How to Claim GST Input Tax Credit on Credit Card Fees for Ecommerce Sales in India

Indian GST-registered ecommerce sellers may claim ITC on eligible GST charged on business payment fees, subject to registration, invoices, supplier reporting, apportionment, and statutory deadlines.

This guide assumes you are an ecommerce seller registered under India’s GST. You can generally claim input tax credit (ITC) on GST charged on eligible payment-processing or merchant fees used for your business—but only if the statutory conditions are met and the fee is supported by the right tax document. A deduction on a settlement statement, by itself, is not enough.

First identify which charge you are claiming

For an online sale, the fee may relate to payment aggregation and settlement, gateway technology, acquiring, or another service. Check the provider’s agreement and tax invoice to identify the service, supplier, recipient, and GST charged. The payment provider’s fee for processing your customer’s payment is different from the cardholder’s credit-card bill, interest, or other charges.

CBIC explains that GST is not charged on the entire credit-card bill, but on the fee or commission charged by the card company. It also says card-settlement fees are consideration for a separate transaction between banks and are liable to GST. These general explanations do not settle the classification or invoice details of every ecommerce provider’s charge; use the actual service and invoice for your case. Check whether the fee qualifies for ITC

Section 16(1) of the Central Goods and Services Tax Act, 2017, says: “Every registered person shall, subject to such conditions and restrictions as may be prescribed and in the manner specified in section 49, be entitled to take credit of input tax charged on any supply of goods or services or both to him which are used or intended to be used in the course or furtherance of his business”. The conditions are material: being charged GST does not automatically make every amount deductible as ITC.

  • You must be a registered person. An unregistered seller cannot claim GST ITC merely because a provider deducted a fee from a payout.
  • The service must be for your business. The service must be used or intended for use in the course or furtherance of your business.
  • The invoice must identify your business as recipient. Check that it is addressed to the GST-registered business that is claiming the credit, with the relevant registration details and invoice particulars.
  • The service must be received and the tax conditions met. The statutory conditions include receipt of the service, payment of the tax by the supplier, and filing the required return.
  • Check restrictions and apportionment. Section 17’s blocked-credit rules still apply. If the fee relates to both taxable or zero-rated supplies and exempt supplies, restrict or apportion credit as required. An ordinary merchant service fee is not identified in the cited sources as a general blocked-credit category, but that does not remove the need to check your circumstances.

Reconcile the invoice before claiming

  1. Obtain the provider’s tax invoice or other prescribed document. A settlement statement or payout report can help reconcile the deduction, but it does not substitute for the prescribed tax document supporting ITC.
  2. Check the document. Verify the supplier, your business and GST registration details, description of the service, taxable value, tax charged, and applicable invoice particulars. CBIC’s tax invoice and credit/debit note guidance covers invoice requirements.
  3. Match the document to supplier-reported information. Reconcile the invoice with inward-supply information and returns as applicable under the rules. Follow up with the provider if the document is missing, incorrect, or not reported as expected.
  4. Keep the supporting records together. Retain the invoice, service agreement or fee schedule, settlement records, reconciliation, and relevant return records so the business purpose and claimed amount can be substantiated.

Distinguish payment aggregators from gateways

CBIC Circular No. 55thGSTC-Services distinguishes payment aggregators, which receive, pool, and transfer funds to merchants, from payment gateways, which provide technology to route and facilitate online transactions without handling funds. The circular describes a limited exemption for RBI-regulated payment aggregators in relation to the payment-settlement function for an amount up to ₹2,000 in a single transaction paid through a payment card. It says the exemption does not cover payment gateway services.

This ₹2,000 limit is not a general threshold for claiming ITC on merchant fees. Do not assume that every gateway, acquiring, processing, or merchant-discount charge is exempt—or taxable—based only on the provider’s label. Identify the actual service and rely on the applicable invoice and agreement. Read CBIC Circular No. 55thGSTC-Services.

Track the supplier-payment condition and ITC deadline

Section 16 includes a 180-day condition for payment to the supplier. If the recipient does not pay the supplier the value of the supply and tax within that period, the rules require reversal or payment of the corresponding ITC, with re-availment provisions when payment is made. Apply this to the provider relationship and relevant accounting records, rather than treating a payout deduction as proof that the condition is satisfied.

There is also a statutory time limit for taking ITC. The applicable deadline depends on the current amended law and the financial year involved; check the version in force and the relevant return position before filing. Do not rely on an older calendar or assume the same deadline applies to every financial year. The 180-day period and the claim deadline are separate requirements under section 16.

What to do when the records do not line up

  • You have only a net settlement report: request the tax invoice or other prescribed document from the provider; do not claim solely from the payout deduction.
  • The invoice names the wrong recipient or lacks key details: ask the provider to correct or reissue it before treating the tax as your ITC.
  • The invoice does not appear in reported inward-supply information: reconcile with the provider and resolve the reporting discrepancy, while checking the applicable conditions and filing deadline.
  • Your business makes exempt as well as taxable supplies: determine the appropriate restriction or apportionment instead of claiming the full fee tax automatically.
  • The provider calls the charge a gateway, aggregator, or settlement fee: verify the service actually supplied and apply the specific treatment reflected in the agreement, invoice, and relevant GST rules.
