Whether a missed scan is a crime depends on the law where it happened and the facts, including any intent the offense requires.
What a store accusation does—and does not—mean
There are several distinct stages: a store employee may suspect or accuse you; store personnel may detain you; police or a prosecutor may pursue a case; and a court may decide whether you are guilty. A store’s suspicion or report does not itself establish criminal intent or result in a conviction.

Because you have not named a state, there is no single nationwide answer about criminal liability or a store’s authority to detain someone. The laws below are examples from Florida and North Carolina, not rules that apply everywhere.

Why the state and the facts matter
Florida: intent is part of the cited retail-theft definition
Florida’s 2026 statute defines retail theft to include taking possession of or carrying away merchandise with intent to deprive the merchant of possession, use, benefit, or full retail value. It also allows a merchant or employee with probable cause to detain a person in a reasonable manner and for a reasonable time for recovery of the merchandise or prosecution. Florida Statutes § 812.015 (2026)

North Carolina: separate provisions address concealment and detention
North Carolina separately criminalizes willfully concealing merchandise while still on store premises. Its merchant-detention protection is conditioned on probable cause and detention on or reasonably near the premises, in a reasonable manner and for a reasonable length of time. North Carolina General Statutes, Chapter 14, Article 16
That article also addresses transferring or altering price tags or product codes. For that specific provision, it says that mere possession of goods or presenting improperly priced merchandise for checkout does not itself constitute prima facie evidence of guilt. That limited statement should not be treated as a general rule for every shoplifting allegation.

A New Jersey case shows prosecution is possible, not inevitable
In State of New Jersey v. Shamecca Whitfield, a shopper failed to scan a detergent bottle at self-checkout, was convicted of shoplifting, and the appellate court affirmed the conviction. The opinion concerns one prosecution and its facts; it does not establish that every missed scan is intentional or that another shopper’s case will have the same outcome. What may help explain a missed scan
A scan discrepancy shows that an item may not have been paid for; by itself, it does not explain why. Depending on the circumstances and the law, relevant details may include:

- Whether you tried to scan the item or the barcode failed.
- Where the item was in the cart and what the register displayed.
- What happened before you left the checkout area.
- What you said or did after an employee stopped you.

Stay calm and avoid escalating the encounter. Keep any receipt or other checkout information, and make a note of what you remember about the scan attempt, register display, and interaction.
