CySEC Recalled the Suspension of the Centralspot Trading Ltd License

CySEC suspended Centralspot Trading Ltd’s CIF authorisation on 7 November 2019, then recalled the suspension on 18 November after finding the firm had met specified capital-ratio and own-funds requirements. The recall was not a new licence or a withdrawal; CySEC’s current register lists the renamed entity, Finteractive Ltd, as a former investment firm with the licence voluntarily renounced.

CySEC suspended the firm’s Cyprus Investment Firm (CIF) authorisation, number 238/14, on 7 November 2019. It published the suspension on 8 November. On 18 November, CySEC decided to recall the suspension after it was satisfied that Centralspot had met specified capital-ratio and own-funds requirements. That decision was published on 19 November 2019.

What CySEC decided

The Cyprus Securities and Exchange Commission (CySEC) recalled the suspension of Centralspot Trading Ltd’s CIF authorisation under section 9(3)(a) of CySEC Directive DI87-05, the directive covering the withdrawal and suspension of authorisations.

CySEC said it was satisfied that Centralspot complied with two provisions of Regulation (EU) No. 575/2013:

  • Article 92(1), concerning the firm’s capital ratio; and
  • Article 93(1), concerning its own funds.

The regulator’s notice did not say that Centralspot had received a new authorisation. It said that the existing suspension was recalled. That distinction matters because a suspension temporarily restricts a firm’s activities, while a withdrawal or renunciation ends the authorisation.

CySEC’s 19 November 2019 recall notice is the primary document for the later decision.

Centralspot’s 2019 regulatory timeline

The dates of the decision and publication are different. The suspension was decided on 7 November but announced publicly on 8 November. The recall was decided on 18 November and announced on 19 November.

Why was the authorisation suspended?

In its 8 November notice, CySEC said it suspected a breach of Articles 92(1) and 93(1) of Regulation (EU) No. 575/2013. The regulator said the suspected breach could create concerns and risks for client protection and could threaten the orderly operation and integrity of the market.

The suspension was imposed under section 71(6)(c) of Cyprus’s Investment Services and Activities and Regulated Markets Law of 2017, together with section 10(1) of Directive DI87-05. CySEC gave Centralspot 15 days to take action to comply with the relevant requirements.

That notice described a regulatory concern, not a final finding that the firm’s authorisation had been withdrawn. The later recall indicates that CySEC became satisfied about the specified capital and own-funds requirements.

What Centralspot could and could not do during the suspension

The suspension was broad. While it was in force, Centralspot was prohibited from:

  1. Providing or carrying out investment services or activities;
  2. Entering into business transactions with any person or accepting any new client; and
  3. Advertising itself as a provider of investment services.

There were limited exceptions for existing business. Subject to the wishes of existing clients, Centralspot could complete its own transactions and existing client transactions already before it, provided it acted in accordance with client instructions. It could also return client funds and financial instruments attributable to those clients.

For a customer checking an old account or dispute, these details are important. The suspension did not mean that every existing transaction automatically stopped, but it did prevent the firm from taking on new clients or conducting ordinary new investment business while the restriction remained in place.

Suspension recall is not licence withdrawal

Some online summaries describe CySEC as having “withdrawn” Centralspot’s licence on 8 November 2019. That description does not match the operative wording of the official decision published that day.

The 8 November CySEC document is headed “Suspension of CIF licence” and states that the authorisation was suspended in full. The later document is headed “Recall of suspension of CIF authorisation.”

There is also an important source of confusion in CySEC’s decisions index. The index currently labels the 8 November entry “CySEC Decision for the withdrawal of authorisation of Centralspot Trading Ltd,” even though the linked PDF describes a suspension. When the index label and the decision’s operative text appear inconsistent, the wording of the linked decision document is the more precise description of what CySEC actually ordered.

What the current register shows

The 2019 recall does not by itself establish that Centralspot remains an authorised investment firm today. CySEC’s current former-investment-firms register lists the entity as Finteractive Ltd, with Centralspot Trading Ltd shown as its previous name.

The relevant CySEC former-investment-firms record therefore places the renamed entity among former investment firms and marks the licence as voluntarily renounced.

What this means for customers

The narrow conclusion is that Centralspot’s suspension was lifted in November 2019 after CySEC received sufficient evidence on the specified prudential requirements. It is not accurate to present the 8 November suspension as a permanent withdrawal.

The broader current-status conclusion is different: the regulator’s present register identifies Finteractive Ltd, formerly Centralspot Trading Ltd, as a former investment firm with the licence marked “Voluntary Renunciation.” Anyone researching the firm should check that current register rather than rely only on the 2019 recall announcement.

When reviewing an old broker relationship, use the following checks:

  1. Search CySEC by both names: Centralspot Trading Ltd and Finteractive Ltd.
  2. Match the licence number, 238/14, rather than relying on the company name alone.
  3. Read the linked decision PDF, not just a search-result headline or decisions-index label.
  4. Check whether a current firm has a valid authorisation before sending money or assuming investor protections apply.
  5. Keep account statements, transfer records and correspondence if you are pursuing a historical complaint or trying to recover funds.

CySEC’s 2019 notices establish the sequence of suspension and recall. They do not, on their own, confirm the safety of any particular customer balance, the outcome of a dispute, or the availability of compensation.

Could Centralspot accept new clients during the suspension?
