Usually, receiving an inheritance does not count as federal income to the heir. But that does not make every inherited asset or later transaction tax-free: income an asset generates, some inherited retirement-account distributions, a later sale at a gain, and state inheritance taxes can all create tax obligations. In 2026, Kentucky, Maryland, Nebraska, New Jersey, and Pennsylvania impose inheritance taxes; Iowa does not tax deaths on or after January 1, 2025.

Is an inheritance taxable as federal income?

The IRS says, “In most cases, property you receive as a gift, bequest, or inheritance isn’t included in your income.” That rule generally means you do not report the inherited property itself as federal income simply because you received it. It does not exempt income the property later produces or every distribution from an inherited account. See the IRS’s Publication 525 (2025).

  • Income produced after inheritance: Interest, dividends, rent, and income distributed from a trust may be taxable to the person who receives it.
  • Retirement benefits: Some inherited pension or IRA amounts are taxable when distributed. The treatment depends on the account and distribution.
  • Sale of inherited property: Selling an asset for more than its tax basis can create taxable gain; receiving it is a separate event.

How inheritance tax differs from federal estate tax

Federal estate tax and state inheritance tax are different taxes. Federal estate tax is assessed at the estate level, rather than being a general federal income tax on each heir’s receipt. For a person who died in 2026, the IRS lists a $15,000,000 filing threshold for an estate tax return, based on the gross estate and adjustments described by the IRS. This is not a universal tax-free allowance for every beneficiary, and it does not decide whether a state inheritance tax applies. Review the IRS’s estate tax guidance for the applicable filing rules.

Which states impose an inheritance tax in 2026?

The five states identified as imposing inheritance taxes in 2026 are Kentucky, Maryland, Nebraska, New Jersey, and Pennsylvania. Iowa is not among them for deaths occurring on or after January 1, 2025; the Iowa Department of Revenue says inheritance tax does not apply to those deaths. An inheritance tax is generally a state-level tax on a beneficiary’s transfer, but the rules are not uniform across the five states. In particular, a beneficiary’s relationship to the person who died can affect the tax. Kentucky, for example, says closer relatives generally receive a larger exemption and a lower rate. Do not assume another state uses the same categories, exemptions, or rates.

What determines whether a state inheritance tax applies?

Check the facts of the estate and the law in effect for the date of death, rather than relying only on where you live. The relevant questions include:

  • Where the decedent lived: The decedent’s domicile may matter.
  • Where the property is located: Property in another state can raise separate questions. A person’s own state of residence alone may not settle the issue.
  • Your relationship to the decedent: States may provide different exemptions or rates for different beneficiary categories.
  • What was transferred and its value: Rules can differ by property type and value.
  • Who must file or pay, and when: Filing responsibility and deadlines are state-specific.

Current official sources support relationship-based differences, but the figures and cross-border rules should be checked with the relevant state revenue authority for the specific death date. What happens when you sell inherited property?

For federal income-tax purposes, inherited property generally receives a basis tied to its fair market value on the date of death. The IRS describes exceptions, including an alternate valuation date that the personal representative may elect and special-use rules for qualifying property. If you sell for more than your basis, the difference may be taxable gain. A practical checklist for heirs

  1. Identify the asset and the event. Separate receiving property from later interest, dividends, rent, retirement-account distributions, or a sale.
  2. Check the federal treatment. Use IRS guidance for inherited income and account distributions; for an estate, determine whether federal estate-tax filing rules apply.
  3. Check state exposure. Start with the decedent’s domicile and the property’s location, then review the beneficiary relationship, applicable exemptions and rates, and filing and payment deadlines.
  4. Confirm rules for the date of death. State laws and figures can change. Verify details with the state revenue authority or a qualified professional, especially when more than one state is involved.
  5. Keep valuation and transaction records. They can help establish basis and calculate any gain if inherited property is sold.
