Employers can replace or limit AI-mediated reviews and discipline with a structured process led by managers: set job-related expectations in advance, assess accurate evidence, give employees a chance to respond, apply standards consistently, and accommodate disabilities where required. A human process is not automatically fair, but it makes the standards, evidence, and decision-maker visible and open to review.
What are alternatives to AI performance reviews?
The core alternative is a documented, human-led performance process rather than a software score treated as the review. The EEOC’s technical assistance recommends explicit expectations, clear performance standards, accurate measures, reliable feedback, and consistent application to help reduce the chance of discriminatory ratings. The document, Applying Performance and Conduct Standards to Employees with Disabilities, was issued September 3, 2008. It is technical assistance, not a document with the force and effect of law.
In practice, the process can use ordinary tools such as written goals, work samples, documented coaching conversations, and manager review. What matters is whether the evidence reflects the employee’s actual duties, the standard was communicated beforehand, and the person making the decision can explain how they reached it.
Set expectations before the review period
Translate job duties into standards employees can understand before evaluating their work. Describe what successful performance looks like, how it will be assessed, and when feedback will be given. A standard should relate to the work rather than to a vague impression or an unexplained numerical target.
Use relevant, reviewable evidence
Choose evidence that directly reflects the duties being assessed, and explain how it was measured. A manager should be able to identify the underlying work or conduct and describe why it supports a conclusion. If a metric is incomplete, inaccurate, or detached from job duties, it should not carry more weight simply because it is easy to quantify.
Give feedback and invite context
Provide feedback reliably and close to the work rather than relying only on a year-end judgment. Give the employee a chance to respond, correct factual errors, and explain relevant circumstances. Record the evidence and reasoning in terms the employee can understand.

Keep a person accountable for the decision
A manager should make and own the assessment and any discipline decision. This is a practical safeguard drawn from the guidance’s focus on clear standards, accurate measures, and reliable feedback: a software output should not serve as self-justifying evidence. The decision-maker should be able to explain the evidence, the standard applied, and why the outcome follows.
How can managers evaluate employee performance without AI?
A consistent review can be built around the same sequence for each employee, while allowing for differences in job duties and required accommodations.

- Define the job-related expectations. Identify the duties and standards for the period, and communicate them before evaluation.
- Collect evidence tied to those duties. Keep examples of work, results, and relevant feedback; explain how any measure was calculated and what it does and does not show.
- Discuss performance during the period. Give timely feedback and identify what needs to change, rather than waiting until a formal review to raise concerns.
- Invite the employee’s account. Let the employee respond to the evidence, provide context, and identify errors or barriers that may affect the assessment.
- Apply the standard consistently. Compare performance against the stated job-related standard, not an undisclosed or shifting expectation. Consider reasonable accommodation where applicable.
- Document the conclusion. Record the evidence, the standard, the employee’s response, and the manager’s reasoning in clear language.
The EEOC guidance says employers may define jobs and evaluate performance and conduct. For qualified employees with disabilities, it says standards must be job-related and consistent with business necessity, and an accommodation may be relevant when a disability contributes to a performance issue. It also explains that an employee who uses an alternative method of performing a task because of a disability should be evaluated accordingly.
How can employers discipline employees fairly without automated tools?
Use the same basic safeguards for discipline that apply to a performance review: identify the applicable conduct or performance standard, establish the facts, give the employee a meaningful opportunity to respond, and explain the reasoning for the outcome. A human-led investigation is not fair merely because a person conducts it; it should rely on evidence that can be assessed and standards applied consistently.

- Separate the allegation from the conclusion. State what conduct or performance is at issue and what information supports it.
- Check the evidence. Review relevant records and accounts, distinguish firsthand information from assumptions, and correct factual mistakes before deciding.
- Hear the employee. Provide a meaningful way to respond and contribute information, including an accommodation where needed.
- Explain the decision. Connect the established facts to the applicable standard and document the manager’s reasoning.
The EEOC guidance recognizes that an employer may need to provide a reasonable accommodation so an employee can participate in a review or misconduct investigation. It gives the example of a blind employee requesting a Braille or accessible electronic copy of review materials; absent undue hardship, the employer should provide a format the employee can read independently. It also describes accommodation that allows meaningful input during an investigation.

Technology may remain part of a process, but its output should be examined rather than accepted as a neutral verdict. In 2022, the EEOC and Department of Justice warned that software used to monitor performance or inform pay and promotion decisions may disadvantage workers with disabilities. ADA.gov’s employment-technology guidance advises employers to consider impacts across different disabilities and examine tools before and during use for disability screening. It is informal guidance and does not have legally binding effect beyond existing law. A practical review should therefore ask whether the tool’s inputs and outputs reflect job duties, whether employees can understand and challenge an assessment, and whether an accommodation route is clear.
- Check the tool before use and while it is in use for disability-related screening or disadvantage.
- Make the accommodation process accessible and explain how an employee can request help with a technology-mediated assessment.
- Review the underlying evidence and measures rather than treating an automated score as proof.
- Keep an accountable manager responsible for the evaluation and any resulting discipline.
These safeguards synthesize the agency materials; they are not a formal agency scoring framework. The cited sources address U.S. federal law and guidance. Requirements may differ by state, municipality, or country, so employers should verify the rules that apply where their employees work.
When do consumer-report rules matter?
If an employer uses a third-party consumer report as part of an employment decision, federal nondiscrimination rules still apply and procedures under the Fair Credit Reporting Act may apply. State and municipal rules may also matter. The EEOC and Federal Trade Commission discuss these issues in their background-check guidance. This is a limited point about consumer reports, not a general rule governing every performance review or workplace technology.
