No undocumented farmworker received legal status under President Joe Biden’s 2021 proposal. Biden proposed a broad immigration plan, while his administration separately backed the Farm Workforce Modernization Act of 2021 (H.R. 1603). The House passed that bill, but it did not become law in the 117th Congress. The two proposals described different routes, and neither created an application program.
What Biden proposed for farmworkers
In January 2021, Biden announced a broad immigration proposal that, according to contemporaneous agriculture reporting, would make qualifying farmworkers immediately eligible for green cards. After three years, they could apply for citizenship if they met additional requirements. That description is secondary reporting on the broader proposal; it is not the text of H.R. 1603. Successful Farming’s January 2021 report described the proposal.
The administration also supported a separate, farm-specific bill: the Farm Workforce Modernization Act of 2021. Its provisions would have created Certified Agricultural Worker status and an optional earned-residence path for eligible long-term agricultural workers. It also addressed the H-2A temporary agricultural worker program and employment verification. These were proposed changes, not benefits available under an enacted law. Congress.gov’s bill record identifies H.R. 1603 and its legislative history.
What happened to H.R. 1603
- March 18, 2021: The House passed H.R. 1603, as amended, by a vote of 247–174. The bill then moved to the Senate for consideration. The Social Security Administration’s legislative bulletin records the vote and next step.
- 117th Congress: The bill received no further action in that Congress, according to the Congressional Research Service account. House passage alone did not make it law.
The Biden administration’s March 18, 2021 statement supported House passage, saying: “A path to immigration status for undocumented farmworkers is critically important to our Nation’s food and agriculture sectors.” The statement also argued that legal status could help farmworkers earn higher wages and exercise labor-law rights, and called for balancing H-2A expansion with stronger worker protections. Those points were the administration’s policy rationale, not established outcomes. The Statement of Administration Policy is dated March 18, 2021.

Who would have qualified under the House bill
The SSA summary of H.R. 1603 says applicants would have needed to show at least 1,035 hours—or 180 work days—of agricultural labor or service in the United States during the two years before the bill’s introduction on March 8, 2021. This was a proposed eligibility threshold in that bill, not a current application requirement. The SSA summary describes the provision.
How the two 2021 proposals differed
| Measure | Proposed route, as described in contemporaneous sources | Status |
|---|---|---|
| Biden’s broad immigration proposal | Qualifying farmworkers would be immediately eligible for green cards, with the possibility of applying for citizenship after three years if they met additional requirements, according to 2021 agriculture reporting. | Announced as a proposal; this account does not establish enactment. |
| Farm Workforce Modernization Act (H.R. 1603) | Certified Agricultural Worker status and an optional earned-residence path for qualifying long-term agricultural workers, alongside H-2A and employment-verification provisions. | Passed the House 247–174 on March 18, 2021, but did not advance further in the 117th Congress. |
The broad proposal and H.R. 1603 were related politically, but they were not the same measure. The green-card timeline reported for Biden’s broader proposal should not be treated as a description of the bill’s text.

What the workforce estimates do—and do not—say
In its 2021 statement supporting H.R. 1603, the Office of Management and Budget cited roughly 2.4 million U.S. farmworkers and said a majority were undocumented. A separate 2021 Successful Farming report cited an estimate of 1.25 million undocumented farmworkers. The estimates differ in scope and formulation, and neither is a current 2026 workforce count. The administration statement and the agriculture report give their respective figures.

H.R. 1603 did not create one because it did not become law in the 117th Congress. The CRS account notes that a similar Farm Workforce Modernization Act was introduced in the 118th Congress, but the sources cited here do not establish what happened to later successor proposals through October 8, 2026. They therefore do not establish whether a successor law or current program is available. A House-passed bill from 2021 is not itself a basis to apply for status.
