What was the outcome of Daniel Penny’s criminal case?
Penny was tried in New York over the 2023 subway encounter that preceded Jordan Neely’s death. The two charges had different outcomes:
- Second-degree manslaughter: On December 6, 2024, jurors said they could not reach agreement. At prosecutors’ request, the judge dismissed this count.
- Criminally negligent homicide: On December 9, 2024, the jury found Penny not guilty. It is accurate to say he was acquitted of this charge.
The Manhattan District Attorney’s Office published a statement on the verdict, while contemporary CBS New York coverage describes the separate sequence for the manslaughter count. The verdict should not be described as an acquittal of manslaughter: that count ended with a deadlock and dismissal, not a jury finding of not guilty.
