Usually, self-employment income alone does not qualify you for regular unemployment insurance (UI). But you may qualify if a state determines that work you performed as an independent contractor was actually covered employment, or if a qualifying disaster directly interrupted your self-employment and you meet the requirements for Disaster Unemployment Assistance (DUA). The temporary pandemic-era Pandemic Unemployment Assistance (PUA) program has expired.
UI rules and claim decisions depend on the state where you worked and the facts of your situation. This U.S. overview explains the main paths; it is not an eligibility determination.
How regular unemployment insurance treats self-employment
Regular UI is a joint federal-state program, but states administer their own systems and set eligibility requirements, benefit amounts, and benefit duration within federal guidelines. To qualify, applicants generally must meet state wage or time-worked requirements during a defined base period. The U.S. Department of Labor explains the filing process and directs workers to their state UI program; the Department’s Office of Inspector General describes the federal-state structure and state role.
For a sole proprietor or independent contractor, the usual obstacle is that business income is not automatically treated as wages from UI-covered employment. Gross receipts alone do not establish eligibility. A state agency must assess your covered work and earnings under its law, including any employee wages you earned during the relevant period.

Regular UI also generally requires claimants to be able to work, available for work, and actively seeking work. States set and administer the specific rules, including work-search requirements. If you continue operating a business while claiming, ask your state agency how that activity affects availability and work-search obligations; do not assume it automatically satisfies them.
When a contractor may qualify through employee misclassification
A company’s decision to call you an independent contractor does not by itself settle your UI status. The state UI agency determines whether an employer-employee relationship existed under the applicable state statutes, regulations, or policies. The U.S. Department of Labor’s guidance on misclassification myths says: “You may still qualify for UI even if you are classified as an independent contractor.”

This means it may be worth applying or asking the agency for a classification determination if the actual work arrangement could be employment under state law. It does not guarantee benefits: the agency will also consider wage history and the other eligibility rules.
Which unemployment-related programs may apply?

PUA is expired, but older claims may still be processed
PUA was a temporary program created under the CARES Act for certain people who were not eligible for regular UI, including some self-employed and gig workers who met specified COVID-19-related conditions. The U.S. Department of Labor’s current notice, UIPL 11-26, issued May 18, 2026, says PUA and the other temporary CARES Act programs have expired. That does not mean every historical matter is closed: states may still be handling overpayments, backlogs, or unresolved determinations. For an existing claim, contact the state agency responsible for it.

DUA may help after a qualifying major disaster
DUA is a narrow exception relevant to self-employed people whose work is disrupted by a disaster. It may provide assistance when a Presidentially declared major disaster directly causes a loss or interruption of employment or self-employment and the person is not eligible for regular UI. An ordinary decline in customers, seasonal slowdown, or other business downturn is not enough unless the required disaster conditions are met.
The disaster declaration, direct link between the disaster and your lost work, your individual eligibility, and the filing deadline all matter. Follow the state agency’s instructions for the disaster claim and consult the Department of Labor’s Disaster Recovery Assistance information.

What to do if your income or work has stopped
- Contact the UI agency in the state where you performed the work. State rules and claim procedures govern; ask about wage eligibility, worker classification, deadlines, and any current disaster or SEA option. The Department of Labor provides a state-directed filing overview.
- Gather your work and earnings information. Identify employee wages as well as self-employment income, the relevant work dates, pay records, and any state wage history. Business receipts alone cannot show whether you meet covered-wage requirements.
- Explain how the work was arranged. If a payer classified you as a contractor, describe what the work involved and ask whether the state will determine if it was covered employment. A classification review is not a promise of benefits.
- Explain why the work stopped or changed. If you believe a declared disaster directly caused the interruption, identify the disaster and dates and ask about DUA filing instructions and deadlines.
- Ask how to meet ongoing claimant rules. Confirm availability and work-search requirements, especially if you are still running or trying to restart your business.
What determines the answer in an individual case?
- The state where the work was performed and its UI law.
- Whether you had covered employee wages, including work the state might classify as employment despite a contractor label.
- Your earnings and work history during the state’s base period.
- Why and when your work or income stopped.
- Whether a declared major disaster directly caused the interruption and whether you meet DUA deadlines and conditions.
- State-specific requirements for availability, work search, and any SEA option.
The state agency makes the eligibility decision. Federal guidance can explain the programs, but it does not replace a state determination based on your work arrangement, earnings, dates, and circumstances.
