Your options depend on what the seller promised, whether the NFT or associated digital content was delivered as agreed, the marketplace’s terms, how you paid, and which country’s rules apply. Act promptly: dispute windows can be short, and a cryptocurrency transfer is generally difficult or impossible to reverse.
What to do first if an NFT project or marketplace has failed
- Save your evidence. Keep the transaction hash and receipt, the listing, the project description and roadmap as they appeared when you bought, the marketplace terms that applied to the sale, and relevant emails or messages. Record what was promised and what was not delivered or stopped working. The US Federal Trade Commission (FTC) recommends keeping communications and checking claim deadlines.
- Ask the seller for a specific remedy. Contact them promptly, explain what was promised and what happened, and state whether you are seeking a refund, cancellation, or another remedy. Keep a copy of your request and any reply.
- Use the marketplace’s official support or dispute process. Ask whether the particular seller and NFT qualify for a claim and what deadline applies. The FTC advises contacting the seller first and reporting the seller to the marketplace if the problem is not resolved.
- Contact your payment provider immediately. Ask whether a dispute is available for this transaction and what evidence and time limit apply. Describe the transaction accurately: a project losing value is not the same as an unauthorized payment or an item not received.
- Report suspected fraud through the appropriate local official channel. Keep the report factual and include your records. A marketplace disappearing, by itself, does not prove fraud or guarantee reimbursement.
Which refund route might apply?

Does a marketplace have to refund you?
Not necessarily. The FTC’s November 2024 marketplace guidance says, “Some marketplace operators leave it completely up to the sellers and buyers to decide how to handle payments, returns, refunds, delivery, and other issues.” Other operators may offer claims for items not as advertised or not received, but their terms can limit which sellers or items qualify and set short deadlines.
Check the terms that applied when you made the purchase, not just the marketplace’s current homepage or general help page. If the platform has closed or stopped accepting claims, that may make its process unavailable; it does not by itself establish that the platform owes you money. A seller’s promise and any separate consumer-law rights may still matter.
When can consumer or contract law help?
The key issue is not simply whether a project became inactive. It is what the seller committed to provide and whether the actual NFT or associated digital content met the agreement. A roadmap, community plan, or hoped-for resale value may not have become a contractual promise. The facts can differ if the seller represented that particular content or functionality would be supplied and it was not.

United Kingdom: digital-content remedies
The UK Consumer Rights Act 2015, Part 1, provides remedies when digital content does not conform to the contract. Depending on the circumstances, these can include repair or replacement and, where the statutory conditions are met, a price reduction. The Act also provides a refund right in specified situations involving breach of the statutory right to supply. A qualifying statutory refund must be paid without undue delay and within 14 days after the trader agrees that the consumer is entitled to it; the original payment method is used unless the consumer expressly agrees otherwise.
These provisions are not a blanket guarantee for NFT-project failure. Whether a particular NFT purchase qualifies depends on the content, the contract, whether the seller was acting as a trader, and the facts of the breach.

European Union: a limited MiCA withdrawal right
Article 13 of the EU Markets in Crypto-Assets Regulation (MiCA) provides a 14-calendar-day withdrawal period for certain retail holders who buy covered crypto-assets directly from an offeror or a service provider placing them on the offeror’s behalf. Reimbursement is ordinarily due within 14 days after the withdrawal notification. The rule excludes assets already admitted to trading before purchase and does not permit withdrawal after a time-limited offer’s subscription period ends.
Do not assume that every NFT or NFT transaction falls within MiCA Article 13. First determine whether the asset and the way it was offered or sold are within the provision’s scope.

Can you dispute an NFT purchase with your card or bank?
Possibly, depending on the payment route and the reason for the claim. In UK Financial Conduct Authority (FCA) guidance, a buyer who paid by card for something not received may ask the card provider about chargeback. For a credit-card purchase costing more than £100 and less than £30,000, section 75 of the Consumer Credit Act 1974 might also apply. Section 75 does not apply to purchases under £100, although chargeback may be available. These are conditional options, not guaranteed outcomes, and may not fit a purchase made in cryptocurrency or a complaint that the NFT simply lost value.
The FCA also describes reimbursement rules for eligible authorised push payment fraud sent through the UK Faster Payments System or CHAPS on or after 7 October 2024, subject to conditions and possible exceptions. That is a fraud-specific route, not a general remedy for a failed NFT project.

For US consumers, the FTC advises contacting a card issuer when a card dispute is available. It warns that cryptocurrency payments are like sending cash and generally cannot be recovered once sent. Do not describe a payment you authorized as unauthorized merely because the project disappointed you; give the provider an accurate account and ask which dispute category, if any, fits.

Not automatically. A project that closes, abandons its roadmap, or loses market value may be disappointing without proving that the seller committed fraud. Fraud concerns require facts beyond failure alone; preserve evidence of representations and communications, and report suspected misconduct through official channels. A payment provider’s fraud-reimbursement rules also have their own definitions and conditions.

In the UK, the FCA says direct investments in cryptoassets and NFTs are outside its regulatory oversight and are not protected by the Financial Services Compensation Scheme (FSCS). It cautions: “As a result, if you buy cryptoassets you should be prepared to lose all the money you invest.” That warning concerns UK financial-services oversight and FSCS protection; it does not decide every possible consumer, contract, or fraud claim.
What determines whether a refund is realistic?
- What was promised: distinguish specific contractual commitments from a project roadmap, promotional language, or expectations about future value.
- What happened: non-delivery, missing or nonconforming content, an unauthorized payment, and a fall in market price are different kinds of disputes.
- Who sold it: marketplace policy, consumer protections, and contract rights can depend on whether the seller was a trader and what role the platform played.
- How you paid: card and some bank-payment routes may permit disputes under conditions; a completed cryptocurrency transfer is generally much harder to recover.
- Where the transaction is governed: UK, EU, and US rules address different situations and should not be treated as one global standard.
- What deadline applies: check the marketplace, card issuer, bank, or statutory process promptly rather than waiting for the project to restart.
If the amount is significant or the seller disputes your account, consult the relevant regulator, a local consumer-advice service, or a qualified adviser in the country whose law may govern the sale. The available remedy depends on the specific contract, seller, payment, and evidence.
