The case is no longer simply an active lawsuit awaiting its first major outcome: the parties proposed a $250 million class-action settlement, and a federal judge granted preliminary approval on July 17, 2026.
That does not mean the settlement is final, that payments are available, or that every iPhone 16 owner will receive money. As of August 18, 2026, the available court record confirmed preliminary approval but did not establish final approval, an active claims deadline, or a payment-distribution date.

What the Apple Intelligence lawsuit is about
The litigation concerns Apple’s marketing of Apple Intelligence and a substantially upgraded Siri. Plaintiffs alleged that Apple promoted Siri capabilities involving personal context, more natural conversations, and actions across apps as part of the value of newer iPhones, even though those capabilities were delayed.

- This phone is unlocked and compatible with any carrier of choice on GSM and CDMA networks (e.g. AT&T, T-Mobile, Sprint, Verizon, US Cellular, Cricket, Metro, Tracfone, Mint Mobile, etc.).
- Please check with your carrier to verify compatibility.
- The device does not come with headphones or a SIM card. It does include a generic (Mfi certified) charging cable.
- Tested for battery health and guaranteed to have a minimum battery capacity of 80%.
Those allegations are not a court finding that Apple committed fraud. The proposed settlement resolves disputed claims without a trial determination or an admission of wrongdoing by Apple.
What Apple advertised
Apple’s 2024 Apple Intelligence campaign presented Siri as becoming more capable and personalized. The disputed expectations included:
- Understanding a user’s personal context;
- Using information across apps;
- Handling more natural, conversational requests; and
- Taking actions involving apps and device functions.
Apple unveiled Apple Intelligence at WWDC in June 2024 and promoted the iPhone 16 in September 2024. The plaintiffs’ theory was that this marketing led consumers to believe the advertised Siri improvements would be available around the iPhone 16 launch, influencing them to buy or pay more for compatible devices.
The complaints also focused on whether Apple’s disclosures that some features were coming later were sufficiently clear and prominent to correct the overall impression created by its advertising. That remains a disputed legal issue, not an established conclusion.
What was actually delayed?
The lawsuit did not establish that all of Apple Intelligence was missing. Apple began releasing some Apple Intelligence features, including Writing Tools, notification summaries, Genmoji, Image Playground, and photo-cleanup functions, in stages. Availability varied by device, software version, language, region, and feature.

The central dispute involved particular personalized Siri capabilities—especially personal-context awareness and cross-app actions—not every Apple Intelligence function. Saying that “Apple Intelligence was unavailable” would therefore be inaccurate.
On March 7, 2025, Apple acknowledged that the more personalized Siri features would take longer than expected and said they were delayed until the following year. Consumers filed lawsuits after that announcement.

What consumers alleged
The plaintiffs alleged that:
- Apple promoted capabilities that were not available when consumers purchased compatible devices;
- Apple knew, or should have known, that the capabilities would not arrive on the advertised timetable;
- The marketing influenced purchases of iPhone 16 models and other eligible devices; and
- Consumers suffered financial harm because they paid for products whose advertised capabilities were delayed.
In legal terms, a delayed software feature is not automatically false advertising. Plaintiffs would generally need to establish more than disappointment, including a legally actionable misrepresentation, consumer reliance, and resulting harm under the applicable laws.
Apple’s response
Apple argued that the plaintiffs overstated the scope of the delay by treating two delayed Siri capabilities as if the entire Apple Intelligence platform had failed. Apple also argued that the complaints did not adequately show that Apple executives knew, when the relevant advertising appeared, that the features would be significantly delayed.

Apple’s broader position was that software features can be delayed for reasons such as reliability, quality, privacy, or engineering readiness, and that the plaintiffs still had to prove legally actionable deception rather than merely a missed timetable.

The proposed settlement does not resolve which side would have prevailed at trial. It also does not mean Apple admitted that its advertising was legally false.
Current status: preliminary approval, not final approval
- Consumers filed separate or related lawsuits after the Siri delay was announced.
- The actions were consolidated in federal court in California.
- The parties proposed a $250 million settlement in May 2026.
- On July 17, 2026, the court granted preliminary approval.
- The settlement must still receive final approval before it becomes effective.
The preliminary-approval order allowed the settlement process to move forward and stayed most further litigation. Preliminary approval means the court found the proposed resolution suitable for the next stage of notice and review. It is not a final judgment on Apple’s conduct.
As of August 18, 2026, the verified record did not establish a later final-approval order, an open claims period, or a payment date. Readers should rely on the final court-approved notice and the official settlement administrator—not social-media posts or outdated articles—for those details.

Who may qualify for a payment?
Under the proposed settlement materials, the class generally covers U.S. consumers and businesses that purchased an eligible iPhone in the United States during the class period of June 10, 2024, through March 29, 2025.

Ownership alone is not enough. Eligibility may depend on the exact model, purchase date, purchase location, class definition, final settlement terms, and whether the person submits a timely and valid claim.
An iPhone bought outside the class period may not qualify even if it supports Apple Intelligence. Likewise, a person who purchased an eligible model outside the United States may not fall within the proposed class. The final court-approved notice controls.
How much could eligible owners receive?
The proposed settlement creates a gross fund of $250 million. Eligible claimants are expected to receive approximately $25 per eligible device as a base amount, with the payment potentially increasing to as much as $95 per device depending on the number of valid claims and other settlement calculations.
The $95 figure is not guaranteed. The $250 million is the gross fund, not the amount available for direct payments alone. Attorneys’ fees, expenses, administration costs, and any court-approved service awards may be paid from the fund under the settlement terms. The final payment also depends on the number of valid claims.
Do not pay a third party or submit information through an unofficial website merely because an advertisement promises the maximum amount. Wait for the final notice or official administrator instructions.

What happens next?
The normal settlement process generally includes final notice, an opportunity to object or request exclusion, a final-approval hearing, claims administration, and distribution of payments if the court grants final approval. The precise deadlines and procedures must come from the final court order and official settlement website.
Until final approval occurs, readers should not assume that:
- The case is finally over;
- Claims are currently open;
- Payments are being mailed;
- Every eligible owner has been contacted; or
- The maximum payment will be $95.
If the settlement receives final approval, a person who wants money will generally need to file a valid claim by the stated deadline. A person who excludes themselves may preserve the ability to pursue an individual claim, while an objector can challenge the settlement without necessarily opting out. Because those choices can carry legal consequences, the final notice should be read carefully.
Why the case matters to consumers
The dispute raises a broader question about technology marketing: how should consumer-protection law treat a major software capability advertised as part of a hardware purchase when the capability is not ready at launch?
Apple can argue that evolving software roadmaps and delayed features are common, especially when reliability and privacy are involved. Consumers can argue that a prominently demonstrated capability may become part of the product’s value proposition, particularly when it helps sell a new phone and is portrayed as arriving with the device.
The settlement avoids a trial ruling on that question. It therefore may compensate qualifying claimants if approved, but it does not create a definitive legal rule that every delayed feature constitutes false advertising.
