Yes. UK citizens can live in Spain after Brexit, but most people moving there now need a visa or residence permit that matches the reason for their move. The key exception may be people who were legally resident in Spain before 1 January 2021 and qualify under the Withdrawal Agreement. Their rights and paperwork differ from those of new arrivals.
This guide is for UK citizens considering a move to Spain, including people who may already have lived there before the transition period ended. Immigration rules depend on your circumstances; confirm the current requirements with the relevant Spanish authority or consulate before making travel plans. Information is current to 8 October 2026.

Start with the date you became resident
The transition period ended on 31 December 2020. Under the Government of Spain’s Ministry of Inclusion, Social Security and Migration Brexit FAQ (English edition, September 2024), UK nationals who were resident in Spain before 1 January 2021 may be covered by the Withdrawal Agreement if they meet its conditions. Eligible family members may also be covered; the FAQ describes qualifying family relationships existing before the transition period ended and includes future children.
If you arrived after 1 January 2021 and are not a Withdrawal Agreement beneficiary, Spanish foreign-nationality rules apply. The Spanish FAQ says a visa and/or residence permit is required. Owning property or visiting Spain regularly, by itself, does not establish a right to live there.

If you were resident before 1 January 2021
Check whether you qualify for Withdrawal Agreement protection and whether your residence documentation reflects it. Spain uses a declaratory residence-document process. A TIE (Tarjeta de Identidad de Extranjero) marked “Articulo 50 TUE” is evidence of beneficiary status, according to the Spanish Brexit FAQ.
The UK Foreign, Commonwealth & Development Office (FCDO) says a green EU registration certificate remains valid evidence of rights, but recommends exchanging it for a TIE. If you lived in Spain before the cutoff but do not have a residence document, the FCDO says to register and apply for a TIE. Historic municipal registration and comprehensive health insurance may help support an application; confirm the evidence required for your case with the Spanish authorities.
If you are moving now
Do not assume that EU free-movement rules still let a UK-only citizen move to Spain. First identify the residence route that fits your purpose, then check its current eligibility criteria and application sequence.

Choose a route that matches your reason for moving
The FCDO’s Living in Spain guidance lists visa or residence routes for purposes including work, digital-nomad work, study, retirement or other non-working residence, joining family, internships, medical treatment, volunteering and research. These are route categories, not interchangeable permissions. A route may set different rules for permitted activities, income or other resources, health coverage, family members, application timing, duration and renewal.

The general guidance does not establish the current requirements or fees for every route. Check the Spanish consulate or relevant Spanish authority’s instructions for the specific route before travelling. Where that route requires an application before arrival, do not plan to enter as a visitor and assume you can settle or work instead.
A practical decision sequence
- Establish your status: Were you legally resident in Spain before 1 January 2021, and do you meet the Withdrawal Agreement conditions? If so, check the process for confirming and documenting that status.
- Name your purpose: Work, study, retirement or other non-working residence, joining family, or another listed activity may point to different routes.
- Verify the permission: Confirm the current criteria, where and when to apply, whether family members can be included, and what activities the authorization permits with the Spanish consulate or authority responsible for that route.
- Plan the connected practical issues: Work out your healthcare basis, income and tax questions, and driving-licence requirements separately. None of these replaces the immigration permission you need.
Arrange residence documents and travel plans
For most UK citizens moving to Spain now, the applicable authorization and resident-registration process will require residence documentation, commonly a TIE. Children need their own TIE. The visa or permit instructions determine whether you must apply for one after arrival and the relevant deadline, so follow the instructions for your particular route rather than assuming one process applies to everyone.

For eligible pre-2021 residents, the green registration certificate remains evidence of rights under the FCDO’s guidance, while the TIE is its recommended practical document. That difference matters when travelling: under the FCDO’s current Entry/Exit System (EES) guidance, a biometric TIE exempts a legally resident British national from EES registration; a green certificate does not. Carry your passport and residence evidence when travelling within Schengen, and show the residence document if asked at the border. EES and border procedures can change, so check the latest official guidance before each trip.
Check healthcare eligibility before you move
A British passport or Spanish residence status alone does not mean that you automatically receive free Spanish state healthcare. Your entitlement and the steps to register depend on your circumstances and coverage basis.

Eligible resident family members may also qualify.
- UK-issued coverage: A UK EHIC or GHIC may be used by tourists under the applicable coordination arrangements. It is not a general substitute for arranging healthcare coverage as a resident. The FCDO’s later-life guidance also identifies an S1 as a possible coverage basis where applicable; check your own eligibility and registration process.
- Private insurance: It may be needed where you do not qualify for state coverage or need to satisfy a route’s conditions. Check exclusions and limits, including pre-existing conditions, age limits and emergency evacuation from remote areas or islands.
The FCDO’s later-life guidance says access to state care requires registration and appropriate documents, including a valid British passport, a residence document and municipal padrón registration. If you have not registered for state care, you may need to pay for private treatment. Confirm the required registration steps with the relevant Spanish health authority; coverage and eligibility are not identical for every resident.

Understand the rules for working and studying
If you have lived legally in Spain since before 1 January 2021 and qualify under the Withdrawal Agreement, the FCDO says you can work without a work permit or visa under those rights. For other UK citizens, the required authorization depends on the planned activity. A work route, a student route and a route for another purpose may carry different permissions and conditions; do not infer that permission to reside also authorizes every kind of work.
Check the Spanish authority’s current conditions before accepting work, enrolling or travelling. In particular, confirm whether the route permits employment or remote work, and whether the application must be approved before you arrive.

The FCDO’s Living in Spain guidance, updated 3 July 2026, says UK and Gibraltar licence holders can drive in Spain for up to six months. To continue driving after that period, they must exchange the licence. Apply before the six months expires: the FCDO advises obtaining the relevant DVLA or DVA check code and allows for processing time.

Jersey, Guernsey and Isle of Man licence holders cannot use that exchange route, according to the same guidance. They must apply for a Spanish licence and pass theory and practical tests.
Plan tax, pensions and later-life support separately
Tax and pensions
The FCDO says Spanish residents must declare assets held outside Spain and may need to file an annual tax return. It also flags possible Spanish tax on income from savings, property and public or private pensions. These general points do not determine whether you are tax-resident, what you owe, which reporting forms apply or whether treaty relief is available in your case. Get advice specific to your circumstances and check the relevant Spanish and UK tax authorities.
The UK State Pension can be claimed abroad subject to the applicable rules. Whether you can receive a Spanish pension depends on eligibility and your contribution history. Check your position with the official UK and Spanish pension services rather than assuming that residence alone creates a pension entitlement.
Healthcare access, transport and social care
Before choosing where to live, consider distance to primary care and hospitals, transport, banks and shops, as well as access to services you may need later. The FCDO notes that healthcare access can vary by location; some island residents may need air transfer for certain treatment.
Social care is not automatic after a hospital discharge. Spanish regions administer social-care systems, and local rules and availability vary. The FCDO says an eligibility assessment may require proof of a minimum period of residence, and some support may need to be arranged and paid for privately. If you or a family member expects to need ongoing care, check the rules and availability in the specific region before relocating.
