Can TSA Seize Cash After Security? What the Brown Class-Action Lawsuit Claims

Travelers in Brown v. TSA allege screeners held cash, belongings, or people after security screening. Here’s what the lawsuit claims—and what has not been decided.

“Unconstitutional” is the plaintiffs’ allegation, not a court’s final ruling. In Brown v. Transportation Security Administration, travelers allege that TSA screeners held cash, belongings, or people after aviation-security screening had ended because they found a large amount of cash. They argue that this went beyond TSA’s security role and violated the Fourth Amendment. The case also includes separate claims involving the Drug Enforcement Administration (DEA).

What cash-related conduct does the lawsuit challenge?

The amended complaint alleges that TSA screeners detained travelers or kept their cash, carry-on luggage, or personal effects after screening was complete, based on the amount of cash they were carrying. These are claims made by the plaintiffs in a pleading; they are not established findings about what happened in every alleged encounter.

The plaintiffs’ legal argument starts with TSA’s aviation-security function. The complaint cites 49 U.S.C. § 114(e)(1) and 49 C.F.R. § 1540.5, which it describes as defining screening in terms of inspecting people and property for weapons, explosives, and incendiaries. The plaintiffs contend that holding travelers or their property for a cash-related investigation after screening exceeded that authority. That is their interpretation of the law and its application to the alleged conduct, not a ruling that the statute or regulation necessarily bars every such action. Why do the plaintiffs call it unconstitutional?

The complaint says the alleged post-screening detentions and property holds violated the Fourth Amendment, which protects against unreasonable searches and seizures. In this case, “unconstitutional” describes the plaintiffs’ position about the alleged conduct. The materials cited here do not establish a final merits ruling that TSA’s alleged practice is unconstitutional.

The plaintiffs seek declaratory and injunctive relief on a class-wide basis. Those are requests for the court to declare rights and potentially order changes; their inclusion in the complaint does not mean the court granted that relief.

What are the TSA and DEA claims?

TSA and DEA are both defendants, but the complaint frames separate claims and proposed classes. The proposed TSA class concerns travelers whose cash, belongings, or person were allegedly seized after screening concluded because of cash. The proposed DEA class is separately framed around airport cash seizures connected to carrying at least $5,000. These proposed definitions do not, by themselves, show that either class was certified. The distinction matters: the lawsuit does not present every allegation as one undifferentiated agency practice. The allegations against TSA concern the scope of aviation-security screening and what happened after it ended; the DEA claim is separately pleaded and tied to airport cash seizures.

What has happened in court?

The Civil Rights Litigation Clearinghouse reports that DEA returned the $82,373 taken from Rebecca Brown and that early motions to dismiss left the three class claims proceeding. The Institute for Justice likewise reported that the court rejected the government’s motion to dismiss those claims. These procedural outcomes allowed claims to continue; they did not decide whether the alleged conduct was unlawful. Institute for Justice’s account of the return and early ruling.

The latest located status report, published by LegalClarity on June 30, 2026, says TSA filed a summary-judgment motion on May 30, 2025, and plaintiffs cross-moved on July 2, 2025. It reports that the motions were argued on February 5, 2026, and remained under advisement as of June 30, with no timeline announced. What travelers should take from the case

The lawsuit concerns whether TSA allegedly continued to detain people or hold their property over cash after its security screening had concluded. It is not a final court declaration that carrying cash through an airport is unconstitutional, nor do the cited materials establish a general rule that TSA may seize cash simply because a traveler possesses it.

For now, separate three things when reading coverage: the plaintiffs’ allegations about what screeners did, the legal arguments about TSA’s authority and the Fourth Amendment, and the court’s eventual decision on the merits. The early procedural rulings and the reported summary-judgment arguments do not substitute for that final decision.
