Bitfinex Hacker Sentenced to 5 Years for Money-Laundering Conspiracy

Ilya Lichtenstein was sentenced to 60 months in federal prison on November 14, 2024, for his involvement in a money-laundering conspiracy arising from the 2016 Bitfinex hack. The U.S. Department of Justice says 119,754 bitcoin were transferred from Bitfinex in the theft; its releases do not establish that $10.5 billion was laundered. Dollar values depend on the date and bitcoin price, and the amount stolen is not the same as the amount laundered or seized.

What sentence did Ilya Lichtenstein receive?

The U.S. Department of Justice announced that Lichtenstein received 60 months—five years—in federal prison on November 14, 2024. He also received three years of supervised release. The offense of conviction was conspiracy to commit money laundering, not a separate hacking conviction, according to the DOJ sentencing announcement.

At sentencing, U.S. District Judge Colleen Kollar-Kotelly said, as quoted in the Associated Press’s contemporaneous courtroom report, “It’s important to send a message that you can’t commit these crimes with impunity, that there are consequences to them.”

What happened in the Bitfinex hack?

In August 2016, Lichtenstein hacked the Bitfinex cryptocurrency exchange and stole bitcoin, the DOJ says. More than 2,000 transactions moved 119,754 bitcoin from Bitfinex to a wallet he controlled. DOJ also describes the theft in rounded terms as approximately 120,000 bitcoin. The agency says Lichtenstein later deleted access credentials and log files from Bitfinex’s network.

Lichtenstein and Heather Morgan pleaded guilty on August 3, 2023, to one count of conspiracy to commit money laundering. Morgan, identified by DOJ as Lichtenstein’s wife, assisted in laundering the stolen funds. The case overview also discusses a conspiracy to defraud the United States, but Lichtenstein’s 2024 sentence was for the money-laundering conspiracy.

Did Lichtenstein launder $10.5 billion?

The DOJ releases reviewed do not identify $10.5 billion as the amount laundered. They report the bitcoin transferred in the 2016 theft and give dollar valuations for seized bitcoin at particular historical points. Those are different measures: bitcoin stolen, funds moved through laundering, bitcoin seized, and the later dollar value of bitcoin are not interchangeable.

For example, DOJ’s August 2023 announcement said approximately 95,000 bitcoin had been seized and valued at approximately $3.6 billion at the time. It also reported approximately $475 million in additional funds tied to the hack seized after the arrests. These are historical seizure figures, not current valuations or a determination that every seized asset would go to a particular claimant. Bitcoin’s dollar price changes, so a dollar estimate needs an “as of” date and a source.

How did authorities trace and recover bitcoin?

DOJ says law enforcement seized approximately 95,000 bitcoin from wallets under Lichtenstein and Morgan’s control after their February 2022 arrests. Its August 2023 release put the value of that bitcoin at approximately $3.6 billion at the time of seizure and reported an additional approximately $475 million in funds tied to the hack seized after the arrests. These figures describe assets recovered, not the total amount stolen or a final allocation of recovered property.

What laundering methods did prosecutors describe?

DOJ said the defendants used multiple techniques to conceal and move proceeds. The agency’s descriptions include fictitious online identities, automated transactions, transfers through darknet markets and cryptocurrency exchanges, conversions between cryptocurrencies (known as chain hopping), mixers, U.S.-based business accounts, and converting a portion of funds into gold coins.

These are methods DOJ said were used in this case; the releases do not say that every stolen bitcoin passed through every method.
