‘Common Sense Has Prevailed’: What the Whole Milk for Healthy Kids Act Means for Schools and Dairy Farmers

The 2026 law lets participating schools offer whole milk but does not require it. Dairy advocates call it a win for farmers, though its effect on demand and income has not been quantified.

The Whole Milk for Healthy Kids Act of 2025 became law on January 14, 2026. It lets schools participating in the federal lunch program offer whole and reduced-fat milk alongside other permitted options; it does not require schools to serve whole milk. Dairy Farmers of America (DFA) called the law a win for farm families, but the available sources do not quantify any resulting increase in milk demand, farm prices or farmer income.

What the Whole Milk for Healthy Kids Act changes

Public Law 119–69 amends the Richard B. Russell National School Lunch Act. For participating schools, it expands the fluid milk choices that may be offered. The law authorizes flavored or unflavored, organic or nonorganic whole, reduced-fat, low-fat and fat-free milk, as well as lactose-free milk and qualifying nondairy beverages. Those nondairy beverages must meet nutrition standards set by the Secretary of Agriculture, including requirements for calcium, protein, vitamins A and D. The enacted statute is the controlling source for the law’s terms.

The law grants schools permission; it does not order every participating school to offer whole milk. The Congressional Research Service summarizes the change as allowing whole and reduced-fat (2%) milk in federally funded school lunches. Schools retain a range of choices rather than being directed to replace all other milk with whole milk. CRS’s overview explains the policy change and its background.

How the rules differ from the prior policy

Before this change, National School Lunch Program milk rules limited the standard options to low-fat (1%) and fat-free milk beginning in school year 2011–2012. That restriction followed the Healthy, Hunger-Free Kids Act of 2010, which linked program milk rules to the Dietary Guidelines for Americans. The 2026 law changes the permitted choices by adding whole and reduced-fat milk while leaving other listed options available.

What “dairy farmers gain” means—and what remains unmeasured

Dairy Farmers of America welcomed the legislation and described it as a win for children and dairy farm families. DFA President and Chief Executive Officer Dennis Rodenbaugh said: “Common sense has prevailed with Congress and the Senate recognizing the importance of giving kids access to more complete nutrient-rich and delicious beverage options that support growth and overall health.” That statement documents the cooperative’s position; it is not an estimate of the law’s financial effect.

DFA said in its 2025 release that it serves 9,500 farmer-owners. That figure describes cooperative membership, not how many farmers will benefit from the law. The cited sources do not measure changes in school milk purchases, student consumption, farmgate prices or farmer income attributable to the legislation. As a result, “gain” is best understood as an advocacy and policy win for the dairy sector, not a demonstrated or quantified increase in farmers’ earnings.

What schools and families should know about implementation

The statute establishes what participating schools may offer, but the cited sources do not establish a school-by-school adoption schedule or current USDA implementation instructions. A school deciding what to serve in a particular meal cycle should check current guidance from the USDA Food and Nutrition Service. The law’s enactment alone does not show that every school has added whole milk to its menu.
