The up-to-540-day automatic extension is no longer the general rule for EAD renewals filed on or after October 30, 2025. It may still matter if you filed an eligible renewal before that date and already qualified under the earlier rules, or if a separate law or Federal Register notice provides an extension. Your filing date, EAD category and documents determine which rules may apply.
Who can still use the 540-day EAD extension?
The 540 days were the maximum automatic extension for certain eligible applicants who timely filed Form I-765 to renew an Employment Authorization Document (EAD). It was not a blanket extension for every work permit holder. Whether an extension applies depends on the category and the rules covering the renewal.
DHS’s October 30, 2025 interim final rule ended the general regulatory automatic extension for renewal applications filed on or after that date. It does not take away an extension already granted to an eligible application filed before the cutoff. The rule also preserves extensions provided independently by law or a Federal Register notice, including certain TPS-related employment-document extensions. See the DHS interim final rule.
How the filing date changes the answer

Why the policy changed
DHS temporarily increased the automatic extension period to up to 540 days in 2022 and 2024, then made that maximum permanent for eligible cases in a final rule effective January 13, 2025. The October 30, 2025 interim final rule subsequently ended the general automatic extension for later-filed renewals. The earlier policy history explains why some people may still have an extension while a new filing generally does not receive one.
What to do if your EAD is expiring
- Find your renewal filing date. Use the date USCIS received your Form I-765 renewal to determine whether it was filed before or on/after October 30, 2025.
- Identify your EAD category. Check the category on your card and the eligibility rules that apply to it; the 540-day provision did not cover every renewal.
- Check for an existing or separate extension. For a pre-cutoff filing, confirm whether the applicable automatic extension was triggered and what evidence is required. For a later filing, check current USCIS guidance and any law or Federal Register notice applicable to your category.
- Plan the renewal early. USCIS recommends filing a renewal up to 180 days before the EAD expires. That recommendation does not guarantee processing before expiration.
- Check processing time by category. Use USCIS’s live Form I-765 processing-times tool; there is no single processing duration that applies to all categories.
Work authorization and Form I-9 documents
An automatic extension, where one applies, does not mean every expired EAD is acceptable proof in every situation. Work authorization and acceptable Form I-9 evidence can depend on the category and the specific documents an employee presents. Employees and employers should follow current USCIS instructions for the relevant category and documentation rather than assuming the former 540-day rule applies.
