Elon Musk’s DOGE Reportedly Accesses Federal Workforce’s Personal Data: Here’s What to Know

Federal court records confirm DOGE-affiliated access to OPM systems containing sensitive data on millions of current, former and prospective federal employees. Here’s what the findings establish—and what they do not.

Reports and court records show that personnel affiliated with Elon Musk’s Department of Government Efficiency (DOGE) received access to Office of Personnel Management (OPM) systems containing sensitive information about current, former and prospective federal employees.

The records included data such as Social Security numbers, birth dates, addresses, phone numbers, salaries, employment histories and disciplinary information. That does not mean every record was copied, publicly released or used for identity theft—and the court findings do not establish that Musk personally opened individual employee files.

What DOGE personnel reportedly accessed

The systems at issue were OPM’s Enterprise Human Resources Integration (EHRI) system and electronic Official Personnel Folder, or eOPF, records. These systems contain personnel and employment information for tens of millions of people, including federal workers, former employees and job applicants.

According to federal court records, DOGE-affiliated personnel received administrative access to OPM systems containing personally identifiable information. The access reportedly included code read-and-write permissions. For approximately two weeks, OPM’s career database administrators also had their access revoked, according to a later court opinion.

In this context, “DOGE-affiliated personnel” did not necessarily mean Musk personally. The term used in litigation covered several groups:

  • People employed by or detailed to the U.S. DOGE Service;
  • OPM employees detailed to the U.S. DOGE Service; and
  • OPM employees assigned to carry out initiatives directed by the U.S. DOGE Service.

The information potentially available through the systems included:

Type of information Why it matters financially
Social Security numbers and birth dates Could be used in attempts to open credit, file tax returns or apply for benefits fraudulently.
Addresses and phone numbers Can support phishing, impersonation and account-recovery scams.
Salary and employment history May help a scammer create a convincing impersonation or target a worker with payroll fraud.
Disciplinary and personnel-file information Could be used in highly targeted social-engineering attempts.

What the executive order authorized

Executive Order 14158, issued on January 20, 2025, created the U.S. DOGE Service Temporary Organization. It directed agency heads, “to the maximum extent consistent with law,” to provide DOGE with access to unclassified agency records, software and IT systems.

That language did not create unlimited permission to use personal information for any purpose. The order also required rigorous data-protection standards, and DOGE’s access remained subject to laws including the Privacy Act of 1974.

The Privacy Act governs how federal agencies collect, maintain, use and disclose records containing personal information. The legal dispute was therefore not simply whether DOGE could enter an agency system. It also concerned whether the access, disclosure and handling of the information complied with the Privacy Act and other applicable rules.

What federal courts found

In March 2025, a federal judge found that OPM had granted DOGE-affiliated personnel access to systems containing personally identifiable information belonging to millions of Americans. The judge concluded that the plaintiffs were likely to show that OPM had violated the Administrative Procedure Act by failing to act consistently with the Privacy Act.

A Maryland court issued a temporary restraining order on February 24, 2025, and later a preliminary injunction restricting OPM and the Department of Education from disclosing the plaintiffs’ sensitive personal information to people implementing the DOGE agenda. The court said the plaintiffs were likely to succeed on claims that the agencies had not complied with the Privacy Act.

In separate litigation involving OPM, a New York federal judge issued a preliminary injunction in June 2025. The government later argued that the case was moot because OPM had adopted new security protocols and no DOGE agents then had access to the plaintiffs’ personal information. That was the government’s position in a motion—not a final judicial finding that all DOGE-related access had ended.

On April 1, 2026, the New York court ordered the names of 16 DOGE agents in the case unsealed. The court said their identities were relevant to questions about who received access, what vetting and training they had, and whether they had a legitimate need to use OPM systems.

What has not been established

The verified record supports a serious access-control and privacy controversy. It does not support every claim circulating online.

Claim What the record supports
“DOGE hacked OPM.” The documented events involve access granted through government systems and credentials, not an external computer intrusion.
“Musk stole every federal employee’s data.” DOGE-affiliated personnel received access to systems holding sensitive information. The records do not prove that Musk personally viewed or took every employee’s records.
“All federal employees’ identities were exposed.” The systems contained information on millions of people, but the cited findings do not establish a public disclosure of every employee’s data.
“The courts ruled the entire DOGE project illegal.” The cases addressed particular access arrangements, disclosures and Privacy Act questions—not every DOGE activity.

