An NBFC service supplied to a bank does not attract 18% GST solely because of who provides or receives it. The applicable treatment depends on the service and its classification, whether an exemption applies, and whether a specific reverse-charge rule covers the transaction. Interest or discount on qualifying loans, advances, or deposits is treated differently from separate fees.
Why 18% is not a blanket rule
The phrase “NBFC services to banks” can describe many different supplies. A rate cannot be established from the identities of the parties alone: the underlying service must first be identified and classified, then checked against the applicable rate entry, exemptions, and any reverse-charge notification. CBIC lists the service-rate notification, 11/2017-Central Tax (Rate), separately from the service-exemption notification, 12/2017-Central Tax (Rate), in its Central Tax (Rate) notification index. That index identifies the relevant notification families but does not classify an unnamed contract or establish that every such service is taxed at 18%.
How interest and separate service fees differ
CBIC’s Sectoral FAQs explain that the exemption for extending loans, advances, or deposits applies to the extent the consideration is represented by interest or discount. Charges collected in addition to that interest or discount are not covered by that exemption simply because they relate to the lending or deposit arrangement.
CBIC says: “Any charges or amounts collected over and above the interest or discount would represent taxable consideration and hence liable to GST.” This addresses service, administrative, or entry charges collected in addition to interest or discount. It does not, by itself, establish the rate for every charge; classification and the applicable rate entry still need to be checked.

When reverse charge may matter
Reverse charge is not a general rule for every NBFC-to-bank supply. The notifications identify specific categories and parties. For example, CBIC’s Notification No. 13/2017-Central Tax (Rate) includes services supplied by recovery agents to banks, financial institutions, or NBFCs. A separate amendment addresses services supplied by an individual direct selling agent (DSA) to a bank or NBFC; the GST Council’s Notification 15/2018-Central Tax (Rate) describes that amendment. These entries are specific: they should not be extended to a different supplier, recipient, or service without checking the notification’s wording and amendments.

- Identify the actual supply. Read the agreement and invoice to determine what the NBFC provides, rather than relying on a broad description such as “financial services.”
- Separate the consideration. Distinguish interest or discount from separately billed fees, charges, or other amounts.
- Determine classification and exemption. Check the service classification and whether the facts meet the terms of an exemption, including the interest-or-discount treatment described by CBIC.
- Check reverse charge. Compare the parties and service against the specific notified categories and amendments; do not assume reverse charge applies merely because a bank or NBFC is involved.
- Verify the current rate and documents. Review the applicable rate entry and amendments alongside the agreement, invoice, consideration components, parties’ GST status and locations, and relevant notification or circular.
CBIC’s Circular No. 245/02/2025-GST concerns penal charges levied by regulated entities. It is relevant only when the amount in question is a penal charge; it is not a basis for deciding the treatment of unrelated service fees. The RBI’s Master Circular on Bank Finance to NBFCs, RBI/2025-26/15 provides banking-regulatory context, not a GST rate determination.
