Delta’s lawsuit against CrowdStrike is still unresolved. A Georgia judge’s May 16, 2025 ruling allowed parts of the case to continue but did not find CrowdStrike liable. As of CrowdStrike’s latest disclosed filing, dated August 18, 2026, discovery was ongoing. The eventual fight will turn less on who released the update that triggered the crash—which is comparatively clear—than on which losses can legally be traced to it and what the parties’ contract permits Delta to recover.
The July 19, 2024 failure that started the case
CrowdStrike released a content-configuration update for its Falcon sensor on July 19, 2024. The update caused crashes on certain Windows systems, disrupting businesses and critical services worldwide. CrowdStrike describes the incident in its regulatory filings as a content-update failure, not a conventional cyberattack or a Microsoft-originated outage. (CrowdStrike SEC filing)
Delta experienced widespread cancellations, passenger disruption and a recovery effort that lasted longer than many airlines’ responses. The technical trigger and the full financial consequences are separate questions: the lawsuit asks whether CrowdStrike’s testing, release, warnings, support and contractual conduct legally caused Delta’s broader losses.
Why Delta became the test case for downstream losses
Delta alleges that the faulty update disabled or disrupted systems central to its operation and forced extensive manual recovery. Its public statements described cancellations, refunds, reimbursements and other customer-relief measures. Delta also estimated that the disruption cost roughly $500 million to $550 million, depending on the accounting or public statement cited. That is a company estimate, not a court award, and it is not automatically the amount Delta can recover.

CrowdStrike disputes Delta’s account of the prolonged breakdown. It argues that Delta’s own technology choices, system dependencies and recovery decisions helped turn an initial endpoint failure into a larger operational cascade. Crew scheduling, aircraft positioning, passenger reaccommodation and interdependent systems could all affect the length and cost of the disruption. Those issues remain contested; no disclosed court finding establishes that Delta’s architecture or response was deficient.

What Delta alleges
Delta filed its complaint in Fulton County Superior Court, Georgia, on October 25, 2024. The pleading seeks unspecified compensatory and punitive damages and attorneys’ fees. Its theories include contract, tort, computer-access, product-defect and deceptive-practices claims. Allegations in a complaint are not established facts. (Delta’s complaint)

CrowdStrike’s defense: trigger, amplification and contract
It disputes responsibility for every downstream loss
CrowdStrike’s position is that releasing the faulty update does not make it responsible for every consequence that followed. Its filings and public arguments assign significance to Delta’s IT architecture, business-continuity planning and recovery decisions. The company says the airline’s own choices materially contributed to the unusually long disruption. (Associated Press report)
It relies on alleged contractual limits
In a federal declaratory-judgment complaint filed October 25, 2024, CrowdStrike argued that the subscription agreement governed the dispute. It alleged that the agreement capped liability for the incident at twice the fees paid and excluded indirect, incidental, punitive or consequential damages. The enforceability and application of those provisions have not been finally decided. (CrowdStrike’s federal complaint)

It may challenge tort and statutory theories
The defense can argue that Delta is repackaging a contract dispute as negligence, product defect, trespass or deceptive-practices litigation to avoid contractual limits. The outcome will depend on the exact agreement, Georgia law, the duties alleged and whether those duties exist independently of the contract.
Comparative responsibility could reduce recovery
Even if CrowdStrike breached a duty, evidence about Delta’s system dependencies, response time and recovery choices could make causation harder to prove or reduce recoverable damages. A faulty update can be the initial trigger without legally causing every later expense.

The May 16 order determines which theories survive that stage of pleading review. It does not validate Delta’s allegations, decide causation or award damages. Later docket developments should be checked through the Fulton County case-search page. The order itself is available here.

Delta’s estimate is not a judgment
The $500 million-to-$550 million public estimate may include operating expense, lost revenue, passenger refunds, reimbursements, compensation, accommodation and other effects. The complaint does not state a finalized amount awarded by a court; it seeks unspecified monetary relief.
Direct and consequential loss matter
Costs directly tied to restoring systems may be treated differently from lost ticket revenue, network disruption, future customer effects or other consequential losses. The alleged contractual exclusion of consequential damages could therefore matter more than the headline estimate.

A cap could dominate the outcome
If the alleged twice-the-fees cap is enforceable and applies to Delta’s claims, the potential recovery could be far below Delta’s estimate. Questions include the contract’s wording, which services and fees count, and whether exceptions apply for gross negligence, willful misconduct, fraud or other pleaded conduct.
Proof must separate the outage from the cascade
Delta would need to connect specific costs to the update rather than to later scheduling, staffing, reaccommodation or network effects. That will require operational data, accounting analysis and expert testimony.

What discovery could reveal
- CrowdStrike’s change-control, pre-release testing and approval records.
- Internal warnings, customer communications and incident-response logs.
- The executed subscription agreement and any negotiated amendments.
- Delta’s incident-response plans, system-dependency maps and restoration records.
- Manual-work records, cancellation data, refund and accommodation expenses.
- Expert analyses separating the initial outage from later operational effects.
Those records could show whether safeguards were promised, whether they were followed, how quickly each company knew of the failure and which recovery choices affected the duration of Delta’s disruption.
Microsoft and the passenger lawsuits are separate issues
Microsoft was part of the 2024 public blame debate because Falcon operated on Windows systems and Delta also criticized Microsoft. The active commercial case described in CrowdStrike’s disclosures is Delta v. CrowdStrike, not a three-way adjudication of Microsoft’s liability. Public statements about Microsoft should not be treated as findings in the Georgia action.
Passenger litigation is separate as well. CrowdStrike disclosed that putative class actions were consolidated in federal court in Texas, dismissed in June 2025 and affirmed by the Fifth Circuit on May 20, 2026. That result does not decide Delta’s contract and business-loss claims. CrowdStrike’s litigation release is available from its investor-relations site.

Could the case settle?
Settlement is possible but not predictable from the disclosed record. Both sides face discovery costs, expert risk and the prospect of exposing internal testing, recovery and business-continuity evidence. A contractual cap could reduce Delta’s trial upside, while a trial could create reputational risk for CrowdStrike and Delta’s technology and resilience decisions. Those incentives make settlement conceivable, not confirmed.
Business-continuity lessons for technology buyers
The dispute illustrates why resilience depends on more than choosing an endpoint-security brand. Organizations using highly privileged software should evaluate:
- staged or ring-based update deployment and customer-controlled pause or rollback;
- offline recovery, redundant identity and management paths, and tested manual fallbacks;
- independent business-continuity exercises for systems that can become a single point of failure;
- vendor escalation, incident-notification and remediation commitments;
- audit rights, warranties, indemnities, liability caps and consequential-damage exclusions; and
- cyber-insurance and other allocation of outage risk.
Replacing one vendor without changing deployment architecture or recovery planning does not by itself remove concentration risk.
Bottom line
CrowdStrike appears to bear responsibility for releasing the faulty content update that triggered the Windows crashes. But Delta must still prove how that event caused its prolonged operational and financial disruption, overcome any contractual limits and establish that its tort and statutory theories are legally independent. The May 2025 ruling kept the case alive; discovery, not that ruling, will determine what either side can ultimately recover.
