Yes, but sharing custody does not automatically let both parents claim the same child. For federal tax purposes, the parent the child lived with for more nights during the tax year is generally the custodial parent and can usually claim the child. If the parents had exactly equal nights, the parent with the higher adjusted gross income (AGI) generally wins the federal tie-breaker. The other parent may claim the Child Tax Credit (CTC) if the custodial parent makes a valid release—usually on Form 8332—and the claimant and child meet the credit’s other requirements.
This guide covers federal rules for tax year 2025, generally for returns filed in 2026. Tax rules and amounts can change, so check the IRS instructions for the year on your return before relying on a 2025 detail for another year.

How does the IRS decide which parent can claim the child?
The IRS uses the child’s actual overnight count, not the custody label in a parenting plan or the parents’ informal description of who has “primary custody.” In general, the parent with whom the child lived for the greater number of nights during the tax year is the custodial parent for federal tax purposes. The other parent is the noncustodial parent for this rule.

For example, if a child lived with one parent for 183 nights and the other for 182 nights in a 365-night year, the first parent generally has the greater number of nights. The point of the example is the comparison: count the nights for the tax year in question rather than assuming that a 50/50 arrangement, alternating weeks, or a decree’s terminology settles the tax claim.

If the parents had exactly equal nights
When the overnight count is exactly equal, the IRS tie-breaker generally assigns custodial-parent status to the parent with the higher AGI. This determines which parent is treated as the custodial parent under the federal rule; it does not mean that both parents can claim the child or divide a single child’s dependency claim between them for the same year.
What to compare before filing
Work through these facts in order. A later step does not replace an earlier one:
- Nights: Determine how many nights the child lived with each parent during the tax year.
- Tie-breaker, if needed: If the count is equal, compare the parents’ AGIs.
- Release: Check whether the custodial parent signed a release that applies to the tax year, and whether it was revoked with the required notice.
- Paperwork: Check the release form and any older decree or agreement against the IRS rules that apply to its effective date.
- Credit eligibility: Confirm that the child and the parent claiming the credit meet that tax year’s dependency, age, identification-number, income, and tax rules.
Can the noncustodial parent claim the Child Tax Credit?
Usually, the noncustodial parent cannot claim the child merely because the parents share custody, split expenses, or have an agreement about who will claim the child. The custodial parent generally has the claim unless the parents meet the IRS special rule and the custodial parent releases the claim to the noncustodial parent.

The special rule generally applies when the parents are divorced or legally separated, separated under a written agreement, or lived apart throughout the last six months of the year, and the child was in the custody of one or both parents for more than half the year. Under that rule, the custodial parent must release the claim and the noncustodial parent must attach the release to the return. The exact conditions and exceptions matter; consult the applicable IRS Publication 504, Publication 501, and Form 8332 instructions rather than assuming that any shared-custody arrangement qualifies.
One child, one dependency claim for the year
A child cannot be treated as a dependent of two taxpayers for different portions of the same tax year. The IRS states that an individual may be a dependent of only one taxpayer for a tax year. Parents therefore cannot split a child’s claim by months, nights, or halves of the year. The question is which parent is entitled to claim the child under the federal rules, including whether a valid release applies.
How Form 8332 transfers the claim
Form 8332 is the usual way for the custodial parent to release the claim for a child to the noncustodial parent. A substantially similar statement can qualify if it contains the information the IRS requires. The noncustodial parent generally attaches a copy of the release to the return for each year the child is claimed.

- Identify the parent who has the claim under the federal rules. Start with the overnight count and apply the AGI tie-breaker if the count is equal.
- Check that the special rule applies. Confirm the parents’ relationship or living arrangement and the child’s time in the custody of one or both parents against the current IRS instructions.
- Complete the release for the right year. The custodial parent can release the claim for the current year or specify future years. Confirm that the release covers the year being filed.
- Attach the release. The noncustodial parent generally includes a copy with the return for each year claimed. Follow the instructions for the filing year.
- Check for a revocation. A prior release may have been revoked, and notice timing determines when the revocation becomes effective. For a 2025 claim, Publication 504 (2025) says the custodial parent must have given, or made reasonable efforts to give, written notice in 2024 or earlier for the revocation to take effect for 2025.
A release does not guarantee that the noncustodial parent will receive a CTC. The parent still has to meet the applicable credit rules, and the release must be valid for the year at issue. If the parents disagree about who filed correctly, compare the actual nights, release and revocation history, and relevant decree dates. Do not assume a divorce or custody decree by itself overrides the federal attachment requirements.

