Yes—but the exact rule depends on where the measure is and what kind of measure it is. A proposal can win more “yes” than “no” votes among people who answered the question and still fail a separate legal requirement, such as a supermajority or minimum participation threshold.
How can a majority vote still lose?
“Majority” can describe the share of votes cast on the measure, but that is not always the only test for passage. A law may also require a specified percentage of yes votes or require a minimum number of voters to participate in that question.

Those tests use different denominators. A percentage threshold usually compares yes votes with yes and no votes on the measure. A participation rule compares votes on the measure with a broader total, such as all votes cast in the election. Leaving the measure blank does not automatically count as a “no,” but blank responses can matter when the law imposes a participation test.

A supermajority requires more than a simple majority—such as 55%, 60%, or two-thirds approval. In a hypothetical election with 54% yes and 46% no, the measure has a majority but would fail a 55% requirement.

The threshold varies by jurisdiction and measure type. California’s Secretary of State says statewide ballot measures may pass by a majority, while certain local measures require 55% or two-thirds approval. California Secretary of State: Ballot Measures
Turnout and participation rules
A measure can also need enough participation to satisfy a separate minimum, even when a majority of votes cast on the question favors it. Washington’s constitution, for initiatives and referenda covered by its provision, requires both majority approval among votes cast on the measure and that those votes equal at least one-third of all votes cast at the election. If too many people leave the question blank, the measure may miss that condition despite receiving more yes than no votes among responses.

“Any measure initiated by the people or referred to the people as herein provided shall take effect and become the law if it is approved by a majority of the votes cast thereon: Provided, That the vote cast upon such question or measure shall equal one-third of the total votes cast at such election and not otherwise.”

That language is from Article II, Section 1(d) of the Washington State Constitution. It describes a specific state process; it is not a nationwide rule.

Rules can vary by measure type
Local bonds, levies, school measures, and statewide initiatives may face different passage or validation rules, even within the same state. For example, Snohomish County, Washington, says most non-school levies require at least 60% yes votes and a minimum yes-vote total tied to 40% of turnout in the prior general election. Its guidance describes different rules for school levies and bonds, so the non-school levy test should not be treated as a rule for every Washington measure.
The county illustrates its non-school levy minimum this way: if 10,000 people voted in the prior general election, 40% is 4,000; 60% of that is 2,400 minimum yes votes. What to check when a measure appears to have won but failed
- Identify the jurisdiction and measure category. A statewide initiative, local levy, school measure, and bond may not follow the same rule.
- Find the required approval percentage. Check the ballot language and official election materials for a simple majority or a stated supermajority. Ohio law, effective January 1, 2026, requires ballot issue text to state the percentage of affirmative votes necessary for passage. See Ohio Revised Code Section 3505.06.
- Check what the percentage is measured against. Determine whether it uses votes cast on the question, all ballots in the election, or another figure specified by law.
- Look for a separate participation or minimum-vote condition. A measure might meet its yes-versus-no threshold but fail this additional test.
- Use the controlling law for the specific measure. The state constitution or statutes establish the legal rule; the local election authority can help explain how it applies.
The National Conference of State Legislatures reports that initiatives in Illinois, Mississippi, Nebraska, and Wyoming have participation requirements in addition to a simple majority. That is a comparative overview rather than a substitute for checking the current law governing a particular measure. See NCSL: The Election and Adoption of Initiatives.

Majority, supermajority, and participation are different tests

A result can satisfy one test and fail another. The decisive question is not simply whether “yes” beat “no,” but whether the measure met every passage condition that applies to its jurisdiction and category.
