Banking Group Sues OCC Over Crypto Firms’ National Trust Charters

ICBA says its lawsuit challenges the OCC’s national trust charter approach for crypto firms and seeks to vacate Protego’s conditional approval. The case is a filing, not a court ruling.

The Independent Community Bankers of America (ICBA) says it sued the Office of the Comptroller of the Currency (OCC) on October 2, 2026, challenging the agency’s approach to national trust bank charters for entities conducting substantial non-fiduciary activities. The case is a newly filed lawsuit, not a court ruling: ICBA is asking a federal court to invalidate a 2026 OCC rule and a separate interpretive letter, and to vacate Protego Holdings Corp.’s conditional charter approval.

What ICBA is challenging

ICBA announced that it filed its lawsuit in the U.S. District Court for the District of Columbia. It challenges two separate OCC actions: a March 2, 2026 final rule related to national trust banks, and Interpretive Letter 1176. ICBA alleges that the framework exceeds the OCC’s statutory authority and asks the court to find both actions unlawful. Those are the plaintiff’s claims and requested relief; they are not findings by a judge.

The OCC identifies Interpretive Letter 1176 as a January 2021 Chief Counsel interpretation concerning national trust banks and the agency’s authority under 12 U.S.C. § 27(a). The letter is not the March 2026 final rule; ICBA challenges them as separate materials. Read Interpretive Letter 1176.

What ICBA means by a “side door”

ICBA’s objection is that a national trust charter could give crypto firms the credibility associated with a federal bank charter while avoiding obligations the group associates with insured depository institutions. In the announcement, ICBA President and CEO Rebeca Romero Rainey said: “Congress did not create the national trust charter as a side door into the banking system for crypto firms seeking the credibility of a federal bank charter without the Community Reinvestment Act obligations, consolidated supervision, capital and liquidity standards, and FDIC insurance that apply to insured depository institutions.”

That statement describes ICBA’s position, not a complete legal comparison of every national trust bank and insured bank. A federal charter is not, by itself, proof that an institution takes insured deposits or that its customers have FDIC coverage. The precise activities, insurance status, supervision, and other requirements depend on the institution’s charter and applicable law. Readers should not assume that a national trust bank works like a conventional deposit-taking bank.

Why Protego is named

ICBA says it is asking the court to vacate Protego Holdings Corp.’s conditional approval for a national trust bank charter. Protego is therefore a specific target of the requested remedy, alongside the challenge to the OCC rule and interpretive letter. The announcement does not establish that the court has granted that request or otherwise changed Protego’s status.

How this differs from other OCC crypto actions

The dispute is about the scope of national trust charter authority, especially for substantial non-fiduciary activity. It should not be read as a challenge to every crypto-related action by the OCC or as a ruling on all activities available to national banks.

The OCC’s interpretations and decisions index, for example, describes Interpretive Letter 1183 as affirming that certain crypto custody and payment activities are permissible for national banks and federal savings associations. What happens next

As of ICBA’s October 2, 2026 announcement, the available information establishes that the lawsuit was filed and describes what ICBA wants the court to do. It does not establish whether the court has issued an order. The announcement also does not provide a docket number, judge, or subsequent motion or ruling. Until the court acts, the challenged actions and Protego’s conditional approval should not be described as blocked or invalidated.
