If you paid someone as part of a trade or business, you may need to file a Form 1099, depending on what you paid for, how much you paid during the year, who received it, and how the payment was processed. Personal payments generally are not reported on Forms 1099-MISC or 1099-NEC. This is a federal overview; state rules can differ.
Start with these six questions
- Was the payment part of a trade or business? Forms 1099-MISC and 1099-NEC generally cover business payments, not personal ones. Nonprofits and government agencies can also have reporting duties. See the IRS instructions for Forms 1099-MISC and 1099-NEC.
- What was the payment for? Nonemployee services, rent, royalties, medical care, and legal payments may fall under different forms and thresholds.
- Which payment year are you reporting? The 1099-NEC threshold changed for payments made in 2026; do not apply the new threshold to earlier payments.
- Was the recipient an employee, a corporation, an attorney, or a medical provider? Each status can affect the form or an exception.
- Did you pay by card or through a third-party settlement organization? Some transactions are reported on Form 1099-K by the payment settlement entity instead.
- Did you withhold federal income tax as backup withholding? That can require reporting even when the payment is below the usual threshold.
Once you identify the payment category and year, check the current IRS instructions for that form. The IRS’s information-return guidance is a useful starting point, but a special category or state rule may change the result.
When Form 1099-NEC applies
Form 1099-NEC is generally used for reportable payments to nonemployees for services performed in a trade or business, including parts and materials paid as part of those services, and for attorney fees. Employees’ service compensation belongs on Form W-2, not 1099-NEC.

These are federal thresholds for the specified 1099-NEC payment categories, not a blanket threshold for every 1099 form. The amounts and year qualifications are described in the IRS small-business information-return guidance.

When Form 1099-MISC applies
Form 1099-MISC covers specified payment types other than the ordinary nonemployee-service payments reported on 1099-NEC. Categories include rents, royalties, prizes and other income, medical and health-care payments, crop-insurance proceeds, certain deferred compensation, and gross proceeds paid to an attorney.
Thresholds depend on the payment category. For example, the IRS’s 2025 instructions list $10 for royalties and $600 for several other categories. Those examples are for the 2025 instructions; do not assume every threshold is the same for 2026 payments. Check the instructions and Publication 1099 for the payment year and box involved.

Exceptions and special cases that change the answer
- Personal payments: A personal payment generally is outside the trade-or-business reporting rules for Forms 1099-MISC and 1099-NEC.
- Payments to corporations: These are generally excepted from 1099-MISC and 1099-NEC reporting, but important exceptions include payments for medical or legal services. The category of legal payment matters: attorney fees for services and gross proceeds paid to an attorney can be reported on different forms.
- Backup withholding: If you withheld federal income tax as backup withholding, a form may be required regardless of the usual dollar threshold.
- Payment cards and settlement networks: Payment-card transactions and certain third-party-network transactions are generally assigned to Form 1099-K reporting by the payment settlement entity, rather than duplicated on the payer’s 1099-MISC or 1099-NEC.
Because exceptions depend on both the recipient and the payment type, use the relevant box instructions rather than relying on a general rule about corporations or a single dollar cutoff.
How Form 1099-K fits in
Form 1099-K is a separate reporting track. Under the federal rules summarized in the IRS FAQs updated October 23, 2025, payment-card transactions have no minimum federal reporting threshold. For a third-party settlement organization, the general federal threshold is met only when gross payments exceed $20,000 and the transaction count exceeds 200. State thresholds may be lower, and a platform may issue a form below the federal threshold. See the IRS Form 1099-K FAQs.

A Form 1099-K reporting threshold does not determine whether money is taxable. The IRS says income can remain taxable even if no Form 1099-K arrives; payments in cash, property, or services may also be income. Recipients should determine the tax treatment of the underlying activity, not treat receipt or absence of a form as the deciding test.

Deadlines depend on the form and payment year. The 2025 Forms 1099-MISC and 1099-NEC instructions give general due dates of January 31 for 1099-NEC and February 28 on paper or March 31 electronically for 1099-MISC. A weekend or legal holiday moves a deadline to the next business day.

For reporting payments made in 2025, the IRS’s 2025 general instructions set the 1099-NEC filing deadline at February 2, 2026, and most 1099 filings at March 2, 2026 on paper or March 31, 2026 electronically. Required recipient statements also have deadlines: 1099-NEC recipient copies are generally due with the IRS filing date, while the 2025 1099-MISC instructions specify January 31. Always confirm the date for the particular payment year and form in the IRS general information-return instructions and applicable form instructions.
- E-filing threshold: Filers generally must e-file when they submit 10 or more information returns, aggregated across forms. The IRS offers free filing through its Information Returns Intake System (IRIS).
- Paper filing: If filing on paper, use official printed forms. The IRS warns that downloaded Copy A is informational and is not scannable for filing.
