Chinese EVs Inch Closer to the U.S. as Canada Replaces 100% Surtax With a Quota

Canada’s new quota allows up to 49,000 China-origin EVs in the first year at a 6.1% tariff. It authorizes imports into Canada, not the United States.

Canada has opened a limited route for China-origin electric vehicles: up to 49,000 in the first quota year can enter under permit at a 6.1% most-favoured-nation tariff, replacing the former 100% surtax for vehicles admitted under the quota. That brings Chinese EVs into Canada—not into the United States. U.S. officials said the authorized cars were headed to Canada, and the arrangement does not itself grant U.S. market access.

What changed in Canada’s treatment of Chinese EVs?

Canada’s measure is a capped import arrangement, not an across-the-board tariff cut. For vehicles of China origin admitted under the quota, the former 100% surtax has been repealed and the 6.1% MFN tariff applies. Imports outside the quota do not gain that treatment simply because the arrangement exists. The quota and permit rules are set out by Global Affairs Canada and in the Canada Gazette regulation.

Import process Not stated here as a quota-permit system Shipment-specific permit required; allocation is first-come, first-served until further notice
Destination authorized Canada’s import treatment Canada; this arrangement does not authorize entry into the United States

How much of the first-year quota remains?

Global Affairs Canada’s utilization report, updated September 25, 2026 at 3 p.m. Eastern Time, recorded 15,763 vehicles used out of the 49,000 first-year maximum, leaving 33,237 at that snapshot. The report counted 15,603 vehicles in the first period and 160 in the second. These are dated utilization figures, not a promise of availability when an importer applies. Check the live quota utilization report for the latest posted figures.

How the quota and permits work

Quota year and periods

Each quota year runs from March 1 through the following February 28 or 29. The second period of the first quota year runs September 1, 2026 through February 28, 2027. For that period, the August 29, 2026 importer notice gives an access quantity of 24,500 vehicles plus unused volume from the first period.

Who can apply and what requires a permit

Eligible applicants are Canadian-resident electric-vehicle original equipment manufacturers (OEMs). A non-resident OEM may appoint an agent resident in Canada. Global Affairs Canada says permits are issued on demand, first-come, first-served until further notice, and each shipment requires a specific permit. This also applies to temporary imports for testing or demonstration. The operational requirements are in Importer Notice 1168.

Which vehicles count as China-origin

Origin is based on substantial manufacture in China, not only on the location where a vehicle is finally assembled. Under the importer notice, a complete knock-down kit substantially manufactured in China remains China-origin even if exported for assembly in Canada or another country. Electric tricycles and certain non-passenger vehicles are excluded from the quota controls described in the notice.

Does the Canadian quota let Chinese EVs enter the U.S.?

No. The quota governs Canadian imports. In a January 16, 2026 report, Reuters quoted U.S. Trade Representative Jamieson Greer saying, “Those cars are going to Canada — they’re not coming here.” The same report said Greer cited U.S. tariffs and connected-vehicle rules as obstacles. Those remarks describe the U.S. officials’ position at the time; they are not a complete current legal analysis of U.S. import rules. Read the Reuters report on the U.S. response.

“Closer to the U.S.” is therefore geographic and strategic: Canada is a neighboring market where Chinese-made vehicles may now gain limited access. Axios raised the possibility of future factory investment as an open question, not an outcome delivered by the quota. Canadian authorization alone does not establish that a vehicle can be imported into the United States.

Why did Canada make the deal?

The January 16, 2026 preliminary arrangement linked the EV opening to expected Chinese tariff changes on Canadian goods. Canada said it expected China to lower the combined tariff on canola seed to about 15% and suspend certain anti-discrimination tariffs on canola meal, lobster, crab and peas for a specified period in 2026. The Bank of Canada incorporated the arrangement into its January 2026 tariff assumptions. These are the terms and expectations described at the time; they should not be read as confirmation that every promised change has since been completed. See the Canadian government backgrounder and the Bank of Canada’s January 2026 tariff assumptions.

What could the arrangement mean for Canadian buyers and industry?

The federal government presents the quota as a way to make lower-cost EV options available while encouraging Chinese joint ventures with Canadian partners. It has also pointed to potential manufacturing jobs and development of a domestic EV supply chain. Those are expected benefits, not verified results of the policy. The regulatory analysis says the first quota year’s 49,000 vehicles represent less than 3% of Canada’s new-vehicle market, and the government schedules quota growth of 6.5% per year.

The lower-priced-vehicle provision phases in over time. The Gazette says the share reserved for qualifying lower-priced EVs begins at 10% in year two and rises toward 50% over five years; the January backgrounder describes the objective as 50% of the quota for vehicles priced at CAD 35,000 or less by 2030. That is not a 50% reservation of the first-year quota. The official figures and policy rationale appear in the regulatory analysis and backgrounder.

The policy may expand choice, but the available official material does not establish a measured change in Canadian retail prices or compare specific vehicles’ prices, range or performance. A tariff reduction is not itself proof of a particular consumer saving: the quota is limited, permits govern shipments, and the final retail effect depends on factors not quantified in these sources.
