The opinion did not adjudicate those allegations as proven facts. It would be inaccurate to say that 2.7 million people were established to have been marked deceased.

How the three DOGE-related disputes differ

On May 27, 2025, the state AG offices reported that Judge Tanya Chutkan denied a motion to dismiss and allowed claims against Musk and DOGE to proceed. That procedural ruling was not a final finding that the allegations were true.

What is and is not known about personal data and benefits

  • Benefits: State officials warned that access to the Treasury payment system could threaten or interfere with payments. The cited records do not establish that Social Security checks were stopped because of DOGE access.
  • SSA data: SSA told the court that a DOGE team member searched PII on its copy of the Numident on March 24, 2025. The filing describes the searches as PII searches but does not enumerate the exact fields searched, so it does not establish from the information cited here whether Social Security numbers specifically were searched.
  • Possible disclosure: SSA believed an encrypted March 3 attachment contained SSA-derived information for about 1,000 people, but could not inspect it or verify its precise contents or accessibility to recipients.
  • Legal status: Vacating preliminary relief did not end the SSA case. The June 26 district-court opinion describes discovery and a motion to dismiss still pending at that point; it does not establish a later resolution.
