Re:

Could a Montana Fossil Sale Be Taxable Without Counting Against Social Security’s Earnings Test?

A property sale can be taxable without automatically counting as earnings for Social Security’s retirement earnings test. The seller’s classification, basis, ownership, age, and benefit context matter.

Yes, potentially. A property sale can create a federal income-tax obligation without automatically counting as earnings under Social Security’s retirement earnings test. The test generally concerns wages and net earnings from self-employment; whether a particular fossil sale falls outside it depends on how the property was held and sold. The tax result likewise depends on the seller’s basis and transaction details.

The headline’s auction figures match historical reporting about the Montana fossils known as the Dueling Dinosaurs. That reporting describes an earlier auction that did not meet its reserve; it does not verify that the fossils are currently headed to auction.

What the Social Security earnings test counts

The retirement earnings test is not a general test of whether someone received money. For beneficiaries to whom it applies, it generally counts wages and net earnings from self-employment. Social Security regulations and agency guidance also exclude certain types of income, including gains from sales of capital assets and some dispositions of property outside inventory.

A one-time sale of a fossil could be treated as a disposition of property rather than earnings from a business. But the fact that a sale happens only once does not, by itself, establish its classification. Under the regulation on gains from disposing of property, the treatment can depend on whether the item was a capital asset, inventory, or property held primarily for sale to customers in the ordinary course of a business.

Age and benefit context matter

The earnings test applies in relevant circumstances to beneficiaries below full retirement age. It does not apply once a beneficiary reaches full retirement age, and the year a beneficiary reaches that age has a separate calculation. A seller’s age and benefit type therefore matter before anyone can assess whether the test applies at all.

“Not counted as earnings for the Social Security earnings test” does not mean “not taxable.” Nor does that classification decide whether Social Security benefits are federally taxable. The IRS treats the taxability of benefits as a separate income-tax question that depends on the recipient’s income and filing circumstances.

Why a fossil sale could still have federal tax consequences

For income-tax purposes, gross sale proceeds and taxable gain are not the same thing. The taxable amount generally depends on the seller’s basis and relevant transaction details, not simply on the auction price. Inherited property is generally assigned a basis tied to its fair market value at the decedent’s death, subject to applicable rules. The IRS explains inherited-property basis and reporting in its guidance on inherited property; reportable sales are reported on Schedule D and Form 8949.

That means an auction estimate or hammer price alone cannot establish the seller’s taxable gain. A seller’s basis, expenses of sale, ownership share, and applicable tax rules all affect the calculation. It is also possible for a transaction to have income-tax consequences while not being wages or net self-employment earnings for the retirement earnings test.

What the auction figures do—and do not—establish

The $6 million reserve and $7 million to $9 million appraisal match historical reporting about the Dueling Dinosaurs, two fossils found on a Montana ranch. Bloomberg reported in 2021 that Bonhams had appraised the fossils at $7 million to $9 million. PBS NewsHour reported in 2020 that bidding reached $5.5 million but did not meet the $6 million reserve. The auction therefore failed to meet the reserve in the historical sale reported by those outlets.

Those figures are not evidence of a current auction. The available reporting does not verify a present listing, sale date, venue, or seller, so the claim that the fossils are now “headed to auction” should not be treated as confirmed.

Ownership is a separate question

Before considering taxes or benefits, a seller would need to establish who owns the specimen and what share, if any, is being sold. The Dueling Dinosaurs became the subject of litigation over whether the fossils belonged to the surface estate or the mineral estate. The Ninth Circuit opinion recounts that dispute, and later coverage describes Montana’s 2019 statutory clarification that fossils are not minerals under state law, subject to the terms of the rights arrangement.

That history does not establish that every fossil found on Montana land automatically belongs to the surface owner or any other particular party. The property rights, contracts, and facts governing the particular specimen matter.

Facts needed to assess a particular seller

No seller’s tax bill or benefit reduction can be calculated from an auction estimate. For an individual case, the relevant questions include:

  • Who owns the fossil, and what agreements or property rights govern it?
  • How and when did the seller acquire it, and what is the seller’s tax basis?
  • What sale expenses and ownership shares apply?
  • Was the fossil held as a capital asset, or was it inventory or property held primarily for sale to customers as part of a business?
  • Does the seller receive benefits subject to the earnings test, and has the seller reached full retirement age?

A tax professional can assess basis, gain, and reporting; a Social Security benefits specialist can address the earnings-test classification and benefit context; and a lawyer familiar with property rights can review title and relevant agreements. Those are separate questions, and one answer does not settle the others.
