Canada prevailed in the second U.S.–Canada dairy tariff-rate quota dispute under CUSMA, known as USMCA in the United States. In its November 2023 report, the panel majority found that the Canadian measures challenged by the United States were not inconsistent with the treaty provisions cited. The decision was not unanimous: one panelist sided with the United States on whether retailers and food-service operators should be eligible for quota allocations.
What the dairy dispute was about
The case concerned how Canada allocated dairy tariff-rate quotas (TRQs), not whether dairy imports could enter Canada at all. A TRQ allows imports up to a defined quantity to receive a preferential duty rate; imports above that quantity face a different rate. The U.S. argued that aspects of Canada’s administration restricted access promised under the agreement.
The second case followed an earlier dispute over processor-only quota pools. After the first panel ruled against Canada on that practice, Canada changed its policies. The United States argued that the subsequent system still failed to meet the agreement’s requirements.

The panel majority found Canada’s challenged measures were not inconsistent with the provisions the United States cited. The ruling therefore favored Canada on the U.S. claims, but it did not erase the disagreement: one panelist dissented on the retailer and food-service eligibility issue, siding with the United States. The U.S. summary also identifies a split concerning the historical market-share allocation approach.

The key distinction is the policy at issue: the first case concerned processor-only reservations; the second examined the broader rules used to decide who could receive quota and how allocations were administered. The first ruling required a policy change, while Canada’s 2025 briefing says the second ruling did not require changes to CUSMA dairy TRQ administration.

When the ruling was issued and what happened next
The panel issued its final report on November 10, 2023. The governments made it public on November 24, 2023. Canada’s current official case listing marks the case concluded, and Canada says CUSMA dispute settlements have no appeal process.
The governments described the result differently in public statements, while acknowledging the panel outcome. Canadian ministers welcomed the decision and said it supported Canada’s supply-management system. U.S. Trade Representative Katherine Tai said the United States continued to have serious concerns about how Canada was implementing its dairy market-access commitments and would keep seeking the access it believed the agreement promised. That was the U.S. government’s reaction, not a change to the panel’s ruling.

Why dairy mattered to Canada—and what the figures do not show
In its November 2023 statement, the Government of Canada tied the sector’s scale to 2022: more than 9,700 dairy farms, 500 processing plants, $8.2 billion in farm cash receipts, $17.4 billion in dairy sales, and more than 70,000 jobs from dairy production and processing activities. Those figures describe the industry’s economic footprint; they do not establish the legal merits of either side’s position in the dispute.
