What prompted the scrutiny?
DePuy International’s ASR XL Acetabular Hip System and ASR Hip Resurfacing System were registered for import and marketing in India in 2006, according to the [CDSCO expert committee report](URL). The report describes serious adverse reactions and premature revision operations—additional surgery to replace or correct an implant. It links the worldwide recall to higher-than-expected revision rates and adverse reactions.
Johnson & Johnson’s 2024 annual report says DePuy announced a worldwide voluntary recall of the ASR XL and ASR Hip systems in August 2010. In the later consumer case discussed below, the company argued that the recall was not an admission of product failure. That was the company’s position in the case, not an independent regulatory finding.
How did the Indian government respond?
A Ministry of Health and Family Welfare expert committee examined the issue. On 29 November 2018, the Ministry announced that the government had accepted the committee report and approved a compensation formula for patients who received ASR implants before August 2010. The formula includes a ₹20 lakh base amount, a disability risk factor, an age factor and ₹10 lakh for non-pecuniary damages, as set out in the [Ministry announcement](URL).

On 2 December 2024, CDSCO listed a notice reconstituting the Central Expert Committee for the ASR compensation process. It said affected patients may approach the central or relevant State/UT committee. The notice also states: “The ASR patients who have already submitted their claim application before the State / UT Level Committee or Central Expert Committee, need not file any fresh claim application.” See the [CDSCO public notice](URL).
What did the 2024 consumer case decide?
In Mrs. Lalita Rajpurohit v. M/S Johnson & Johnson Ltd. & 5 Ors., the National Consumer Disputes Redressal Commission partly allowed the complaint on 3 September 2024. It ordered the company parties to pay ₹35 lakh with 6% annual interest from the date the complaint was filed, while permitting an adjustment of ₹25 lakh if that amount had already been paid. The order is specific to that case; it is not a universal compensation award. The [Commission’s decision](URL) records both the complainant’s allegations and the company’s arguments, which should not be mistaken for findings simply because they appear in the record.

What is established—and what is not?
- Documented issue: The CDSCO report addresses the DePuy ASR systems, their registration in India, reported adverse reactions and premature revisions.
- Different roles: CDSCO’s expert committee report and the Ministry’s compensation process concern regulatory review and patient assessment; a consumer commission decides an individual complaint.
- Unresolved totals: The cited sources do not establish a current India-wide count of people implanted with ASR devices, the number of unresolved claims, or the status of every claimant.
- Scope: These sources support describing ASR as a major documented India-specific controversy, not as the only possible controversy involving Johnson & Johnson in India.