Musk was the public face and de facto head of DOGE during the initial controversy. However, the White House described him as a departing DOGE adviser on May 30, 2025. It is more precise to refer to “Musk’s DOGE operation” or “the DOGE initiative Musk initially led” than to suggest that he currently controls OPM data access.

What federal workers should do now

Access to a government database is not the same as confirmed identity theft. Still, Social Security numbers and personnel information are difficult to replace, so affected workers may reasonably take preventive steps.

  1. Check all three credit reports. Go to AnnualCreditReport.com, the authorized free source, and review reports from Equifax, Experian and TransUnion. Look for unfamiliar accounts, hard inquiries, addresses or employers.
  2. Consider a credit freeze. A freeze is free and restricts most new-credit applications until you lift it. Set one separately with Equifax, Experian and TransUnion. Keep the PINs or login details needed to temporarily lift each freeze.
  3. Set a fraud alert if a freeze is not practical. An initial fraud alert can be placed with one bureau, which must notify the other two. A freeze generally provides stronger protection against new-account fraud.
  4. Secure tax and government-benefit accounts. Create or review an IRS online account and use a strong, unique password with multifactor authentication. Also check Social Security and other benefit accounts for unauthorized changes.
  5. Watch existing financial accounts. Review bank, brokerage, credit-card and payroll accounts for unfamiliar transactions or changes to direct-deposit instructions. Contact the institution using the number on your card or statement—not a number in an unexpected email or text.
  6. Be skeptical of targeted messages. A scammer may know your agency, job title, salary range or former workplace. Do not provide an authentication code, password or Social Security number in response to an unsolicited call, text or email.
  7. Report confirmed identity theft. Use IdentityTheft.gov for a recovery plan and report suspicious activity to the relevant financial institution, credit bureau and agency.

Do not mix the OPM issue with the Social Security allegations

DOGE’s reported access to OPM systems is separate from allegations concerning Social Security Administration systems. In the Social Security litigation, the record described access to highly sensitive information, including medical, mental-health, family-court and school records.

A whistleblower report also alleged that DOGE affiliates created a copy of the Social Security Administration’s Numerical Identification System, or NUMIDENT, database and transferred it to a DOGE-controlled cloud environment. NUMIDENT contains information associated with more than 450 million Social Security numbers. The Fourth Circuit noted that these whistleblower allegations were not themselves evidence formally before that appellate panel.

Those allegations should not be treated as proof that OPM personnel files were copied in the same way. They concern a different agency, database and set of court proceedings.

FAQ

Did DOGE access federal employees’ Social Security numbers?

Court records establish that DOGE-affiliated personnel received access to OPM systems containing personally identifiable information, including Social Security numbers and other sensitive personnel data. The cited findings do not establish that every record was copied or publicly disclosed.

Did Elon Musk personally view federal employees’ records?

The court records describe access by DOGE-affiliated personnel. They do not establish that Musk personally opened particular employee files or viewed every federal worker’s information.

Should federal employees freeze their credit?

A credit freeze is a free preventive measure that can make it harder for someone to open new credit in your name. It must be placed separately with Equifax, Experian and TransUnion. Checking your credit reports and monitoring existing accounts are also useful steps.

Is this the same as the DOGE Social Security database controversy?

No. The OPM matter involved EHRI and eOPF personnel systems. The Social Security allegations involved SSA systems and a separate legal record. Claims about a NUMIDENT copy should not be presented as proof that OPM employee records were copied.

The Bottom Line

Federal court records support the central claim that DOGE-affiliated personnel were given access to OPM systems containing highly sensitive information about millions of current, former and prospective federal employees. The courts also raised serious questions about access controls and Privacy Act compliance.

That is different from proof that Musk personally viewed employee files, that every worker’s identity was publicly exposed, or that the data was used for identity theft. Federal workers who are concerned should check their credit reports, consider freezing their credit, secure tax and benefit accounts, and treat unexpected requests for personal or login information as potential scams.
