Did Biden Rush CHIPS Awards Before Trump Took Office? What the Timeline Shows

A late-2024 wave of CHIPS Act awards put major semiconductor projects into formal agreements before the presidential transition—but milestone-based funding meant announcements were not the same as cash paid or factories completed.

Yes: after Donald Trump won the November 5, 2024 election, the Biden administration announced a concentrated run of final semiconductor-incentive awards before Trump’s January 20, 2025 inauguration. That timing supports the view that officials wanted to put more of the CHIPS Act program into formal agreements before the transition. But “rush” is an interpretation, not proof that normal review was skipped: negotiations had been under way for months, and many payments remained conditional on project milestones.

What the “rush” claim means

On November 8, 2024, EE Times described the Biden administration as rushing CHIPS Act subsidies ahead of the change in presidential administrations. Its account noted that Polar Semiconductor was then the only company to have received a direct award, while major manufacturers were expected to follow. The label captured an industry interpretation of the political timing; it was not an official statement that the administration had abandoned its review process. EE Times’ November 8 account

The subsequent schedule gave that interpretation substance. Between November 15 and December 20, Commerce announced final awards for large manufacturers and other semiconductor-supply-chain companies. The Biden administration was turning negotiations into formal agreements before leaving office. That does not establish that politics alone drove the timing: Commerce said awards followed due diligence, and the companies had been negotiating for months.

How the late-2024 awards unfolded

The figures below are maximum direct-funding amounts where Commerce stated them. “Up to” is important: it does not mean the full amount was paid at announcement. Loan commitments are shown separately from direct funding.

The timeline began well before the post-election wave. The CHIPS and Science Act was signed on August 9, 2022; the original November 2024 account said Commerce had made its first direct award, approximately $123 million to Polar Semiconductor, in September 2024. Trump was scheduled to take office on January 20, 2025. The interval between election and inauguration therefore became the political window in which many of the largest agreements were finalized.

What the money figures do—and do not—mean

The frequently cited $53 billion associated with the CHIPS Act is not a pot of cash already handed to manufacturers. It covers a broader set of purposes and authorities, including manufacturing incentives and research and development. Commerce’s award announcements also refer to proposed incentives funding and separate loan authority. These measures describe different parts of the program, not contradictory totals.   • Final award: a formal agreement establishing support and conditions. It is more consequential than a preliminary announcement, but it does not guarantee payment of the maximum amount.
  • Direct funding versus loans: direct funding is not the same instrument as a loan. Some announcements included both, and each should be counted separately.
  • Disbursement: Commerce tied payments to project milestones, so the announcement date was not the date the full amount went to a company.

Micron’s December announcement illustrates why status matters: Idaho and New York received final-award treatment, while Virginia was described in preliminary terms. A company can therefore have projects at different stages under the same broad program.

What the awards were intended to build

The program was not limited to cutting-edge logic fabs or companies headquartered in the United States. Its stated industrial purpose extended across the chain needed to manufacture and deliver chips.

  • Domestic manufacturing capacity: Intel’s award supported a U.S.-headquartered manufacturer’s multi-state expansion, making it both an industrial-policy commitment and a test of whether a major U.S. chipmaker could execute large projects.
  • Memory: Micron’s projects and SK hynix’s U.S. plans addressed memory supply, including capacity relevant to AI systems.
  • Mature-node and specialty chips: GlobalFoundries and Texas Instruments represented production used in automotive, industrial, communications, and other applications that do not depend solely on the newest process technology.
  • Packaging, materials, and wafers: Amkor, Absolics, Entegris, and GlobalWafers covered stages and inputs beyond wafer fabrication. A chip supply chain can be constrained by packaging or materials even when a fab exists.
  • Defense and space: BAE Systems and Rocket Lab reflected the need for reliable semiconductor production in strategically sensitive applications.

These projects also expose the difference between announcing investment and delivering capacity. Construction, skilled labor, equipment, permitting, technology transfer, customer demand, and manufacturing yields all affect whether a supported project becomes a productive facility on schedule. A final award is a policy input, not evidence that a fab is already producing chips at commercial scale.

Why foreign-headquartered companies received U.S. support

TSMC, Samsung, and SK hynix are foreign-headquartered companies, as is GlobalWafers. Their inclusion reflects the program’s geographic objective: expand production and related supply-chain capacity inside the United States, even when the company supplying technology, capital, or operating expertise is based elsewhere. The approach can bring experienced manufacturers and advanced processes to U.S. sites, while leaving a political tension over how much a reshoring policy should favor U.S.-owned firms.

A U.S. location does not make a semiconductor supply chain fully domestic. Facilities still depend on specialized equipment, materials, chemicals, intellectual property, and upstream components that may come from abroad. The awards sought to strengthen domestic capacity, not eliminate every foreign dependency.

What a new administration could realistically change

A final agreement makes a program harder to unwind than an application or preliminary memorandum, but it does not make every future decision immutable. The legal and practical levers differ:

  • Repealing the law: Congress would have to change the statutory foundation. That is a different and more difficult route than an administration changing how it manages awards.
  • Slowing or redirecting future support: An administration can make program-management choices that affect pending applications and uncommitted funds, subject to the law and applicable requirements.
  • Changing an executed award: Amendments depend on the agreement’s terms and the circumstances; a new president cannot be assumed to have a blanket power to cancel every signed commitment at will.
  • Withholding or adjusting milestone payments: Payments remain connected to conditions and project progress. If a recipient does not meet requirements, the agreement’s remedies and procedures matter.
  • Changing tariffs or export controls: Trade and technology rules can alter project economics and the wider market without directly rewriting a CHIPS award.

Before the transition, analysts quoted by EE Times expected Trump to be less supportive of the program’s overall design while still having political reasons to favor domestic jobs, manufacturing, and competition with China. Those were forecasts made in November 2024, not proof of what his administration would do. The available evidence supports the narrower conclusion that a new administration could affect implementation and the business environment, while outright repeal or cancellation of every award would involve different legal and political constraints.

How to judge whether the rush worked

The administration could accelerate agreements; it could not guarantee the factories’ eventual performance by signing them. The most useful measures of success are therefore downstream of the announcements: whether projects are built, whether they produce chips reliably and competitively, whether domestic capacity is available in a disruption, and whether the investment strengthens the supply chain rather than simply shifting dependence to another stage.

The late-2024 sequence was unusually dense and included major final awards, so the “rush” description is defensible as a characterization of timing and an effort to formalize commitments before the transition. It should not be read as evidence that the $53 billion had been paid out, that every announced project was unconditional, or that the review process was abandoned.
