Someone can fraudulently record a deed that appears to transfer your home, but a paid “title lock” service cannot prevent that filing. The Federal Trade Commission (FTC) describes title monitoring as an alert service, not title insurance or a lock. Check ownership records with your local land-records office, ask whether free alerts are available, and act promptly if you find an unfamiliar change.
What home title fraud is—and what it is not
Title fraud is identity theft involving property records. As the FTC puts it, “Title fraud is identity theft: someone pretends to be you and transfers your deed to someone else.” A fraudulent filing can create a serious ownership dispute, but a deed appearing in public records does not by itself settle every question about who legally owns the property. The steps to challenge a filing depend on state and county procedures.
Title fraud is also distinct from mortgage-payment fraud and ordinary identity theft. A criminal might misuse personal information, submit a false deed, or try to persuade an owner to sign away a deed under the guise of mortgage relief. The risks and appropriate response differ, so start by identifying what actually happened: an unfamiliar recorded document, suspicious account activity, or pressure to sign or pay.
Title monitoring is not a lock
The FTC says that “title lock insurance” is not title insurance and does not stop someone from submitting a fraudulent transfer. A private monitoring service may notify you after a document appears in public records; it does not prevent the filing or itself resolve ownership. Before paying for monitoring, check whether your local recorder or land-records office offers a free notification service.

Do not treat an alert as proof that fraud occurred or as a legal finding. Use the document details to contact the relevant land-records office and ask what steps apply in your jurisdiction.
How to check your property records
- Find the responsible office. Search for the official state or county land-records office—often called the recorder, county clerk, or register of deeds—and verify that you are using a government site.
- Look up the property. Follow the office’s instructions to search by address, parcel number, or owner name. Confirm the recorded owner and review recent documents if they are available online.
- Ask about notifications. Contact the office using details from its official website and ask whether it offers free alerts for new documents tied to your name or property.
- Get local instructions if something is unfamiliar. Ask how to obtain the document and what the office’s process is for reporting or challenging a suspected fraudulent filing. Do not assume that another county’s forms, deadlines, or remedies apply.
What to do if you find an unfamiliar deed or property-record change
- Contact the land-records office promptly. Use independently verified contact information. Ask for a copy of the recorded document, the date it was filed, and the local procedure for disputing or correcting a suspected fraud.
- Secure the identity and accounts that may be involved. If your personal information was misused, use the free recovery plan at IdentityTheft.gov. Change compromised passwords and enable multifactor authentication where available.
- Consider a credit freeze or fraud alert. A credit freeze is free. You can place an initial fraud alert with one of the three nationwide credit bureaus; the bureau you contact must notify the other two. See the FTC’s credit-freeze and fraud-alert guidance.
- Keep records of what you report. Save copies of documents, alerts, correspondence, and case or reference numbers. The relevant state and county determine how a recorded deed is challenged, so ask local authorities or a qualified attorney about the process for your property.
Protect your identity and property-related accounts
- Dispose of sensitive papers carefully. Shred documents containing personal or account information before discarding them. A community shred event may be a no-purchase alternative; you can also obscure account numbers where a full document is not needed.
- Use strong, unique passwords and multifactor authentication. Apply these protections to email, financial accounts, and other accounts that could expose personal information.
- Review statements and bills. Look for unfamiliar charges, withdrawals, new accounts, or changes to contact details, and report suspicious activity to the company using a phone number or website you independently verify.
- Be cautious with unexpected messages and calls. Do not provide personal or financial information just because a caller, text, or email claims to represent a bank, government agency, or lender. Find the organization’s contact details yourself and reach out directly.
These steps reduce opportunities for identity misuse; they do not guarantee that a fraudulent document will never be filed. Local record checks and alerts can help you notice changes, but prevention, notification, and legal correction are different things.

Watch for mortgage-rescue offers that demand your deed
A mortgage-relief scammer may promise to save your home in exchange for an upfront fee or a deed transfer. Transferring the deed does not transfer the mortgage debt: you may lose control of the property and still owe payments. The FTC warns, “If you transfer the deed, you’re not likely to get it back.”
- Do not sign a deed under pressure or pay an upfront fee for a promised rescue.
- Contact your mortgage servicer or lender directly using a verified phone number or website to discuss payment problems.
- Consider speaking with a certified housing counselor. The U.S. Department of Housing and Urban Development explains how to find one at HUD’s housing counseling page.

Why local rules matter
Recording, notification, and the process for correcting or challenging a deed depend on the state and county where the property is located. General consumer guidance cannot establish the deadline, evidence requirements, or legal remedy for a particular home. Use the relevant local land-records office for its process and seek state-specific legal advice when ownership is disputed.
