No—not in every context. Sky has UK trade mark rights in SKY for specified goods and services, but a trade mark does not give a company universal ownership of an ordinary word. Whether a particular business use is permitted depends on the registered goods or services, the mark being used and how the public encounters it.
What rights does Sky have in the UK?
The UK Supreme Court’s judgment in the SkyKick case identifies Sky Limited as the proprietor of UK trade mark 2 500 604 for the word SKY. The judgment says it was filed on 20 October 2008 and registered on 7 September 2012, covering goods and services across numerous Nice classes, including software and telecommunications apparatus, telecommunications, and entertainment services. Does a trade mark mean a company owns a word?
No. The UK Intellectual Property Office (IPO) describes a trade mark as a sign that distinguishes one business’s goods or services from competitors’ offerings. A mark’s protection relates to the goods and services for which it is registered and the relevant commercial context; it is not ownership of the word for every use. Can a business use “sky” in its name?
There is no blanket yes or no based on the word alone. Different uses can raise different questions, including:

The Supreme Court’s SkyKick judgment concerns the scope and enforcement of Sky’s registrations, including allegations about their breadth. It does not establish that every third-party use of SKY, or every name containing “sky,” infringes. The sources do not determine the outcome for any particular proposed name.

How to check a UK trade mark
- Use the IPO’s trade mark search service. It provides search options by trade mark number, owner, or keyword or phrase.
- Check the record details and the goods and services listed, rather than relying on a word-match alone. The IPO’s journal also includes accepted UK applications and international applications that include the UK.
