The Commission adopted its non-compliance decision on 23 April 2025; Apple and Apple Distribution International filed General Court Case T-354/25 on 30 May 2025. The filing opens judicial review but does not, by itself, suspend Apple’s compliance obligations or prove that the fine has been paid or stayed.
The dispute in plain English
Under DMA Article 5(4), developers using the App Store must be able to tell users about cheaper or different ways to buy digital goods and services outside Apple’s in-app payment system, and direct users to those offers under the law’s conditions. For example, a music, video, cloud-storage, dating or news app could show that a subscription is available on the developer’s website and provide a route to that website.
The Commission said Apple’s technical and commercial rules restricted that communication, steering and resulting transactions. Its decision and legal summary are available from the European Commission and EUR-Lex.
What the Commission found
Article 5(4), not a private damages lawsuit
The case is a DMA non-compliance proceeding followed by an action for judicial review before the EU General Court—not a conventional private antitrust damages claim. The legal basis is Article 5(4) of Regulation (EU) 2022/1925, whose text is available at EUR-Lex.

The penalty and compliance order
The Commission imposed an administrative fine of €500,000,000 and ordered Apple to stop the non-compliant conduct and remove the relevant restrictions. It said the amount reflected the seriousness and duration of the breach. Meta received a separate €200 million DMA fine in the same 23 April 2025 announcement; that is a different case.

What Apple is challenging
Apple’s General Court action contests the Commission’s finding that its App Store arrangements breached Article 5(4), the €500 million fine, and the associated requirements to change the conduct and remove restrictions. Apple has described the penalty as unprecedented and argues that the mandated changes go beyond what the DMA requires. In Apple’s published materials, it also warns that external payments and distribution can make it harder to detect harmful apps, combat fraud and privacy abuse, and provide billing or support assistance. Those are Apple’s stated risk assessments, not a court finding that every external channel is unsafe.

What the appeal does—and does not—change
Filing is not an automatic stay
An appeal asks the General Court to review the Commission decision. Filing it does not automatically suspend the compliance order or restore Apple’s former rules. A suspension would require an applicable interim or other court order, and the sources reviewed do not establish one.
The fine’s payment status is separate
The available official record confirms the action but does not establish that the €500 million has been definitively collected, waived or stayed. Do not treat the appeal as a victory for Apple or as proof that payment has been avoided.
Case T-354/25 is not every Apple DMA case

What changed for EU developers
Apple revised its European terms after the Commission decision, while the Commission continued to assess whether those terms comply with the DMA. Apple’s documentation describes several distinct routes:

Standard App Store terms
The developer uses Apple’s in-app purchase system, with Apple handling much of billing, tax collection, refunds, subscription infrastructure and related commerce tools. External steering remains subject to the applicable standard rules.
External offers and payments
Eligible developers may communicate and promote offers outside Apple’s payment system, subject to Apple’s EU terms, reporting and technical requirements. A developer can still list the app in the App Store while sending a user to an external checkout.
Alternative marketplaces
Marketplace distribution is a separate regime from an external payment link. Apple says alternative app marketplaces are available to EU users on iOS 17.5 or later and iPadOS 18 or later, subject to eligibility and contractual conditions.
Web distribution
Web distribution can move more of installation, billing, support and trust management to the developer. It is not the same as using an external payment link in an App Store app.

How Apple’s EU fees work
Apple’s current documentation does not support one universal “EU commission.” Depending on the selected business terms, transaction type, entitlement, distribution channel and contract, its materials list an initial acquisition fee, a store services fee and a Core Technology Commission. One Apple table lists 2% for an applicable initial-acquisition fee and 5% for certain external transactions under the Core Technology Commission model. These figures are conditional, not a guaranteed rate for every app.
Apple says it is transitioning from the Core Technology Fee toward a Core Technology Commission for applicable EU transactions. Developers should verify the live contractual documents, including Apple’s commissions, fees and taxes documentation and its external-offer communication rules, before choosing a model.
Should a developer switch away from Apple billing?
There is no automatic saving. A developer should compare the applicable Apple charges with payment-processor fees, tax administration, fraud losses, customer support, refund handling, subscription entitlement systems, compliance reporting and any effect on conversion or App Store discovery.
- Revenue model: subscriptions and digital purchases may have different economics from advertising, physical goods or services.
- Transaction volume and value: percentage charges affect high-value sales differently from low-value, high-volume purchases.
- Commerce tools: Apple’s billing, localized payments, family sharing and refund workflows may have operational value.
- Distribution: alternative channels can increase control while reducing App Store reach and user familiarity.
- Support and risk: external checkout shifts account, refund, fraud and chargeback work to the developer or its payment provider.
- Legal uncertainty: Apple’s terms and the Commission’s compliance assessment may continue to change.
What EU users may notice
- Apps may display links or buttons for web purchases and explain that an offer is outside Apple’s billing system.
- Prices inside and outside an app may differ, but developers decide whether to pass through any savings.
- External purchases may require a separate account, payment method or customer-support channel.
- Refund rules, subscription cancellation and fraud assistance may differ from Apple’s App Store process.
- Alternative marketplaces and web distribution can introduce additional phishing, malware, privacy and trust risks; Apple specifically highlights those concerns.
The DMA rules discussed here apply to the European Union. They do not automatically govern the United States, the United Kingdom or every European country outside the EU.

What happens next
The General Court will review Apple’s legal challenge. It could uphold, annul or alter aspects of the Commission decision. The Commission can continue monitoring compliance while the case proceeds. A later appeal to the Court of Justice would generally concern points of law under the EU court system; no outcome or timetable should be assumed.
The Bottom Line
The case is about control of the commercial relationship around iPhone and iPad apps: Apple’s App Store rules versus developers’ DMA right to communicate and transact outside Apple’s system. Until a court or Commission record says otherwise, the fine and compliance order remain distinct from Apple’s appeal, and developers must make EU business decisions under the terms currently in force.