Form 8332 releases the claim for the child for certain tax purposes; it does not transfer every tax benefit connected to the child. If otherwise eligible, the noncustodial parent may claim the CTC, the Additional Child Tax Credit (ACTC), or potentially the Credit for Other Dependents (ODC). The release does not let that parent claim the following benefits on the basis of that child:
- Head-of-household filing status
- The earned income credit (EIC)
- Dependent-care benefits
Those benefits are not included in the release. In particular, signing Form 8332 should not be treated as a general handoff of all tax benefits or as a change to which parent is the custodial parent under the overnight-count rules.

Does the child qualify for the 2025 Child Tax Credit?
Custody paperwork answers who may claim the child; it does not establish that the child qualifies for the CTC. For tax year 2025, the child generally must be under age 17 at the end of the year, be claimed as a dependent, meet the qualifying-child tests, and satisfy the citizenship or residency test. The claimant must also meet the applicable income and tax-liability rules.
The IRS’s 2025 tax-year guidance sets the CTC at up to $2,200 per qualifying child. “Up to” is important: the amount a taxpayer can claim may be lower because of income and tax-liability rules. The amount is specific to tax year 2025, not a permanent annual figure.

2025 SSN requirements
For the 2025 CTC or ACTC, the child must have an SSN valid for employment that was issued before the return’s due date, including extensions. For a joint return, at least one spouse must also have an SSN valid for employment issued by that deadline. The other spouse on the joint return must have an SSN or ITIN issued by the deadline. These are tax-year-specific requirements; check the relevant year’s Schedule 8812 instructions if filing for another year.

2025 income and ACTC figures
The 2025 Schedule 8812 instructions set the modified AGI thresholds at $200,000 for most filing statuses and $400,000 for married filing jointly before the CTC amount begins to phase down. The 2025 ACTC is up to $1,700 per qualifying child, and the IRS’s 2025 guidance requires at least $2,500 of earned income to be eligible for the ACTC. These figures do not establish the amount any particular parent will receive; eligibility and the calculation depend on the taxpayer’s circumstances and the applicable instructions.
Can a custody decree replace Form 8332?
Often, no. The decree’s effective date matters. For a decree or agreement effective after 2008, decree pages generally cannot substitute for Form 8332. A decree that says one parent may claim the child does not, by itself, satisfy that paperwork rule.
There are limited older-document exceptions. Certain agreements effective after 1984 and before 2009 can qualify if they contain the required terms and are attached as instructed. The IRS also describes a narrow exception for certain pre-1985 decrees. Because these exceptions depend on the document’s date and exact language, do not rely on an old decree without checking the applicable IRS instructions.
A practical filing checklist
- Count the child’s nights with each parent for the tax year; use the IRS AGI tie-breaker if the count is equal.
- Identify the custodial parent under federal tax rules rather than relying only on labels in a custody arrangement.
- If the noncustodial parent plans to claim the child, verify that the special rule applies and that a valid release covers the year.
- Check whether a prior release was revoked and whether the required notice timing makes the revocation effective.
- For an older decree or agreement, verify its effective date and whether it meets a specific IRS exception.
- Confirm the child’s age, dependency and qualifying-child tests, citizenship or residency status, and applicable SSN requirements.
- Check the claimant’s income and tax situation against the instructions for the tax year being filed.
- Do not treat a release as transferring head-of-household status, the EIC, or dependent-care benefits.
This is a federal-rule overview, not a determination for an individual family. The result can turn on exact overnight counts, living arrangements, the decree’s effective date, release or revocation paperwork, and the child’s and claimant’s eligibility. For a different tax year, use that year’s IRS publications and forms.
