Short answer: no Apple executive was reported jailed. On April 30, 2025, Judge Yvonne Gonzalez Rogers found Apple in civil contempt for violating an injunction in its long-running dispute with Epic Games and referred Apple and Apple vice president of finance Alex Roman to federal prosecutors for possible criminal contempt proceedings. A referral is not an indictment, conviction, or prison sentence.
The provocative headline published by 9to5Mac on May 1, 2025 described a legal possibility, not an event that had already happened. The dispute also was not fully over as of August 18, 2026.

What the judge found on April 30, 2025
The dispute grew out of Epic’s 2020 decision to add an alternative payment system to Fortnite. Apple removed the game, and Epic sued. In 2021, Judge Rogers rejected Epic’s broad federal antitrust claim that Apple operated an illegal monopoly, but she issued an injunction under California law restricting Apple’s anti-steering rules. The original injunction is available through GovInfo.

The injunction barred Apple from preventing developers from telling users about payment options outside Apple’s in-app purchase system, using buttons or links to those options, or otherwise directing customers toward external purchasing mechanisms.

Apple’s response allowed certain external links but imposed a 27% commission on qualifying purchases and included restrictions and design choices that the court viewed as discouraging users from paying outside Apple’s system. Judge Rogers concluded that Apple had not meaningfully complied with the injunction and held the company in civil contempt.
That distinction matters. Apple did not lose every issue in the original Epic case. It won the central monopoly claim at trial. The later ruling concerned whether Apple had complied with the anti-steering injunction and whether its implementation effectively recreated the barrier the injunction was supposed to remove.
Who is Alex Roman?
Alex Roman is Apple’s vice president of finance. He is not Apple’s chief executive officer or chief financial officer, and the available record does not support describing him as equivalent to Tim Cook.

Judge Rogers described portions of his testimony as false or misleading and treated Apple’s failure to correct the testimony as significant.
The record also distinguished among Apple executives. Phil Schiller advocated compliance with the injunction, while Tim Cook ultimately accepted a course supported by Apple’s finance leadership. That does not support the claim that Cook personally lied under oath. The finding described in the available material focused directly on Roman’s testimony.

What does “referred for criminal prosecution” mean?
Judge Rogers referred Apple and Roman to the U.S. Attorney’s Office for possible criminal contempt proceedings. In plain English, the judge asked federal prosecutors to consider whether conduct connected with the order warranted criminal action.
A referral is not:
- an indictment;
- a criminal charge;
- a conviction;
- a sentence; or
- proof that Roman would go to prison.
Criminal contempt generally serves to punish or vindicate the authority of the court. Civil contempt is generally coercive or remedial. The two forms of contempt are related but not interchangeable. The Ninth Circuit explained the distinction in its December 11, 2025 opinion in Epic Games v. Apple.

For Roman to be imprisoned, prosecutors would first have to decide whether to pursue a case. There would then be further legal proceedings, including the opportunity to contest any charges, before a court could impose a sentence.
Did Alex Roman go to jail?
Not according to the material available for this article. The documented events are the civil-contempt ruling, the referral for possible criminal contempt proceedings, and subsequent appeals. No prison sentence or conviction of Roman is established here.
That is why “could be jailed” is materially different from “was jailed.” The former describes a possible consequence of a referral; the latter would assert a completed legal event.

What happened on appeal?
Apple appealed the contempt ruling and also sought to pause its effect. In June 2025, Apple lost an effort to stay or halt the district court’s order while the appeal proceeded, according to Associated Press reporting.
On December 11, 2025, the Ninth Circuit upheld the core civil-contempt determination and the district court’s authority to enforce the injunction. It also addressed the scope and mechanics of Apple’s obligations, including the treatment of certain costs associated with external payments. The exact fee mechanism therefore should not be described as permanently settled.
The civil appeal and the criminal referral are separate matters. Upholding the civil-contempt finding did not automatically convict Roman or create a jail sentence. Nor did later appellate proceedings erase the district court’s findings.
As of August 18, 2026, the litigation remained procedurally active. The Supreme Court docket shows later Apple-related filings. Those filings should not be described as proof that the Supreme Court overturned the contempt ruling or ended the dispute.
What changed for U.S. developers?
Apple’s current App Review Guidelines, listed as updated June 8, 2026, state that for apps distributed through the United States storefront, the previous prohibition on buttons, external links, and other calls to action directing users to outside purchasing mechanisms does not apply. Apple also described related changes in its developer announcement.

This is a significant change for developers selling digital goods and services through iPhone and iPad apps. A business may be able to direct a U.S. customer to an external checkout rather than requiring Apple’s in-app purchase system.
But the change is not worldwide permission to use any payment system without restrictions:
- Storefront matters: U.S. rules may differ from rules in other countries.
- Product matters: The Epic dispute concerns digital goods and services in iOS and iPadOS apps, not every kind of commerce.
- Apple’s documentation matters: External-payment entitlements, APIs, metadata rules, and regional requirements may still apply in particular circumstances. See Apple’s external-purchase documentation.
- Compliance remains the developer’s job: Taxes, refunds, fraud, chargebacks, privacy, customer service, subscription management, and entitlement synchronization do not disappear when Apple’s payment system is bypassed.
The financial trade-off for developers
Using an external checkout can reduce reliance on Apple’s commission structure, but it does not automatically create a 30% improvement in profit. Developers may need to pay a payment processor, manage fraud controls, handle refunds and disputes, calculate sales tax or VAT, support customers, and connect web purchases to in-app access.
Some developers may prefer a traditional processor such as Stripe for payment and billing control. Others may consider a merchant-of-record provider such as Paddle to simplify parts of tax and compliance administration. Larger international businesses may evaluate providers such as Adyen. These services have different fees, responsibilities, settlement arrangements, and technical requirements. Their prices and terms should be checked directly before making a business decision.
The useful comparison is total cost, not headline commission: processing fees plus engineering, support, tax administration, fraud, refunds, failed payments, and reconciliation. Merchant-of-record services may reduce administrative work while limiting control or changing payout economics.

Why the headline was easy to misunderstand
The phrase “it’s time to end this disaster” is an opinion about the prolonged dispute, not a finding by the court. The phrase “could be jailed” is also attention-grabbing but compresses several legal steps into two words.
The more accurate summary is:
Judge Rogers found Apple in civil contempt and referred Apple and Alex Roman to federal prosecutors for possible criminal contempt proceedings. The referral did not charge or convict Roman, and no jail sentence followed automatically.
The case also cannot fairly be reduced to “Apple lost to Epic.” Epic did not win its broad monopoly claim in the original trial. Apple later lost the compliance fight over how it implemented the anti-steering injunction, and that narrower ruling produced the 2025 contempt proceedings.

| June 8, 2026 | Apple’s App Review Guidelines listed the U.S. external-link policy change and this update date. |
Bottom line
Apple faced real legal consequences for how it implemented the Epic injunction, and Alex Roman faced the serious possibility of a criminal-contempt investigation. But a referral is not a prosecution, conviction, or prison sentence. The Ninth Circuit largely upheld the civil-contempt ruling, while the precise economics and mechanics of external payments remained subject to continuing litigation. For developers, U.S. payment-link rules changed materially—but the costs and responsibilities of running an external checkout shifted rather than vanished.
