Usually, no—not for ordinary road driving. “Off-road diesel” typically means dyed or rebated fuel restricted by tax rules. Whether you may use it depends on where you are, the vehicle’s class and road-licensing status, and what the vehicle is doing. In the United States, the IRS says a truck used both on a farm and on the highway should use taxed, undyed fuel. In the United Kingdom, red diesel is allowed only for specified vehicle categories and qualifying purposes. These examples are not universal rules; check the law where the vehicle is used.
What counts as off-road diesel?
“Off-road diesel” commonly refers to marked or dyed fuel sold for restricted, often nontaxable, uses. The dye is an identifier; it does not itself determine whether a particular trip is allowed. The governing rules depend on the jurisdiction, the vehicle and its licensing status, and the activity for which the fuel is used.
Before using it, identify the country and state or region, the fuel designation, the vehicle’s class and road status, and whether the trip involves a public road. Also distinguish permission to use a fuel from eligibility for a fuel-tax credit or refund: those are separate questions.
United States: dyed diesel in trucks and cars
Farm use does not make a highway trip exempt
The IRS’s Publication 225 (2025), Farmer’s Tax Guide, says dyed diesel bought for a nontaxable use must be used only for that or another nontaxable use. It gives the example of a truck used both on a farm and on the highway: the truck should not use dyed diesel, even when the highway trip is connected to the farm business. The highway use is taxable, so the guide says to buy undyed, taxed fuel for that truck.

This is about the vehicle’s taxable highway use, not merely whether the trip is part of a farm operation. A truck does not escape the highway-fuel rules just because it carries equipment or performs a specialized task. IRS Publication 510 (December 2025) explains that passenger automobiles and highway-type trucks are examples of highway vehicles, and a vehicle may remain a highway vehicle while performing a special cargo or off-highway function.
Tax credits and refunds are a separate issue
The IRS guide says a taxpayer may be eligible for a credit or refund of excise tax on fuel used for farming on a farm in the United States. That potential tax benefit does not authorize putting dyed fuel in a vehicle for taxable highway use. Keep fuel records and follow the requirements for any credit or refund claim.

United Kingdom: red diesel and rebated fuel
Eligibility depends on vehicle category and purpose
HMRC’s Excise Notice 75 limits rebated fuel to specified vehicle or machine types being used for qualifying purposes. The listed categories include agricultural vehicles, special vehicles, mowing machines, railway vehicles and unlicensed vehicles, including vehicles with a Statutory Off Road Notification (SORN). The qualifying purposes differ by category; permission associated with one category should not be assumed to apply to another.
For agricultural vehicles, qualifying purposes listed by HMRC include agriculture, horticulture, aquatic farming or forestry; certain maintenance of public-road verges, hedges or trees; and specified snow, ice, frost or flood work. The vehicle’s category and the actual use both matter.

A general-haulage-licensed tractor cannot use red diesel
HMRC’s agricultural vehicle licensing and fuel guidance says a tractor with a vehicle excise licence for general haulage cannot use red diesel, either on or off public roads—even while doing agricultural, horticultural or forestry work. Its general-haulage licensing means it is licensed for other work and is not treated as being used solely for those qualifying purposes.
HMRC identifies unlicensed vehicles not used on public roads as potentially qualifying under the unlicensed-vehicle category, subject to the applicable rules. A SORN vehicle must not be used on a public road.

What penalties can apply?
U.S. federal dyed-fuel penalty
The IRS says knowingly holding or using dyed fuel for taxable use can trigger a penalty, in addition to any tax imposed. Under Publication 510 (December 2025), the penalty is the greater of $1,000 or $10 per gallon involved. After the first violation, the $1,000 component increases according to the number of violations. The publication also addresses selling dyed fuel for a use known or reasonably expected to be taxable and willfully altering the dye; its limited exceptions to the dye-alteration penalty are not general permission to use dyed fuel on the road.
That federal penalty is not necessarily the total cost in every case: tax and applicable state consequences may also matter. The cited amount is the IRS figure, not a rule to apply to other countries.

UK penalties
The HMRC guidance cited here establishes conditional eligibility for red diesel and rebated fuel but does not establish one general penalty amount for every scenario. Consult the applicable HMRC rules for the circumstances rather than assuming a single figure applies.
Check these details before filling up
- Confirm your jurisdiction. Find the tax and vehicle-use rules for the country and, where relevant, the state or region where the vehicle will operate.
- Identify the fuel. Check whether it is dyed, marked or rebated fuel and which restricted-use rules apply.
- Check the vehicle’s category and road status. Registration, licensing, general-haulage status and SORN can affect eligibility.
- Match the actual activity to a permitted use. Do not assume that farm-related work or being physically off a public road is enough.
- Keep fuel use and tax claims distinct. A possible credit or refund does not by itself permit restricted fuel in a road vehicle.
The U.S. and UK rules above are jurisdiction-specific examples. They do not establish the rules for every U.S. state, Canada or any other country.
