CLARITY Act Stalls in the Senate; Evidence on Bank Crypto Deals Is Limited

The CLARITY Act failed to advance in the Senate on September 15, 2026, amid ethics, stablecoin-reward, and developer-protection disputes. The available reporting does not establish whether banks continued crypto dealmaking afterward.

The CLARITY Act failed to advance in a Senate procedural vote on September 15, 2026. That setback does not establish that the bill is permanently dead—and it does not show that bankers have kept making crypto deals. The reporting available through October 4 identifies banking-sector involvement in the policy debate, but no named, dated post-stall transactions to support that dealmaking claim.

What is the CLARITY Act?

The CLARITY Act is a proposed U.S. digital-asset market-structure bill. It would create a federal framework for crypto markets, divide oversight between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), and extend traditional bank anti-money-laundering rules to crypto platforms. These are proposed provisions, not rules that took effect: the Senate vote did not enact them.

The Senate Banking Committee advanced the bill 15–9 in May 2026, according to Senator Cynthia Lummis’s office. That committee vote marked progress, but did not guarantee enough support to clear a Senate floor hurdle.

What happened to the bill in the Senate?

The September 15 vote failed to advance it

The Senate failed to advance the measure in a procedural vote on September 15, 2026. The Washington Post reported the tally as 50–49, with 60 votes required; the Associated Press reported the same result as 49–50, using the opposite vote-order convention. The motion failed either way.

As of October 4, 2026, the available reporting does not establish that the bill is formally dead. JPMorgan analysts said another vote was procedurally possible, while assessing the remaining passage window as “extremely narrow.” That is an assessment made after the September vote, not a guarantee that another vote will occur.

Why did the Senate vote fail?

Ethics rules and enforcement

Disputes over ethics provisions for public officials’ crypto interests were a central obstacle. Democrats sought stronger controls and questioned whether the proposed enforcement mechanism could be used against a sitting president. The September draft added a role for state attorneys general, but critics said the enforcement language still fell short. Senator Mark Warner told the Associated Press that Congress could not pass landmark legislation governing the industry while allowing the president to personally profit from it.

Stablecoin rewards and bank deposits

Banks objected that rewards offered by stablecoin platforms could pull deposits away from banks. The September draft would have authorized Treasury to restrict stablecoin platforms if rewards were contributing to runs that hurt community banks. The Block reported that the draft included a “circuit breaker” that could last up to 18 months if payment stablecoins triggered substantial deposit outflows. Banking groups argued that such a measure would activate only after significant outflows had already happened.

This deposit-risk dispute is separate from the ethics debate: one concerns potential effects on banks’ funding, while the other concerns accountability for public officials’ financial interests.

Non-custodial developer protections

The September draft also changed language concerning protections for non-custodial developers. The Block reported that it removed references to a federal criminal statute. Coin Center considered the change insufficient to resolve the key criminal-law issue.

Does the vote show that bankers are still doing crypto deals?

No. The reporting cited here documents banks’ positions in the legislative debate, including criticism of stablecoin rewards, but does not identify a post-stall acquisition, investment, partnership, transaction value, or adviser that would substantiate continued bank crypto dealmaking after September 15.

That absence is not evidence that banks stopped doing deals, either. It means the legislative vote and banks’ policy advocacy cannot by themselves answer whether deal activity continued. A reliable affirmative claim would need specific, dated transaction reporting; without it, the headline-level assertion that bankers are not hitting the brakes goes beyond what these sources establish.

What happens to crypto regulation now?

Congressional legislation versus agency rules

JPMorgan analysts led by Kenneth Worthington wrote after the failed vote that market participants were likely to focus more on SEC and CFTC action. They said agency rulemaking could provide some guardrails and confidence for incremental capital flows, but would be less durable than legislation: agencies can amend or repeal rules under future administrations, and courts can challenge them. Repealing a statute would require another act of Congress.

Route What it can provide Durability and limits
Federal legislation such as the CLARITY Act A statutory market-structure framework, including the proposed SEC/CFTC division and other provisions described above. Changing or repealing a statute requires another act of Congress.
SEC and CFTC rulemaking Agency rules may establish some guardrails, according to the JPMorgan analysts’ September 2026 assessment. Future administrations can amend or repeal agency rules, and courts can challenge them.

The September 2026 vote leaves the statutory route uncertain; it does not itself settle what either agency will do. The analysts’ comparison describes the relative durability of the two routes, not a timetable or assurance of particular agency actions.

Quick Recap

What to watch next

  • Congressional calendar: As of October 4, 2026, JPMorgan analysts said another vote remained procedurally possible before Congress adjourned, but viewed the passage window as extremely narrow.
  • Any revised bill or enforcement language: The ethics dispute and the debate over developer protections were unresolved in the September reporting.
  • Agency actions: SEC and CFTC rulemaking may draw more attention, but the specific actions and their timing are not established by the cited reporting.
  • Transaction-level evidence: To judge whether banks are continuing crypto dealmaking, look for named, dated deals rather than treating committee votes, lobbying, or positions on stablecoin policy as proof of transactions.
