For U.S. employers, federal FMLA duties may overlap with ADA accommodation responsibilities, and state or local rules can add further obligations.
What are the challenges in leave management?
Leave administration is not simply approving or denying time off. Employers must determine which rules apply, give required information, keep accurate records, and handle staffing and pay consistently. A mistake at intake can carry through eligibility decisions, timekeeping, payroll, and return to work.
Coverage and eligibility are separate decisions
Do not assume that every employee or employer is covered by the same leave rules. Federal FMLA employer coverage and an individual employee’s eligibility are distinct questions. The U.S. Department of Labor’s FMLA Employer Guide describes employer responsibilities from a leave request through restoration to the same or an equivalent job.
As historical context, 56% of U.S. employees met FMLA eligibility criteria based on reported tenure, hours worked, and worksite size in the Department of Labor’s 2018 survey, published in 2020. That figure describes the surveyed population and is not a current estimate for every workforce or employer.

Late or inconsistent communication
Employees need a clear way to report a possible need for leave, and managers need to know where to route the request. The Department of Labor says employees must communicate their need to the employer to request FMLA leave or find out whether they qualify. Delays or inconsistent instructions can make it harder for employees to understand their rights and for HR to meet its notice and documentation responsibilities.
Intermittent leave and partial-day records
Some qualifying FMLA leave is taken in separate blocks or on a reduced schedule. Eligible employees may use leave in weeks, days, hours, and, in some cases, increments of less than an hour; only leave actually taken from work may be counted against the entitlement. The precise rules depend on the qualifying reason and circumstances. For example, intermittent leave for birth or placement is available only if the employer agrees. In the Department of Labor’s 2018 leave-taking data, published in a 2020 study brief, intermittent leave was more common for an employee’s own illness (47%) than for a new child (13%). These are historical survey findings, not current rates or predictions for an individual workplace.
FMLA and ADA responsibilities can overlap
FMLA entitlement running out does not automatically settle whether more leave or intermittent time off must be considered. The Equal Employment Opportunity Commission explains that additional leave may be a reasonable accommodation under the ADA unless it would impose undue hardship. A medical leave request may therefore require analysis under both laws. See the EEOC’s guidance on the FMLA, ADA, and Title VII.

Staffing, pay, and employee confidence
Leave can affect scheduling and income, so unclear or uneven procedures can undermine trust. In the Department of Labor’s 2018 employee survey, published in 2020, 15% of U.S. employees reported taking leave for a qualifying FMLA reason in the previous 12 months. Among employees who took leave, 42% received full pay, 24% partial pay, and 34% no pay. These historical results describe the survey, not an employee’s likely pay outcome: pay depends on applicable law, employer policies, benefits, and individual circumstances.
How do you manage intermittent FMLA leave?
Intermittent leave requires records that reflect the actual time away from work rather than a rounded or assumed block. Establish one process for capturing approved schedules and each absence, then reconcile it with timekeeping and payroll.

- Confirm the applicable leave basis. Determine whether the employee and employer meet FMLA coverage and eligibility requirements, and whether the stated reason and circumstances qualify for intermittent or reduced-schedule leave.
- Explain the process and record the decision. Communicate the employee’s rights and responsibilities, relevant documentation requirements, and how to report each absence. Keep the decision rationale and dates with the leave record.
- Log time actually missed. Record the hours or days taken at the level needed to apply the rules, including qualifying partial-hour use. Do not deduct time from FMLA entitlement that the employee did not take from work.
- Keep the schedule and records current. Record schedule changes, relevant certification or recertification dates, entitlement used, and return-to-work status where appropriate.
- Reconcile systems. Compare HR leave records with payroll and timekeeping so that deductions, pay handling, and attendance records align.
The Department of Labor’s 2018 survey data, published in a 2020 brief, found that qualifying FMLA leave averaged about six weeks away from work (28 business days). That is a historical average across the study, not a planning assumption for a particular employee or leave case.
How do FMLA and ADA leave work together?
Consider both laws when a medical leave may relate to a disability. FMLA provides qualifying eligible employees up to 12 workweeks of leave in a 12-month period; military caregiver leave may reach 26 workweeks in a single 12-month period. Those federal limits do not, by themselves, decide whether additional time off is a reasonable ADA accommodation.

When FMLA leave is exhausted, assess any request for further leave under the ADA’s accommodation framework, including whether the requested accommodation would impose undue hardship. Avoid an automatic denial based solely on the FMLA balance. The EEOC’s guidance discusses how these responsibilities may interact. State and local laws may also apply; this overview does not resolve those requirements or an individual case.

A reliable system combines a consistent intake route, a documented decision path, appropriately granular time records, and controlled access to sensitive information. HR should be able to trace what was requested, what decision was made, what time was used, and what follow-up remains without exposing unnecessary medical detail.
- Centralize intake: Give employees one clear channel for reporting a leave need. Train managers to route possible qualifying requests promptly rather than deciding them informally.
- Document the decision path: Record the coverage and eligibility assessment, leave reason, required documentation and notices, dates, and any overlapping-law review.
- Track at the right granularity: Maintain actual hours or days taken, entitlement used, schedule changes, relevant certification or recertification dates, and return-to-work status. Reconcile HR, payroll, and timekeeping records.
- Restrict medical information: Limit detailed medical records to appropriate HR or leave administrators. Give supervisors the restrictions or approved schedule information needed to manage work.
- Plan coverage consistently: Cross-train and arrange staffing coverage, but do not treat ordinary staffing inconvenience as proof that leave is unprotected or as a reason to apply different rules.
- Review local requirements: Map federal processes against applicable state and local family-leave, paid-leave, disability, and sick-time rules. Their requirements are not covered in detail here.
What should an employer look for in a leave-management process or tool?
Whether administration is handled internally, by a specialist service, or with software, assess how well the process supports the work employers must perform. No tool by itself guarantees compliance.

These checks are process-evaluation criteria, not endorsements or claims about any particular provider. Employers still need to review individual circumstances and applicable laws.
