Bertrandt U.S. sued Fisker Group in federal court in Michigan on April 30, 2024, alleging that Fisker failed to pay for engineering and development work on its planned Pear EV and Alaska pickup. Bertrandt sought $12,919,443, but that amount was a demand in its complaint—not a court award or a finding that Fisker owed the money.
What the lawsuit was about
The case, Bertrandt U.S., Inc. v. Fisker Group Inc., No. 2:2024cv11152, was filed in the U.S. District Court for the Eastern District of Michigan. The complaint described work for two planned Fisker vehicle programs: the Pear, a lower-cost EV, and the Alaska pickup. What Bertrandt said Fisker agreed to pay
Pear development
TechCrunch’s account of the complaint and an attached agreement says Bertrandt entered a Pear design-and-development agreement with Fisker in May 2022, valued at more than $35 million. This is the reported value of the agreement, not the amount Bertrandt said remained unpaid. TechCrunch reported the agreement terms.
Alaska work
Bertrandt alleged that Fisker later requested similar work for the Alaska pickup. It said the parties did not sign a formal written Alaska agreement, but that Fisker accepted a quote of $1.66 million. How Bertrandt calculated its $12.9 million demand
Bertrandt alleged that Fisker stopped paying at the end of August 2023 and left invoices unpaid through January 31, 2024. It said the unpaid invoice balance was $7,061,443. According to the complaint as described by TechCrunch, Bertrandt also said that at a February 6, 2024 meeting, Fisker acknowledged liability for those invoices and agreed to promptly pay $3,685,000 toward them; Bertrandt alleged that the partial payment never arrived. Bertrandt also alleged that Fisker’s pause of Pear and Alaska development caused delay costs and amounted to another contractual breach. It said it demanded return of its intellectual property on April 22, 2024, along with written confirmation that Fisker had kept no physical or electronic copies, and alleged that Fisker did neither. The complaint’s lawyers wrote, “Fisker has been unjustly enriched at the expense of Bertrandt.” That was the plaintiff’s characterization, not a court’s conclusion. What happened after the complaint
Fisker answered the complaint and asserted a counterclaim on May 31, 2024. Bertrandt filed an answer to the counterclaim on June 11. Those filings show that the dispute was contested; they do not resolve the factual allegations. The district-court docket.
Fisker Group and its U.S. subsidiaries filed for Chapter 11 bankruptcy on June 17, 2024, as reported in the company’s SEC filing. On June 20, the district court recorded notice of the bankruptcy and administratively stayed the civil case. Did Bertrandt get paid in Fisker’s bankruptcy?
Fisker’s liquidation plan was confirmed on October 16, 2024, and its effective date was October 17, according to the case administrator, Verita. Those plan milestones do not establish whether Bertrandt’s particular bankruptcy claim was allowed, paid, or otherwise resolved.
