Amazon and Catamaran announced on August 9, 2021, that they would not renew their joint venture, Prione Business Services, after its scheduled term ended on May 19, 2022. That was also the day the Supreme Court declined to halt a Competition Commission of India (CCI) inquiry into allegations of preferential treatment on e-commerce platforms. The timing is documented; the partners did not say the inquiry caused their decision.
What happened on August 9, 2021?
Amazon and Catamaran, the partners in Prione Business Services, announced they would not renew the joint venture beyond its then-current term. Prione’s wholly owned subsidiary, Cloudtail India, was a prominent seller on Amazon.in. The announcement concerned the future of the joint venture; it was not itself a statement that Cloudtail had already stopped operating.

On the same day, the Supreme Court refused to halt the CCI inquiry into allegations concerning online marketplaces. The Court’s decision allowed the inquiry to proceed; it was not a finding that Amazon had favored Cloudtail. Scroll.in reported the two events on August 10, 2021.
Did the inquiry cause Amazon and Catamaran to end the joint venture?
The available statements do not establish that it did. The partners’ announcement did not cite the court decision or the CCI inquiry as a reason. An Amazon spokesperson separately told The Indian Express that “Both the partners believe that the primary business objectives of the JV have been fulfilled.” That explanation is the stated business rationale in the reporting, not proof that regulatory scrutiny played no role.

The distinction matters: two events occurring on the same date do not, by themselves, establish a cause-and-effect relationship.
What was the CCI investigating?
In January 2020, the CCI ordered an inquiry into allegations about online marketplaces. Its order in Case No. 09 of 2020 described Cloudtail as a seller on Amazon.in and recorded informants’ claims that selected sellers received preferential treatment, including promotion, to the disadvantage of competing sellers. Those statements were allegations recorded in the order, not final findings that Amazon had violated competition law.
The CCI’s 2020 order documents the inquiry and the claims before it. The Supreme Court’s August 2021 refusal to stop the process should not be read as endorsing those claims or deciding their merits.
When did the joint venture end, and when did Cloudtail stop online operations?
The announced non-renewal, the scheduled end of the joint venture, and Cloudtail’s operational cessation are separate milestones:

The dates and operational submission appear in the CCI’s 2022 combination order. The order records a company submission about the planned cessation; it should not be collapsed into the earlier 2021 non-renewal announcement.
What did the CCI decide in its 2022 review?
In March 2022, the CCI announced approval of Amazon Asia-Pacific Resources’ acquisition of 76% of Prione. At that point, the CCI described Cloudtail as Prione’s wholly owned subsidiary and said it was engaged in B2C retail and B2B trading. The Press Information Bureau announcement concerns that transaction, rather than a final ruling on every allegation about Amazon’s past marketplace conduct.

In its July 2022 order, the CCI said alleged preference after the proposed combination did not warrant a remedy in that combination review. It also stated that past conduct, if contrary to the Competition Act, could be dealt with under the law. The Commission wrote: “So far as investigation into past conducts is concerned, it needs no reiteration that past conducts contravening provisions of the Act, if any, would be dealt with as per the provisions of the Act.” Approval of the transaction therefore did not amount to a blanket resolution of historical allegations.

No such conclusion follows from the later approvals cited here. On July 24, 2024, the CCI announced approval of a separate proposed combination involving Appario and Clicktech Retail, among other entities. That development is broader marketplace context, not evidence that Cloudtail resumed selling on Amazon.in. The 2024 announcement concerns those entities and a separate transaction.

What is known about the later court proceedings?
A Supreme Court daily order dated December 13, 2024, lists the CCI v Cloudtail transfer petitions as called for hearing. A docket entry recording a hearing does not establish the final disposition of all subsequent proceedings. The order is available via Indian Kanoon’s reproduction of the daily order.
