No official record located supports the claim that Atari’s “Haunted House” trademark dispute is going before regulators this week. The documented case was a 2011 opposition that the Trademark Trial and Appeal Board (TTAB) decided in 2016. The TTAB sustained Atari’s opposition to Andrew N. Greenberg’s application for HAUNTED HOUSE TYCOON; it did not cancel Atari’s registration.
Is a new Atari trademark hearing scheduled this week?
The claim is unverified. A Freedom251 article updated May 22, 2026 says the matter is expected to go before regulators “this week,” but it does not identify a new proceeding, opposing party, docket number or official hearing notice. The official records located document a historical case, not a 2026 hearing.
The TTAB docket search result current through October 6, 2026 shows the Greenberg opposition as terminated. That search result does not establish that no separate, unindexed case exists; a new official filing or hearing notice would be needed to substantiate one.
What happened in the documented case?
Atari Interactive, Inc. opposed Andrew N. Greenberg’s application to register HAUNTED HOUSE TYCOON in standard characters for “Computer game software” in International Class 9. The application was Serial No. 85268906. Atari’s pleaded mark was HAUNTED HOUSE, associated with Serial No. 85087894 and Registration No. 4037222.

The opposition, No. 91202952, was filed on December 13, 2011. The TTAB held a hearing on April 21, 2016, and mailed its opinion on June 2, 2016. The USPTO’s 2016 Official Gazette reported the disposition as “Opposition Sustained.” The docket lists Greenberg’s application as “ABANDONED – AFTER INTER-PARTES DECISION” and Atari’s registration as “REGISTERED AND RENEWED”; it records the proceeding as terminated on August 31, 2016.
What the ruling does—and does not—mean
The outcome concerned Greenberg’s application: the TTAB sustained Atari’s opposition, and the application was later recorded as abandoned after the decision. It did not cancel Atari’s registration. Nor does this case establish that Atari owns the words “haunted house” for every use, or that others are categorically free to use them. The decision addressed the application and proceeding before the board, not trademark rights in every context.

The opinion states, “This Opinion is not a Precedent of the TTAB.” It should therefore be read as a ruling in this particular proceeding, not as a precedential board decision establishing a general rule.

Atari’s official Haunted House product page describes a modern game starring Lyn Graves and developed by Orbit Studio. It lists Steam, Nintendo Switch, Xbox, PlayStation, Epic Games Store and Atari VCS, and names Amazon among select retailers. The product listing is not evidence of a new trademark dispute.
