Delta’s $78.75 Million Settlement Over 2020 Fuel Dump: What It Covers

Delta’s $78.75 million settlement over Flight DL89’s 2020 fuel jettison has a passed claim deadline and, according to an October 1 report, tentative rather than confirmed final approval.

Delta Air Lines agreed to pay $78.75 million to settle claims tied to Flight DL89’s January 14, 2020 fuel jettison over Southern California. The settlement is not a trial verdict or an admission of liability. As of an October 1, 2026 report, the judge had tentatively approved it at a September 28 hearing, but entry of a written final order was not confirmed in that report.

What happened on Flight DL89

Delta Flight DL89 left Los Angeles International Airport for Shanghai on January 14, 2020. After an engine malfunction shortly after takeoff, the Boeing 777-200ER jettisoned fuel over parts of Southern California and returned safely to LAX. The preliminary approval order says 167 people were aboard. The U.S. District Court for the Central District of California’s November 13, 2025 order describes the flight and aircraft.

The Associated Press reported that the plane dumped about 15,000 gallons. Nearly 60 schoolchildren and teachers were examined for minor skin and lung irritation; none required hospitalization. AP also reported Delta’s explanation that the pilots dumped fuel “to reduce the serious risks of flying and landing an overweight airplane on just one engine.” That was Delta’s stated rationale, not a court finding.

What the $78.75 million settlement means

The agreement establishes a gross settlement fund of $78,750,000. The official settlement FAQ estimated that approximately $50,590,000 would remain for class members after deductions for administration and notice, court-approved attorneys’ fees and costs, and service awards. The two amounts describe different stages of the settlement, not competing estimates of the same payment pool. The official settlement website provides the notice and FAQ; the executed agreement sets proposed maximum deductions, including $24 million in attorneys’ fees, $2 million in litigation costs, $2.1 million in administration and distribution costs, and $60,000 total in service awards. These are caps, not evidence that each maximum was necessarily taken.

Within the owners’ allocation, the settlement provides for equal division per eligible property among qualifying owners who submitted valid claims. The residents’ allocation is divided among qualifying resident class members who submitted valid claims. Individual amounts depend on valid claims and available fund balances; the notice did not state a fixed payment per person or property.

Who the settlement covers—and the claim deadline

The official FAQ says eligibility is tied to owning, residing in, or renting a property on the identified affected-property list on January 14, 2020, subject to exclusions and other settlement requirements. The case, In Re: Delta Air Lines, Inc., No. 2:20-cv-00786 JAK (SKx), consolidated claims brought by residents and property owners, including cases named Lomas, Barajas, Cotton, Garcia, Pait, Castillo, and Amah.

The deadline to file an initial claim was February 6, 2026, and has passed. The settlement materials say class members who remain in the class release specified claims against Delta and other released parties, subject to the agreement and court orders. For individual questions about class membership or a submitted claim, use the contact information on the official settlement website rather than assuming eligibility from a general description.

What the settlement does—and does not—decide

Plaintiffs alleged that the fuel jettison harmed residents and property. Delta denied the claims and wrongdoing. The agreement resolves the litigation without a trial determination about liability, negligence, contamination, or lasting illness. AP reported Delta’s position that settling would “eliminate the distraction and other burdens this litigation has caused to Delta’s business.” A settlement payment alone does not establish that every allegation was proven.

Approval and payment status

The latest located post-hearing report, published October 1, 2026, said Judge John A. Kronstadt tentatively approved the agreement at the September 28 hearing and that a written final order was expected later. The report said it had not found a final order through its September 30 check, while noting that the public docket mirror it checked could lag. Accordingly, the status supported by that report is tentative approval, with written-order status not confirmed—not a confirmed final order or a payment date. The official settlement website still described the hearing as upcoming when accessed October 8, so its pre-hearing wording should not be treated as an updated status notice.

The agreement links Delta’s funding obligation to the settlement’s defined Effective Date and provides for distribution afterward. Because those conditions depend on finality and related procedures, the available status report does not establish when payments will be sent. Check the official settlement site and court docket for later updates before relying on a payment timetable.
