How does an election contract settle?
These products are described by Polymarket and the CFTC as event contracts, rather than conventional sportsbook bets. The specific contract rules govern what counts as a result and when the contract expires.
Example: a named candidate wins
In a CFTC-filed example, the question is whether Jane Smith will win the November 2026 Arizona Senate election. The contract’s cited settlement criterion is official certification by Arizona election authorities: a qualifying “yes” result pays $1, while a “no” result pays $0. The example is not a claim that this specific market is currently listed.

Certification, expiration, and disputes
Under the cited terms, media projections, exit polls, analyst commentary, and third-party speculation are not settlement data. The filing also says certain changes or litigation after the contract’s expiration date do not affect settlement. A market’s wording, named source agency, expiration date, and contingencies can differ, so read the individual contract and current rulebook rather than assuming every election market resolves identically.
Who may be restricted from participating?

The answer is contested, not a simple nationwide yes or no. Polymarket says its U.S. service operates through a CFTC-designated exchange and clearing framework. The CFTC has asserted federal jurisdiction over prediction markets, while New York has sued alleging unlicensed gambling under state law. The available reporting as of October 8, 2026, does not establish a final ruling in that case or settle how federal and state authority applies nationwide.

- December 3, 2021: The CFTC announced an enforcement order finding that Polymarket had operated an unregistered or non-designated online event-based binary-options facility. The order required a $1.4 million civil monetary penalty, winding down noncompliant markets, and a cease-and-desist undertaking. It said the company had offered more than 900 separate event markets since inception; that is a historical count, not a current U.S. market or volume figure.
- February 17, 2026: The CFTC said it had filed an amicus brief in the Ninth Circuit asserting its exclusive jurisdiction over U.S. commodity-derivatives markets, including prediction markets. That is the agency’s legal position, not a final ruling about Polymarket or every state dispute. Chairman Michael S. Selig said event contracts can help people hedge event-driven risks and manage portfolio exposure, and can provide information about future outcomes; this describes the CFTC’s view.
- May 2026: Polymarket says its U.S. designated contract market and clearing organization, operated by QCX LLC, fully launched.
- September 24, 2026: The Associated Press reported that New York sued Polymarket in state court, alleging unlicensed gambling and asking a judge to block its operation in the state; the state also sought fines and restitution. The report does not say the court granted that relief. Governor Kathy Hochul characterized the service as an unlicensed gambling operation and said it put New Yorkers, especially underage people, at risk. Polymarket Chief Legal Officer Neal Kumar responded, “We’ll fight for our users.” These are statements by the parties, not court findings.
The 2021 order is relevant history about the CFTC’s registration requirements, but it predates the company-reported launch of Polymarket US and does not describe the current U.S. service’s registration status. Conversely, the company’s exchange designation does not by itself resolve the state-law challenge. Avoid treating either side’s position as a final nationwide answer.
What this means if you are considering a market
- Confirm you are using Polymarket US, not the international platform; the company says U.S. traders may not use the latter.
- Check the exact contract’s rules, source agency, expiration date, and settlement conditions before trading.
- Review current eligibility and restricted-participant rules; the filed terms include under-18 and specified election-related restrictions.
- Do not infer that a market is currently available, or that access is free of state-law dispute, just because its category appears in a CFTC certification record.
The available sources do not establish a current U.S. election-market trading-volume figure or U.S. user count, so historical market counts should not be presented as current activity.
