Can You Legally Receive Crypto From a Sanctioned Wallet?

Whether you can receive crypto linked to a sanctioned wallet depends on jurisdiction, the applicable OFAC program, property interests, and any authorization—not an address match alone.

Can you legally receive crypto from a sanctioned wallet? There is no universal yes-or-no answer based on a wallet address alone. Under U.S. sanctions administered by the Treasury Department’s Office of Foreign Assets Control (OFAC), the result depends on the applicable sanctions program, whether a blocked person has an interest in the crypto, the parties and jurisdiction involved, and whether an exemption or license authorizes the transfer. If a real transfer may involve blocked property, do not move or spend it until a qualified sanctions lawyer or OFAC has assessed the facts.

Why a wallet address alone does not decide legality

OFAC defines a digital currency address as an identifier associated with a wallet, and a wallet as a means of holding, storing, and transferring digital currency. The legal obligations concern blocked persons, property interests, prohibited activity, jurisdiction, and the specific sanctions program—not simply whether an address appears in a screening result. An address match can be an important warning, but it does not by itself establish who owns or controls the crypto or whether the proposed transfer is prohibited. OFAC FAQ 560

What determines whether you may receive the crypto?

For a U.S.-connected transaction, work through these questions before treating a transfer as lawful or prohibited. The applicable sanctions program and facts control the result.

  1. Does OFAC jurisdiction apply? Identify the recipient’s citizenship, location, entity status, and other relevant U.S. jurisdictional links. The rules discussed here concern U.S. sanctions; other countries may impose separate requirements.
  2. Which sanctions program applies? Determine whether it imposes blocking sanctions or another kind of restriction. Some prohibited activity can require rejection even if there is no property interest that must be blocked.
  3. Who is the sender, and for whom are they acting? Check whether the sender is a blocked person, is acting on behalf of one, or is an entity treated as blocked under OFAC’s 50 Percent Rule.
  4. Does a blocked person have an interest in the crypto? Do not infer the legal answer from an address match alone. The relevant question is whether a blocked person has a property interest in the crypto being transferred.
  5. Does an authorization apply? Check whether an exemption, general license, or specific license covers the proposed transaction. Authorization can change what is permitted under the relevant program.
  6. Has an intermediary already blocked the funds? If an exchange, bank, or other institution has frozen the crypto, find out what it blocked and what reporting or release process it requires.

OFAC generally requires property in which a blocked person has an interest to be blocked when it is in the United States or in a U.S. person’s possession or control. Blocking, rejecting, and the 50 Percent Rule

Blocked property is frozen, not seized

Blocking generally freezes property; it does not transfer ownership to the government. OFAC states that “Title to the blocked property remains with the blocked person.” Transfers and other dealings are generally prohibited without authorization, and property can include financial and intangible assets. OFAC FAQ 9

Blocking and rejecting are different responses

“Block” and “reject” are not interchangeable. The correct action depends on whether a blocked person has an interest in the property and on the applicable sanctions program. A license or exemption may also affect the required treatment. OFAC FAQ 11

An entity can be blocked without appearing as a named listing

Under OFAC’s 50 Percent Rule, an entity is treated as blocked when one or more blocked persons own, in aggregate, 50 percent or more of it. The entity need not be separately named on an OFAC list for the rule to apply. OFAC FAQ 401

What if an exchange freezes crypto sent from a sanctioned address?

A freeze means the exchange is restricting access; it does not, by itself, resolve whether the address match was accurate, whether a blocked person has an interest in the crypto, or whether an authorization applies. Ask the institution to explain the basis for the block and its process for providing information or requesting release. An institution may notify a customer that it blocked digital currency, and the customer may apply to OFAC for release. OFAC FAQ 657

If you believe the freeze resulted from mistaken identity or a typographical error, OFAC describes a correction process. Do not try to bypass the institution’s controls or transfer the crypto elsewhere while the issue is unresolved. Releasing property that actually has a blocked person’s interest without authorization could expose U.S. persons to civil penalties. OFAC FAQ 646 OFAC FAQ 658

What should you do if you accidentally received potentially blocked crypto?

  1. Do not move, spend, swap, or return it on your own. A further transfer may itself be a dealing in property that must remain blocked. This is a practical precaution, not a conclusion that every transfer from an exposed address is prohibited.
  2. Preserve the transaction details. Keep the transaction identifier, relevant address information, time and amount, exchange notices, and communications about the transfer. Do not alter records or conceal the transaction.
  3. Contact the exchange or custodian if it is involved. Ask whether it has blocked the funds and what information or process it needs. Follow the institution’s instructions while obtaining legal advice.
  4. Have a qualified sanctions lawyer assess the facts. The analysis should address jurisdiction, the specific program, the sender and any principal, property interests, possible 50 Percent Rule ownership, and any applicable authorization.
  5. Follow applicable blocking and reporting requirements if you determine the crypto must be blocked. For a U.S. person who determines that virtual currency must be blocked, OFAC says to deny all parties access, use controls that prevent unauthorized release, and comply with holding and reporting rules.

OFAC says blocked virtual currency must be reported within 10 business days and annually for as long as it remains blocked. It need not be converted to fiat currency or held in an interest-bearing account. The 10-business-day deadline is OFAC’s stated deadline for the initial report, in FAQ 646, released October 15, 2021.
