What OIN’s Larger Linux System Means for Open-Source Patent Protection

OIN’s June 2024 Linux System expansion added projects in cloud, enterprise, networking, embedded, open-hardware and automotive fields. Here’s how the coverage list and OIN 2.0 participation work.

Open Invention Network (OIN) expanded the set of open-source technologies covered by its Linux System patent cross-license on June 12, 2024. The additions reach beyond core Linux into cloud, enterprise, networking, embedded, open-hardware and automotive projects. OIN’s Linux System is a defined coverage list within a patent agreement—not a Linux distribution or software package.

What changed in the June 2024 expansion?

OIN added projects across several technology areas to the Linux System definition used in its patent non-aggression cross-license. The announcement described the periodic expansion as a way to keep the covered definition aligned with the growth of open-source software. OIN’s June 12, 2024 announcement quoted CEO Keith Bergelt: “By design, periodic expansion of OIN’s Linux System definition enables OIN to keep pace with OSS’s growth.”

These names identify additions reported in the June 2024 expansion; they do not by themselves establish whether every version, dependency, use or related patent claim is covered. The applicable Linux System definition and license terms determine scope.

Does OIN protect Kubernetes and other cloud software?

The 2024 announcement identifies cloud projects including Istio, Falco, Argo, Grafana and Spire. It does not name Kubernetes in the listed additions, so that announcement alone is not evidence that Kubernetes was newly added. OIN’s definition is a broader, maintained list, and coverage should be checked against the applicable Linux System table rather than inferred from a project’s category or relationship to another project.

How does the OIN patent cross-license work?

OIN members cross-license Linux System patents to one another on a royalty-free basis and commit to patent non-aggression in core Linux and adjacent open-source technologies within the license’s scope. The agreement therefore creates a shared protection zone for covered code and related functionality among participating members; it is not a blanket waiver of patent rights for every technology or every organization.

The practical question for a company is whether its relevant technology is within the applicable Linux System definition and whether it has agreed to the relevant OIN terms. OIN describes the definition as several thousand discrete code elements and presents the program as a way to address open-source patent risk at scale. Review the OIN FAQ and the current license materials for the precise obligations and scope.

What changed with OIN 2.0 and who pays?

OIN 2.0 took effect on January 27, 2026, with Linux System Table 13 and subsequent coverage expansions. OIN says small businesses, startups and individual developers can participate for free, while medium-sized and large enterprises support the program through tiered annual participation fees. The exact fee applicable to an organization depends on current OIN terms; the available information does not establish specific fee amounts.

OIN’s 2026 announcement describes the updated program and participation model. Organizations should confirm whether they have signed the current OIN 2.0 agreement rather than assuming that earlier participation terms or an older agreement automatically answer that question. How large is OIN’s network and coverage?

OIN’s figures describe different things and were reported at different dates, so they should not be treated as a single timeless count.

What should an organization check before relying on OIN coverage?

  • Check the technologies: Match the relevant project and functionality against the current Linux System table, not just the 2024 announcement.
  • Check the agreement: Confirm whether the organization signed the current OIN 2.0 agreement and review the commitments that apply to it.
  • Check participation terms: Determine which organization-size category and current fee terms apply; free participation is stated for small businesses, startups and individual developers.
  • Keep the scope precise: OIN membership and the cross-license do not establish universal immunity from patent claims outside the defined coverage and agreement.
