Can You Claim Your Unborn Child on Your Taxes?

A child still unborn at year-end generally cannot be claimed on that year’s federal return. A child born alive during the year may qualify if IRS requirements are met.

No—not for U.S. federal income tax purposes if the child is still unborn at the end of the tax year. If the child is born alive during that tax year, you may be able to claim the child as a dependent and qualify for applicable credits, including the child tax credit, even if the birth is on December 31. The other eligibility tests and official proof of live birth still apply.

What counts as a birth in the tax year?

The key distinction is whether the child was born alive by the end of the tax year. A pregnancy that continues past December 31 does not qualify for the IRS birth-year rule for that year. A child born alive during the year may qualify, subject to the requirements below.

Can you claim a baby born on December 31?

Potentially. The IRS says a child born alive on December 31 may qualify for the child tax credit if the applicable tests are met. A year-end birth does not automatically make a parent eligible for the credit or for every other tax benefit; each benefit has its own requirements. See the IRS Dependents FAQ.

What requirements apply to a child born alive?

Born-alive status and official proof

Under IRS Publication 501 (2025), state or local law must treat the child as born alive, and you must have proof of live birth, such as an official birth certificate. The IRS materials do not decide how every jurisdiction classifies a particular pregnancy outcome. If the classification is uncertain, check the applicable state or local law and official records.

Dependency tests

The child must meet the applicable qualifying-child tests, including relationship, age, residency, support, and joint-return requirements. For the birth year, the ordinary rule that a child lived with you for more than half the year has a special application: the child is treated as meeting the residency period if your home was the child’s home for more than half of the time the child was alive. Required hospitalization after birth is addressed in Publication 501.

Separate credit eligibility

Being able to claim a child as a dependent does not by itself establish eligibility for a tax credit. For example, the child tax credit has its own requirements; check the instructions for the return year you are filing.

What if the baby’s Social Security number is pending?

The IRS says a return claiming a newborn as a dependent must include the child’s Social Security number; it will not allow the claim without the number on the return. If the number has not arrived, consult the IRS FAQ guidance on a pending SSN for filing, extensions, and amending. The FAQ notes that amending after the due date can affect timing requirements for the earned income credit and child tax credit.

Keep records and check the right tax-year guidance

  • Keep official proof of live birth, such as a birth certificate.
  • Include the child’s SSN when claiming the child as a dependent.
  • Use the forms and instructions for the specific tax year you are filing. The cited Publication 501 is the 2025 edition; confirm current IRS guidance for another return year.
  • This answer concerns U.S. federal individual income tax. State tax treatment may differ, so check your state’s rules separately.
