An unnamed company facing an escalating workplace harassment claim reportedly admitted that ChatGPT had drafted its employee handbook—and that the handbook left out a key anti-harassment policy. The account, reported by Futurism on May 14, 2024, is a cautionary example, not evidence of how often AI-written handbooks fail or a final legal finding about the employer.

What the reported handbook incident involved

Futurism’s Noor Al-Sibai reported that Carly Holm, CEO of HR consultancy Humani, recounted the incident in an interview attributed to Forbes. According to Holm, her client acknowledged using ChatGPT to write its employee handbook, which omitted a key anti-harassment section. Futurism did not identify the company.

Holm warned that when appropriate workplace policies are absent, an investigation may scrutinize the employer. She cited policies addressing sexual harassment and workplace violence as examples. That is Holm’s account and warning, not a jurisdiction-specific statement of law or a reported finding by an investigator or court. Read Futurism’s May 14, 2024 report.

What the story does—and does not—establish

  • It describes one anecdote relayed by an HR consultant about an unnamed client.
  • It does not reproduce the handbook, identify the applicable jurisdiction, or report what happened to the company after the incident.
  • It provides no statistic about how many employers use AI-written handbooks or how often those documents omit policies.
  • It does not describe a test of ChatGPT or establish that the reported omission reflects a general product defect.

Those limits matter: the report illustrates a risk of relying on an unchecked draft, but it cannot establish the frequency of that risk or the legal consequences for this particular employer.

A separate AI-drafted document example

Futurism also recounted a different case, attributed to Daniel Grace, director of Iris. Grace said a UK company used Microsoft Copilot to draft a severance agreement that omitted essential information. He said the company’s lawyer rejected the document and that the company ultimately paid a higher settlement amount. This was a separate reported anecdote about a different document and country—not another account of the handbook incident, nor independently established legal or financial analysis.

What employers can take from the anecdote

AI may help produce an initial draft, but an HR policy document can be incomplete even when it reads smoothly. For employers, the practical lesson is to have a qualified HR professional or employment lawyer review a handbook against the organization’s needs and applicable local requirements before relying on it. The report does not establish a universal checklist or a legal rule for every jurisdiction.
