FTX CTO Gary Wang Sentenced to Time Served, Avoids Additional Prison Time

Former FTX CTO Gary Wang received time served and three years of supervised release after pleading guilty and cooperating with prosecutors. The sentence did not amount to an acquittal.

Gary Wang, FTX’s co-founder and former chief technology officer, was sentenced in federal court in Manhattan on November 20, 2024, to time served and three years of supervised release. He received no additional prison term. That outcome followed his guilty plea and cooperation with prosecutors; it was not an acquittal.

What sentence did Gary Wang receive?

U.S. District Judge Lewis A. Kaplan sentenced Wang to time served and three years of supervised release. In practical terms, “avoids prison time” means Wang was not ordered to serve additional time in prison after sentencing. It does not mean he was cleared of criminal responsibility: he had pleaded guilty in the FTX criminal case. Associated Press reported the sentence and hearing on November 20, 2024.

Why did Wang receive no additional prison term?

Prosecutors pointed to Wang’s early and sustained cooperation, including the practical value of his technical knowledge. In its November 13, 2024 sentencing submission, the government said Wang began cooperating immediately after FTX collapsed and that his early explanation of FTX’s code helped investigators understand the case quickly. Prosecutors also described limits to his role: they said he was not involved in many aspects of the criminal enterprise and that little documentary evidence linked him directly to frauds against customers and investors. The government’s sentencing submission, Document 538, set out its position.

At the hearing, Kaplan described Wang as having “limited culpability,” according to AP. Wang’s cooperation was important to the sentencing context, but it should not be treated as an automatic formula: the sentence was imposed by the judge after considering the case and the parties’ positions. The government’s filing described a recommendation under U.S.S.G. § 5K1.1 contingent on Wang continuing to comply with cooperation terms; that filing was not itself the final judgment.

How did Wang help the FTX prosecution?

Wang testified for parts of three days at Sam Bankman-Fried’s 2023 trial. As FTX’s CTO, he explained technical aspects of the exchange and its code. Prosecutors later cited the usefulness of his technical assistance and continuing cooperation in explaining their sentencing position. AP’s sentencing report covered his trial testimony and the cooperation described at the hearing.

How did Wang’s sentence compare with other cooperating FTX executives?

The three executives received different custodial outcomes. Their roles and records were not identical, so the sentences are useful context, not a like-for-like ranking of culpability.

Is the SEC case part of this sentence?

No. Wang’s criminal sentence is separate from the SEC’s civil securities-law case. The SEC’s December 21, 2022 announcement described charges against Wang and Ellison and proposed settlement terms subject to court approval; that announcement alone does not establish the present status or current effect of those proceedings. The SEC release is an initial announcement, not a current-status update.

The available sentencing sources do not establish every term in the final judgment, any separate forfeiture obligations, later changes to supervised release, or the current status of the civil proceedings. Those questions require the relevant final judgment or current docket.
