Canada is allowing a limited number of Chinese-origin electric vehicles into the country at a 6.1% tariff; the United States has documented a 100% Section 301 tariff on Chinese EVs. That policy gap makes a near-term U.S. copy of Canada’s approach unlikely, though it does not rule out a future change.
What Canada’s new policy allows
Canada’s January 2026 arrangement created an initial annual quota of 49,000 Chinese-origin EVs. Eligible vehicles imported within the quota face Canada’s 6.1% most-favoured-nation (MFN) tariff. The change repealed the 100% surtax that had applied since October 2024 for imports eligible under the quota; it did not create unrestricted or duty-free access. Global Affairs Canada’s announcement describes the quota and tariff, while the regulatory order records the surtax change.
Permits and quota periods govern access
The quota is administered through permits and defined quota periods. Global Affairs Canada’s Import Notice No. 1168 says the second period of quota year one runs from September 1, 2026, to February 28, 2027. It provides for 24,500 vehicles plus any unused volume from the first period. That is an available quantity for the period, not a forecast of imports or sales.
Canada’s customs guidance says the Import Control List was amended effective March 1, 2026, to cover Chinese-origin EVs. It also identifies exceptions for certain temporary imports and personal, non-commercial imports classified under Chapter 98. The permit and quota rules therefore matter alongside the headline tariff rate. The Canada Border Services Agency’s customs notice explains the implementation.

Origin—not just the badge on the car—matters
The regime is based on country of origin and customs classification, not simply the automaker’s brand. Import Notice No. 1168 says a complete knock-down EV kit substantially manufactured in China and exported for assembly in Canada or another country is still considered an EV originating in China. Assembly elsewhere does not automatically take a vehicle outside the quota regime.
How the U.S. policy differs
The Office of the U.S. Trade Representative announced in May 2024 that the United States would raise its Section 301 tariff rate on Chinese EVs to 100%, then finalized that action on September 13, 2024. The USTR’s final action is the documented U.S. policy contrast to Canada’s capped route at the 6.1% MFN rate.

The USTR material establishing that 2024 action does not, by itself, establish whether any later U.S. changes, exclusions, or litigation have altered the rate. The comparison here is between Canada’s 2026 arrangement and the U.S. action documented by USTR; the exact current U.S. tariff status should be checked against later official notices before relying on it for a particular import decision.
Why a U.S. change does not follow automatically
The documented policies point in opposite directions: Canada opened a limited, permit-controlled path for Chinese-origin EVs, while the U.S. action established a 100% Section 301 tariff rate. On that record, the United States has not followed Canada’s lower-tariff quota model, and a near-term copy appears unlikely without a major policy shift or negotiated change.

There is no official announcement in the cited material that Washington will change its approach in response to Canada’s 2026 opening. U.S. Trade Representative Katherine Tai’s August 29, 2024 statement praised Canada’s then-planned restrictive move: “Canada’s actions are an important step towards ensuring workers and businesses can compete fairly in the electric vehicle, steel, and aluminum industries.” That statement concerned Canada’s position at the time; it is not an endorsement of the later quota opening. The USTR statement gives its context.
Future trade discussions could affect policy, but the existence of USMCA automotive discussions does not show that U.S. Chinese-EV tariffs are changing. The USTR page listing a 2026 automotive report is context, not an announcement of a tariff shift. USTR’s automotive initiatives page lists that work.

What the headline figures do—and do not—tell buyers
The 49,000 figure is an annual import quota, not a promise that 49,000 cars will arrive or be sold. Permits, allocations, and demand shape actual imports. Likewise, the 6.1% rate applies to eligible quota imports, not every possible import scenario. Neither figure measures the price a Canadian buyer will pay or the amount a U.S. consumer might save; the official sources cited here do not provide directly comparable estimates of future sales or consumer effects.
For a policy comparison, keep four questions separate: the applicable tariff, the size of any quota, who can obtain the required permits, and whether future investment or trade commitments change the rules. A lower tariff alone does not establish broad availability or a particular showroom price.
