Air Canada Strike Disruptions: What Compensation and Rebooking Rights Apply?

Air Canada passengers disrupted by a strike generally do not qualify for APPR inconvenience compensation, but they retain rebooking rights and may choose a refund or free alternate travel if rebooking within 48 hours is unavailable.

A strike does not automatically entitle Air Canada passengers to inconvenience compensation under Canada’s Air Passenger Protection Regulations (APPR). But passengers still have rebooking rights: Air Canada must arrange a seat on its next available flight or a commercial partner’s flight departing within 48 hours of the original departure time. If it cannot, the passenger can choose a refund or free alternate travel. Air Canada’s general claims page does not, by itself, confirm a new strike-specific payment or reimbursement offer.

Is there a new Air Canada compensation policy for strike-affected passengers?

The official Air Canada and Canadian Transportation Agency (CTA) guidance available for this article does not establish the terms of a new strike-specific Air Canada policy. It does not verify any special payment, expense coverage, limits, eligible travel dates, or claim deadline. Air Canada’s disruption page explains its general process for disrupted travel and expenses, but that is not proof of a special strike offer.

For a particular cancellation or delay, check Air Canada’s notices for your booking and travel dates. The CTA advises passengers to contact the airline and monitor its website for an event-specific policy; airlines may offer voluntary fee waivers, but are not required to do so. What must Air Canada do when a strike disrupts a flight?

The CTA classifies a labour disruption within an airline, airport, or air navigation service provider as outside the airline’s control. For an affected itinerary covered by Canadian APPR rules, the airline must rebook the passenger on its next available flight or a flight operated by a carrier with which it has a commercial agreement, departing within 48 hours of the original departure time.

If the airline cannot provide that rebooking within 48 hours, CTA guidance says the passenger may choose either a refund or free alternate travel. The CTA states: “Under the APPR, no compensation for inconvenience is due when a flight disruption is considered outside an airline’s control.” A refund or rebooking is a separate remedy from inconvenience compensation.

Refund rules for flights to, from, and within Canada

The CTA says refund amendments effective September 8, 2022 apply to flights to, from, and within Canada, including connecting flights. For an outside-control cancellation or lengthy delay, when the airline cannot provide the required next-available reservation within 48 hours, the passenger can choose a refund or rebooking. A refund covers the unused portion of the ticket, including unused paid add-ons, goes to the original payment method, and must be provided within 30 days. How strike remedies differ from APPR inconvenience compensation

Air Canada, including Jazz and Rouge, is identified by the CTA as a large Canadian airline. The following compensation amounts apply to qualifying disruptions fully within the airline’s control and not required for safety—not to a disruption caused by labour action simply because the passenger suffered a long delay.

The CTA’s compensation guidance says that when monetary compensation is owed, it must be offered; a voucher can replace it only under specified conditions, including written disclosure of the monetary amount and the passenger’s written choice. Payment goes to the passenger who experienced the disruption, regardless of who bought the ticket.

What to do if your Air Canada flight is affected

  1. Confirm the disruption and your options. Contact Air Canada about the status of your itinerary and the rebooking, refund, or alternate-travel options that apply to your booking. Air Canada’s disruption page covers flights operated by Air Canada, Air Canada Rouge, and Air Canada Express and provides a route to check eligibility and submit claims for disrupted travel and/or expenses.
  2. Check for a notice covering your ticket and dates. Review Air Canada’s website and communications for an event-specific policy. Do not assume a voluntary offer applies to every passenger or covers every expense.
  3. Keep your records together. Retain your ticket and itinerary, disruption notice, rebooking communications, receipts, and correspondence about any claim.
  4. Review insurance terms. Check travel and credit-card insurance wording for labour-disruption exclusions and any covered expenses; coverage depends on the policy, so do not assume it applies.
  5. Use the CTA complaint route if an obligation is not met. The CTA provides a process for air-travel complaints in its labour disruption guidance and flight delays and cancellations guide.

What to verify before relying on an event-specific offer

If Air Canada announces a special policy, confirm that the notice expressly applies to your ticket and travel dates. Check what it covers, any reimbursement limits, required receipts, submission deadline, and whether it is a voluntary offer or a statutory right. Those terms are not established by Air Canada’s general disruption page or the CTA’s standing labour-disruption guidance.
